Yes, the committee meets on an ad hoc basis, but at least once a year in person at the annual member s meeting. Describe the composition of the committee. The committee is comprised of the attorney pro bono coordinator, the chair and 12 additional members, for a total of 14 members. Committee members are appointed by the chair of the committee and approved by the chairman. Dykema attempts to obtain representatives from every office. All committee members (with the exception of the coordinator) are members or of counsel with the firm. THE SCOOP Does your firm have a written pro bono policy? Can associates bring pro bono matters of interest to the firm? How does the firm decide whether to take on a pro bono matter? The firm has a formal pro bono policy which governs that cases that are eligible for pro bono representation. Generally speaking, pro bono work must fall within the following four categories: Poverty law: providing legal services to the poor; Civil rights/public rights law: legal representation vindicating the right of an individual or group which society has a special interest in protecting; Administration of justice: Any activity which directly increases the availability of legal services for persons of low income; Charitable organization representation: Legal services to charitable, civic, governmental or educational institutions where the payment of customary legal fees would significantly deplete the organization s economic resources or would otherwise be inappropriate. For these organizations, the mission statement and recent financial report of the organization are considered in determining eligibility for pro bono legal services. Each matter proposed is reviewed by a member of the firm s pro bono committee for approval. It is then submitted to the attorney s practice group leader for approval. Dykema encourages attorneys to find pro bono matters that most interest them and that they have the expertise to handle. Has the firm signed on to the Pro Bono Institute s Law Firm Pro Bono Challenge? What are some of the areas of law in which your firm performed pro bono legal work in 2007 and 2008? We perform a wide variety of pro bono work in almost every area of the law. We are involved in both large scale impact pro bono matters and individual pro bono matters. Some areas of the law include: Civil rights Death penalty matters Cases for the return of children under the Hague Convention on Civil Aspects of International Child Abduction Asylum VAWA applications and Special Immigrant Juvenile Status matters Housing issues including lockouts, evictions and other landlord tenant matters Consumer tax matters Community development Corporate/legal audits for nonprofits Family and domestic relations matters, including representing victims of domestic violence in proceedings related to personal protection orders and other matters Guardian ad litem Adoptions Probate/estate matters Title disputes/foreclosure actions Disputes regarding insurance benefits Assisting with clinics and programs offering legal intakes Vault.com Inc.
3 What are some of the areas of law in which your firm did not perform pro bono work? We do not handle matters for religious organizations unless the issue affects a larger group (e.g., we have represented a church seeking a warming center in the community). List up to 10 organizations for which your firm performed pro bono legal services in 2007 and Legal Aid and Defender of Southeastern Michigan Community Legal Resources Farmworker Legal Aid ABA Death Penalty Project Institute for Justice National Immigrant Justice Center Justice for Our Neighbors Western Michigan Legal Aid South Central Legal Aid of Michigan County Bar Association Barristers AIDS Legal Services Project Chicago Volunteer Legal Services Chicago AIDS Legal Council Community Economic Law Development Project List up to three pro bono matters that are representative of the pro bono work your firm participates in. Children s Hospital of Michigan Legal Clinic: In 2008, Dykema teamed with one of its clients to represent pediatric patients and their families. We are handling cases referrals involving SSI benefits and landlord tenant disputes. International kidnapping matters: Dykema lawyers represent left behind parents seeking the return of their abducted children to their home country. These matters are referred by the State Department and are resolved through briefing and/or evidentiary hearings in federal court. Special Immigrant Juvenile Matters: We represent several children seeking permission to remain in the United States as reunification with family members in their country of origin is impossible due to severe abuse or abandonment. Dykema lawyers handle and supervise up to three concurrent legal proceedings to ensure the children receive a visa and a work permit and eventual citizenship. List up to three pro bono matters that are highlights: Death Penalty: Dykema represents Jimmy Meders, a Georgia death row inmate. In an unusual move, the Georgia Supreme Court granted Mr. Meders request for an evidentiary hearing on the issue of previously undisclosed evidence, ineffective assistance of counsel and prosecutorial misconduct. The two day hearing on death row was the culmination of almost 1000 hours of time invested by the Dykema team. The firm expects a ruling on Mr. Meders request for a new trial in Appeals: the 7th Circuit decided an issue of first impression in favor of a firm client, reversing a ruling from the Board of Immigration Appeals which had upheld our client s removal from the United States for having committed a crime of violence under 18 U.S.C. Section 16(b). On our petition for review of the BIA s order, Dykema successfully argued that our client s offense could not be considered a crime of violence because his crime was simply one of recklessness. Following on a Supreme Court case holding that drunk driving was not a crime of violence under Section 16(b) (Leocal v. Ashcroft, 534 U.S. 1 (2004)), the Seventh Circuit held that crimes of violence, as defined by Section 16(b), are limited to society s most serious offenses offenses that do not include reckless or accidental conduct. SUPERVISION AND EVALUATIONS Is there partner supervision on all pro bono matters? No, but it is available when requested or needed. Do partner supervisors or, if applicable, senior associates provide written evaluations of associates work on pro bono matters? REQUIREMENT Is there a pro bono requirement at your firm? What is the requirement and to whom does it apply? Each full time associate, member and of counsel must perform 30 hours of pro bono or donate $300 to a legal aid agency of their choice. HOURS Does the firm give billable hour credit for pro bono work? Does the firm have a maximum number of pro bono hours that can be applied toward the billable hour target? No. If your firm uses hours to determine bonuses, does it consider pro bono hours when determining bonuses? PRO BONO POINTS What training opportunities are open to associates working on pro bono matters? Dykema offers many formal training opportunities in handling pro bono matters. Dykema has held in-house training in specific areas, where we work with staff from various outside agencies to coordinate training programs (e.g., representing clients various immigration matters, handling simple family law matters, handling prisoners rights matters, handling guardianship and handling matters for grandparents, drafting simple wills and powers of attorney). Partners are always available to assist associates with matters to the extent requested. Dykema also believes in providing substantive pro bono work that will provide an attorney training to develop his or her overall skills as an attorney. Our associates report that the pro bono matters offer immediate courtroom exposure and trial experience. Does the firm offer the use of support staff in handling pro bono matters? What pro bono opportunities are available for summer associates? The firm provides pro bono assignments especially tailored for summer associates as well as offering them an opportunity to work with firm attorneys on already established pro bono clients. In Michigan, our summer associates are oriented to the firm s pro bono offerings, work with several attorneys on their pro bono projects, and were also able to participate in an Intake Day at the Detroit Legal Services Clinic. In Chicago, our summer associates in 2008 were each assigned a case from the Chicago Volunteer Legal Services (CVLS). Each summer associate obtained a law student license which permitted them to appear and argue in court, under the supervision of a mentor attorney. Although CVLS and Dykema mentor lawyers provided close supervision, the summer associate assumed primary responsibility for their matter. Total associate pro bono hours: Average hours per associate: 27.5 What percentage of summer associates in your firm s U.S. office(s) engaged in pro bono work in 2008? 100 percent. Does the firm have established programs, such as externships, that enable its associates to work in a public interest setting? The firm participates in the Public Interest law Initiative Fellowship Program. The PILI Graduate Fellowship Program, created in 1983, provides incoming first year associates the opportunity work for a PILI-affiliated legal aid agency during their bar exam summers the summer before the associates begin work at their firms. It is a program open to young lawyers with offers at Chicago-based firms. Its purposes are to give young lawyers experience and training in public interest law, to encourage young lawyers to develop long term interests in pro bono practice and to provide public interest agencies with much needed assistance. The fellow is in residence at the agency and will work approximately 300 hours over the course of her fellowship. What other law-related public interest and community service programs do you offer and manage? Dykema Gossett financially contributes to a wide variety of public interest and community service programs, in the communities in which it practices. Some of these projects include sponsorship of scholarship Vault.com Inc.
5 opportunities through Women Lawyers Association of Michigan and Wolverine Bar Association (a minority bar association). We also sponsor a Dykema Gossett distinguished professorship at the University of Detroit- Mercy Law School. We provide a matching contribution to the University of Michigan Student Funded Fellowships for law students who work in unpaid public interest jobs during the summer. We also assist the local law schools by providing attorneys to coach and judge moot court and related competitions. Finally, Dykema matches any attorney or summer associate s donation to their law school up to $100. What non-law-related volunteer opportunities does your firm offer? Dykema attorneys are very active in community activities, both through their local bar associations and in the community at large. Dykema staff and lawyers coordinate work days at local soup kitchens and Ronald McDonald Houses. Dykema also sponsors a team for the annual Komen Detroit Race for the Cure. Many of Dykema s lawyers sit on boards of various not-for-profits, community colleges and community groups. Additionally, through the Detroit Metropolitan Bar Association (DMBA), our attorneys have participated in an annual Fun Run to benefit a local youth residence for troubled girls. Our attorneys also participate in an adopt a school program, in which the DMBA has partnered with a local Detroit High School to sponsor various programs, including an essay contest, career day events, the ABA s Law Day program, internships and scholarships. Has your firm won any special recognition or awards in 2007 and 2008 for its pro bono work? 2008 In July 2008, Dykema was honored as Community Legal Resource s pro bono partner of the month. In May 2008, two lawyers in our Chicago office were awarded an Award of Excellence from the Judge Coar of the United States District Court for the Northern District of Illinois. In October 2008, our CEO Rex Schlaybaugh was recognized as a Friend of LAD Award. This very special award honors those who enable Legal Aid and Defender Association (LADA) to have a broader impact on the LADA s client community. Dykema is a member of the State Bar of Michigan s Circle of Excellence. This award acknowledges firms that meet or exceed the state s voluntary standard for pro bono service. Ranked by American Lawyer as one of the top-100 firms for pro bono service in firms that meet or exceed the state s voluntary standard for pro bono service. THE FIRM SAYS Dykema believes the practice of law, especially in a large commercial firm, is a privilege that carries with it profound societal responsibilities. Performing legal services for those who cannot afford to pay for them or for organizations that benefit such persons is a central part of our effort to improve the quality of life for the underserved in our community. We perform pro bono service because it is simply the right thing to do. Dykema s pro bono work involves serious issues that impact people s lives in significant ways. Our lawyers approach it with the same type of focused commitment that we bring to every client. From recovering abducted children for left behind parents across international borders, ensuring due process for death row inmates, securing political asylum for activists from all corners of the world, assisting an AIDS victim with estate planning, or providing a full range of legal services to non profits that serve underserved groups, our pro bono work represents a convergence of two Dykema values: dedicated client service and a commitment to serving the underserved. We strive to achieve justice and equality for people who otherwise would have nowhere to turn. More than a decade ago, our firm adopted a policy which requires each attorney at our law firm to perform a minimum of 30 hours of pro bono service or donate $300 to a legal service agency of their choice. This program allows each of our lawyers to contribute to the needs of the underserved in some way. Last year, this commitment translated into the firm s lawyers recording over 11,200 hours to pro bono clients and in July 2008, Dykema was ranked as one of the top 100 law firms by American Lawyer for our comprehensive pro bono efforts Heroes of Breast Cancer Community Service Award, awarded to Dykema for its pro bono work associated with the annual Race for the Cure.
