Finnegan recently achieved a settlement for a Korean War veteran, resulting in assignment of a 1993 effective date for the veteran s service-connected bilateral hearing loss and tinnitus. As a result, the veteran received over $50,000 in disability back-pay. The CAVC also awarded $5,763 for attorney fees. The firm donates all attorney fees it receives to veterans organizations. We obtained a successful result for our client, who was facing a Notice to Quit her apartment, in a Landlord-Tenant matter Vault.com Inc.
3 in DC Superior Court. The case centered on allegations of conduct inconsistent with our client s lease and Federal Housing program regulations. Noting the plaintiff s lack of evidence, we determinedly pushed for discovery, which plaintiffs ultimately provided before mediation. At the mediation, we successfully negotiated a settlement agreement that allowed the client to remain in her apartment. We represented Mr. W in a 5-year battle for Social Security Disability benefits, through three hearings and two appeals, and finally won his case last fall including a significant back payment for benefits for which he s been qualified for several years. List up to three pro bono matters that are highlights (e.g., a Supreme Court case). Please limit your answer to a short paragraph per matter. Our Finnegan team served as guardians ad litem (GALs) to two minor children, aged 6 and 8, in a contentious custody battle that started in The issues included allegations that one of the parents unilaterally admitted one of the children into a psychiatric institute without basis and was unilaterally medicating the children, and allegations that the other parent refused to medicate and lied about it. We conducted extensive fact investigation and discovery, including meeting with the children s parents, doctors, social workers, and schools; collecting and reviewing hundreds of pages of medical records and other documents; and eliciting key testimony in depositions. Ultimately, we were able to work with the parents to reach a joint settlement in the best interests of the children, including an agreement that they would share custody and work to communicate more effectively. Our GAL team represented the children at trial on the remaining issues, and a decision on those issues is forthcoming. We were successful in overturning the conviction of a client who was sentenced to 37 years in prison after being convicted of first-degree murder. After uncovering significant evidence in a post-conviction hearing of government malfeasance at the time of our client s trial, we filed a motion requesting a new trial as well as wide-ranging discovery. The court granted limited discovery. After reviewing the production and identifying additional avenues of relief for our client, we argued for and won additional discovery. Shortly thereafter, the government withdrew its opposition to our motion for a new trial and the court dismissed the case against our client. We represented inmate Mr. T, and filed suit against Fulton County, Georgia, claiming multiple incidents of abuse at the hands of Fulton County prison guards. The assigned Federal judge asked Finnegan to handle this 1983 matter on Mr. T s behalf. Investigation revealed that despite Mr. T specifically requesting preservation of certain videotaped and documentary evidence that would substantiate his claims, the evidence was lost or destroyed by Fulton County in direct violation of its own written procedures. Fulton County has been sanctioned for spoliation of evidence, and the judge has ruled that a favorable instruction will be given to the jury regarding the lost evidence. The firm has proudly supported the Howard University School of Law Institute of Intellectual Property and Social Justice (IIPSJ) for 11 years. Finnegan partners with Howard to present the annual IIPSJ conference. This program, which is co-chaired by a Finnegan partner, also includes other Finnegan partners that present at different sessions throughout the two-day conference. In addition, Finnegan s attorneys have taught an advanced patent law and social engineering course as part of the law school s curriculum since We also teach an introduction to patent law class at the law school, and an intellectual property class at Howard s undergraduate engineering school. In 2014, Finnegan attorneys donated a combined 4,858 hours to represent veterans at the U.S. Court of Appeals for Veterans Claims and the Court of Appeals for the Federal Circuit. The firm was awarded attorneys fees in a large number of cases by the courts, and in turn donated those fee awards to charitable organizations serving veterans and their families. The firm donated over $556,500 to veterans charities around the nation, including the Disabled American Veterans National Service Foundation, Fisher House Foundation, National Veterans Legal Services Program, Shepherd Center Foundation, New England Center for Homeless Veterans, Wounded Warrior Project, and USO of Metropolitan Washington. In 2013, five Finnegan attorneys joined with the American Bar Association (ABA) to publish the Veterans Appeals Guidebook: Representing Veterans in the U.S. Court of Appeals for Veterans Claims. The publication addresses the basics of veterans-related appeals to the U.S. Court of Appeals for Veterans Claims (CAVC), including jurisdiction issues, and the process from pre-briefing through post-briefing. The Finnegan Diversity Scholarship, established in 2003, includes a monetary award for tuition and law school fees, as well as an offer to join the firm s summer associate program. To date, the firm has hired 30 summer associates and has awarded nearly $350,000 via our Diversity Scholarship program. For more than 20 years, Finnegan has hosted the finals of the International Trademark Association s (INTA) Lefkowitz Moot Court Competition. The competition honors Saul Lefkowitz, longtime Chairman of the TTAB and former of counsel to the firm. Regularly attracting teams from more Vault.com Inc.
5 than 80 law schools around the country, the competition has become a signature event for INTA. The Finnegan Prize Competition is an intellectual property writing competition open to all students enrolled in the George Washington University Law School. The prizes consist of cash awards of $5,000 for first place; $2,000 for second place; and $1,000 for third place. To receive the Finnegan Prize a paper must be of publishable quality and make a significant contribution to the theory and practice of intellectual property law. Finnegan provides financial support to a number of direct legal services providers dedicated to meeting the unmet needs of the poor in our community. Finnegan coordinates a program with the George Washington University Law School under which students are paired with Finnegan lawyers representing veterans in appeals to the Court of Appeals for Veterans Claims. Students have the opportunity to draft pleadings and potentially participate in oral argument. What non-law related volunteer opportunities does your firm offer? On August 13, 2013, the Disabled American Veterans (DAV) presented Finnegan with the Exceptional Donor Award in recognition of extraordinary generosity to the DAV National Service Foundation. Finnegan is the first recipient of the award, and is the first donor, corporate or individual, to exceed $1 million in lifetime giving. On Friday June 14, 2013, the Fisher House Foundation presented Finnegan with the Fisher House Patriot Award. Established in 2002, the award recognizes the extraordinary efforts of individuals and organizations supporting the quality of life of military service men, women, and their families.
