1 MINUTES HORRY COUNTY COUNCIL REGULAR MEETING January 24, :00 p.m. MEMBERS PRESENT: Tom Rice, Chairman; Harold Worley; Brent Schulz; Marion Foxworth; Gary Loftus; Paul Price; Bob Grabowski; James Frazier; Carl Schwartzkopf; Paul Prince; Jody Prince; and Al Allen. MEMBERS ABSENT: OTHERS PRESENT: Steve Gosnell; Pat Hartley; Anne Wright; Paul Whitten; Arrigo Carotti; Janet Carter; Barry Spivey; Westley Sawyer; and Lisa Bourcier. In accordance with the FOIA, notices of the meeting were provided to the press stating the time, date, and place of the meeting. CALL TO ORDER: Chairman Rice called the meeting to order at approximately 6:00 p.m. INVOCATION: Mr. Foxworth gave the invocation. PLEDGE: Mr. Loftus led the pledge. PUBLIC INPUT- Agenda-Items: There was none. CHANGES TO THE AGENDA: Mr. Grabowski moved to add under Announcements a recreation disbursement in the amount of $5500 to the Socastee Heritage Foundation for the Socastee Heritage Festival. Mr. J. Prince moved to add under Announcements that the Infrastructure and Regulation Committee will be meeting on February 9 th at 9:00 a.m. in the County Council Conference Room. Mr. Allen moved to defer Resolution R Mr. Foxworth moved to add under Announcements a recreation disbursement in the amount of $1000 to the Boys and Girls Club for their after school program and $750 to Save-R-Cats Foundation. Mr. Foxworth moved to defer to the next meeting, at the request of the City of Myrtle Beach, the Presentation on a Use Agreement between the County and the City of Myrtle Beach and CSX Railroad, seconded by Mr. P. Prince. Mr. Schulz moved to defer Ordinance to the February 21 st meeting. 1

2 Mr. J. Prince moved to approve the changes to the agenda, seconded by Mr. Schulz. The motion passed unanimously. APPROVAL OF AGENDA CONTENTS: Mr. J. Prince moved to approve the agenda as amended, seconded by Mr. Frazier. The motion passed unanimously. APPROVAL OF MINUTES: Regular Meeting January 10, 2012: Mr. Frazier moved to approve the minutes as submitted, seconded by Mr. Loftus. The motion passed unanimously. APPROVAL OF CONSENT AGENDA: Mr. P. Prince moved to approve the Consent Agenda, seconded by Mr. Grabowski. The Consent Agenda consisted of the following: Third reading of the following ordinances to approve the request to amend the official zoning maps: Kenneth Jordan, agent for JW Dewitt, et al; Sheila Harrelson, agent for Bradley Construction, LLC.; Howard Bellamy; Ella Boyd and Gregory Dean Jordan. First reading of Ordinance to approve the request of Carlton & Emma Williamson to amend the official zoning maps. Resolution R declaring surplus the service weapon for Lt. Ken Duke and to authorize the sale of the weapon to Lt. Duke. The motion passed unanimously. RESOLUTIONS/PRESENTATIONS: Resolution R honoring the contributions of Melvin Ford to the Poplar Community by naming a softball field in his name. Mr. Schwartzkopf moved to approve, seconded by Mr. P. Prince. The motion passed unanimously. Resolution R approving a variance to the Horry County/MBREDC Economic Development Incentives Program. Mr. Worley moved to approve, seconded by Mr. Loftus. The motion passed with Messrs. Schwartzkopf, J. Prince, and Foxworth voting nay. READING OF ORDINANCES: Third reading of Ordinance approving and authorizing the administrator to execute a lease agreement with KNH Aviation Services, Inc. of property located at MYR Airport for the purpose of operation of an aviation service facility. Mr. Worley moved to approve, seconded by Mr. Grabowski. The motion passed with Messrs. Schwartzkopf, J. Prince, and Foxworth voting nay. 2

3 OLD/NEW BUSINESS: Election of Vice Chairman. Mr. Price nominated Mr. Allen, seconded by Mr. J. Prince. Mr. P. Prince moved to close nominations, seconded by Mr. Schwartzkopf. Mr. Grabowski moved to accept Mr. Allen by acclamation, seconded by Mr. P. Prince. The motion passed unanimously. ANNOUNCEMENTS: Disbursement of District Recreation Funds: Mr. Loftus- $ to Southwood HOA for drainage project; Mr. Foxworth- $750 to Save-R-Cats and $1,000 to Boys and Girls Club and Mr. Grabowski- $5500 to Socastee Heritage Foundation. Mr. Loftus moved to approve, seconded by Mr. Grabowski. The motion passed unanimously. Mr. Schulz announced a Golf Tournament that the local firefighters were putting on that would be held February 25 th. They were accepting teams now. The number to call was It was helping to support the Children s Hospital burned children s fund. PUBLIC INPUT- Non-agenda Items: Mr. Rice said Tom Gibbons had signed up to speak about Bike Week. 1. Tom Gibbons stated he resided at 2017 Windsail Drive in the Manchester Place Subdivision of Prestwick. He was there to talk about the news reports of spring bike weeks getting longer going from seven days to twenty-eight days or even longer. The Horry County website listed the spring bike dates as May The Harley dealership on South Kings Highway has a sign saying their bike week, for the 72 nd annual bike rally, was from May One owner of a bike business quoted in the paper said it would be three weeks. There was also a quote from another owner saying the rally would be from May He had presented to Ms. Hartley two letters from homeowners associations that abut the Harley dealership and businesses and bars where spring bike week events took place. The first letter was from Long Bay Estates Homeowners Association. Long Bay Estates was the east side of Business 17 across from the Harley dealership. The letter they brought from their association because they couldn t be there that night. In their letter their association asked County Council to deny any date changes or extensions to the spring bike week rally. Their association had one road into their community off of Hwy. 17. The residents had a very hard time getting in and out of their homes during bike week, and if the rally was going to get longer, it would only cause more disruptions to them. They urged Council to stand up for 3

4 the residents of the County and to limit the spring bike rally to the seven days as it had been in the past. The second letter was from Manchester Place Homeowners Association. Manchester Place Subdivision of Prestwick was on the west side of south Kings Hwy. behind the Harley dealership in the old Iron Gate Saloon. He was a board member of that association and with him that night were two other board members, Bob Roon and Carol Ernts. The residents of Manchester Place also asked Council not to allow the spring bike rally to extend beyond seven days. They, too, had numerous problems getting in and out of their community during bike week and the fear of having it extended would only make matters worse. They also asked Council not to issue any vendor permits for any dates other than May and not to issue any special event permits for the spring bike rally. Every year the vendor tents went up early and were taken down later than permitted under the bike week vendor permits. Under special event permits, they were allowed to set up early and take down later. This also extended the dates beyond seven days. They also asked Council to limit the number of vendor permits that were given out in the area of where the Harley dealership and the businesses were. Every year it seemed that they got all the vendor permits on the south end other than down at Suck Bang Blow. They got them on the south end right at the Harley dealership and had two residences there and made it almost impossible for people to get in and out. The residents of both communities do not want bike week to become bike month. In the paper that morning, one of the owners of a bike business was quoted as saying, if they wanted a nice relaxed rally weekend come to the first weekend, if they wanted to see the old mayhem come to the second week, if they wanted to see the new mayhem come to the third week. Mayhem, in his dictionary, was defined as wanton destruction, violent disorder and/or havoc. Mr. Loftus said first let him say that County Council did not set the dates. They decided they were going to have it when they were going to have it. It seemed that they had tried to work with them and they kept pushing the envelope. First they set their tents up early and then they wanted to take them down late and they just didn t seem to want to play by whatever rules they set so he asked Mr. Rice to have a discussion at the next Council meeting, and certainly at the next COW meeting, of perhaps doing away with all vendor permits in the month of May. Mr. Rice said he would put that on the agenda. He agreed that the bike rallies were overly burdensome on the communities and this Council had tried to work with them even before he was on Council. He knew a lot of people that he was associated with were very concerned with the bike rally always being such a burden on public safety and such a burden on the community as a whole. This business, in particular, seemed not to be real concerned about the opinions of the community. He thought they were going to have the City of Myrtle Beach request that they take action on it as well as Surfside and as well as Atlantic Beach had some concerns on it. The community was fairly unified on this. He appreciated Mr. Gibbons being there and rest assured they were going to look into it. Mr. Price said he agreed that the south end got inundated down there and saturated. He thought what Mr. Gibbons said had a lot of credence and they need to take a hard look at this. He said he would like to ask Mr. Gosnell if he had any input on it that he would like to share with them as far as the dates. Mr. Gosnell said they recognized the dates they had in the past, which at this time, 4

5 would be May The existing ordinances would be enforced accordingly. Mr. Price said that was a good thing and at least they had clarification. Mr. Foxworth said regarding that, those vendor permits were separate from the vendor permits they issued for Memorial Day. Mr. Gosnell said they were, and the dates for Memorial weekend was May and the same conditions. Whatever was in the ordinance was what they would enforce. Mr. Foxworth said basically those vendor permits were still on sale. Mr. Gosnell said they would be for both events. Mr. Rice said unless they took some action. Mr. Gosnell said exactly. Mr. Rice closed public input at 6:19 p.m. Mr. Worley welcomed to the Council meeting a few Council members from Atlantic Beach.
