Lawyers in all three of Milbank s U.S. offices have worked on Shadow Letters in collaboration with the Center for Reproductive Rights. These Shadow Letters help to hold countries accountable for their human rights obligations by providing a detailed record of their record to United Nations Treaty Monitoring Bodies, which through periodic reviews oversee countries compliance with international human rights treaties. The Shadow Letters supplement information submitted by governments and highlight lapses in countries implementation of their international human rights obligations. The shadow reporting process is crucial to shed light on human rights violations and advocate for national-level legal and policy changes. Milbank lawyers have worked on Shadow Letters involving Kenya, Rwanda, Nepal and Pakistan. Divorce matters: Annually, our New York office handles dozens of uncontested divorce matters, many of which involve domestic violence and abuse. Adoptions: our Los Angeles office takes handles numerous adoption cases each year from Public Counsel. They often participation in Adoption Day they sponsor along with the Los Angeles Juvenile Court, the Alliance for Children s Rights and the Los Angeles Department of Children and Family Services. 3 List up to three pro bono matters that are highlights (e.g., a Supreme Court case). Please limit your answer to a short paragraph per matter. Milbank obtained a landmark settlement in a civil rights lawsuit affecting over 30,000 New Yorkers with disabilities. The class action law suit, Lovely H. v. Eggleston, was filed in 2005 in Federal Court in the Southern District of New York because low-income New Yorkers with disabilities were being denied access to benefits by the City s welfare agency, the Human Resources Administration. Lovely H. challenged HRA s rules and systems for people with disabilities who receive cash assistance, SNAP and Medicaid. The case alleged that HRA programs and systems did not comply with federal, state and local laws protecting individuals with disabilities - failing to provide the accommodations clients need to comply with HRA rules. The lawsuit alleged that without needed accommodations, clients were losing benefits when they could not comply with HRA rules and were put at risk of hunger and homelessness. HRA agreed to change some rules and systems to make Cash Assistance and SNAP programs and benefits more accessible to people with disabilities by improving the screening clients for disabilities, providing faster access to help and more case management services, and better prevention of lost benefits related to disabilities. The settlement represents a sea change in the way people with disabilities will be served. In a class action litigation where Milbank is co-counsel with the Disability Rights Legal Center (DRLC), Milbank and the DRLC litigated against various governmental agencies for years in an effort to provide special education and related services to eligible students with disabilities incarcerated in the Los Angeles County Jail, as required by federal and state law. On behalf of lead plaintiff Michael Garcia and the certified class of similarly situated individuals, Milbank and DRLC obtained summary judgment against certain defendants and fought an appeal filed by the Los Angeles Unified School District (LAUSD). In December of 2013, after Milbank s arguments before the California Supreme Court, the Court issued a 7-0 decision written by Chief Justice Cantil-Sakauye, agreeing with Milbank and DRLC that the LAUSD was the education agency responsible for providing special education and related services to Mr. Garcia during his detention in the Los Angeles County Jail. This decision, which answered a question certified to the California Supreme Court by the United States Court of Appeals for the Ninth Circuit, will impact the educational programs available to detainees in jails throughout the state of California. Milbank and the DRLC are in the process of finalizing and seeking approval of various class settlements with different defendants, making great strides toward developing a comprehensive system for providing special education and related services to students with disabilities detained in the jail. In a dramatic development in a death penalty case spanning three decades, Milbank secured a court order vacating the death sentence of a Louisiana man convicted of rape and murder in In May of 2014, Milbank and the prosecution jointly moved to have John Francis Wille, who was convicted in the 1985 rape and murder of an eight-year-old girl in a parish near New Orleans, resentenced to life imprisonment. He is currently serving his sentence in the Louisiana State Penitentiary (at Angola). This is an important first step in an ongoing battle to overturn his conviction and demonstrate that he is actually innocent. The Milbank team asserted that Mr. Wille s constitutional rights were violated because, among other things, he was deprived of the effective assistance of counsel at trial and did not receive complete disclosure of material exculpatory evidence in the hands of law enforcement. Milbank also argued that newly tested DNA evidence demonstrates Mr. Wille s innocence. The sole direct evidence against Mr. Wille in his 1986 trial was his confession (along with those of his girlfriend and her daughter). All of these confessions were recanted, and Milbank argues they are demonstrably false and were procured by coercion and improper police conduct. At trial, the jury never heard key evidence that would have undermined the confessions in part because Mr. Wille s lawyers, one of whom was assigned the case to satisfy his sentence for a felony conviction, never mounted a defense or developed a strategy for challenging the confessions. Milbank continues to fight to overturn his conviction and demonstrate that he is actually innocent. Many of the programs offer training, and the firm maintains an extensive library of training materials, which includes pro bono training. A number of specialized projects, including uncontested divorces, wills, family law, name changes, and special immigrant juvenile status work are available as well as many of the same opportunities offered associates. We make a special effort to include and indoctrinate summer associates in the pro bono ethic. Does the firm have established programs, such as externships, that enable its associates to work in a public interest setting? Please describe the established program(s) and their duration, if applicable. First year associates can participate in a 10-week fellowship at a pro bono program of their choosing. In 2014, a total of 45 associates, or half the class, participated in the program. Since its inception in 1990, nearly 400 associates have participated in Milbank s fellowship program donating nearly 200,000 hours. Milbank contributes money to various public interest programs, and encourages board service on legal aid boards, law teaching, bar association services and volunteer mediation and arbitration, for example. 5 Please add any additional information about your firm s pro bono program. Milbank has a long and proud tradition of pro bono service. We have one of the oldest law firm pro bono programs in the country, and we are one of the few firms in the country to have both a full-time partner in charge of public service and an experienced attorney to coordinate pro bono. We are an early signatory to the American Bar Association s Law Firm Pro Bono Challenge, and every lawyer is encouraged to meet this 3 percent/60-hour standard, In addition, we require every domestic lawyer to do at least 20 hours of pro bono work per year. Milbank s public service department works closely with individual lawyers and departments to disseminate information about pro bono opportunities and coordinates training to prepare volunteers for the challenge. Milbank lawyers can either choose a pro bono opportunity developed by the public service department or they can suggest their own. We offer a first-year pro bono fellowship program, which enables incoming associates to spend 10 weeks working at a pro bono or legal services program of their choosing. In 2014, 45 incoming associates, half the class, took advantage of this unique opportunity, and since 1990, approximately 400 associates have participated in the program contributing nearly 200,000 hours.
