Property is open to thorough public inspection. It is the Bidder s responsibility to determine condition, age genuineness, authenticity, value or any any other determinative factor. Allen & Marshall Auctioneers and Appraisers, LLC may attempt to describe the merchandise in advertising, on the phone, on the internet and at the auction but makes no representations. In no event shall Allen & Marshall Auctioneers and Appraisers, LLC be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value. 2. Every effort is made to guard merchandise throughout the auction. However, the Bidder becomes solely responsible for all items purchased immediately following the winning bid. Therefore, the Bidder is advised to further guard their items at their own discretion. 3. The Bidder is responsible for knowing which item is being bid on. If the Bidder is unsure, they should inquire or not bid. When becoming the winning bidder at auction you have effected a contract and will be expected to pay for items in which you were evidenced to be the successful bidder. Auctioneer will not honor mistakes. 4. The Auctioneer reserves the right to accept bids in any increment he feels is in the best interest of his client, the Seller. The Auctioneer reserves the right to reject the bidding of any person whose conduct, actions, or adverse comments he feels are not in the best interest of the Seller. 5. Titles will be disbursed on auction day only if payment is made in cash; otherwise they will be mailed when the check clears the bank. 6. Sales tax will be added to the purchase of all taxable items. Dealers who purchase for resale must file their resale permit numbers. 7. Purchaser does hereby indemnify and hold harmless Auctioneer and Seller from any and all damages, claims or liabilities from injuries to persons or property of any type whatsoever caused during the sale or by the removal of items purchased. Purchaser assumes all risk and liability whatsoever resulting from the use of the item(s) sold hereunder; and shall defend, indemnify, and save harmless Auctioneer and Seller from any liability. 8. If the foregoing conditions or any other applicable conditions are not complied with, in addition to other remedies available to Auctioneer and Seller by law, including without limitation, the right to hold the purchaser liable for the bid price, the Auctioneer, at their option may (1) resell the property publicly or privately, with purchaser being liable for the payment of any deficiency plus all costs incurred, or (2) cancel the sale, retaining liquidated damages on all payments made by purchaser, Auctioneer commission and all other incidental damages will be

All statements made by the Auctioneer the day of the auction take precedence over oral statements and/or printed materials. 11. We will offer shipping on smaller items. Local Pickup is preferred. Pick Up times Monday through Friday from 9-5 with Appointment. Larger Furniture Sized Items (Lots 1-197) are not shippable and must be picked up locally. 12. AUCTION FORMAT: This will be a live Auction starting at 6 pm on Friday Nov. 15th, Absentee Bidding will be available through the Auction Co. Website. Absentee Bids must be received no later than 3 PM on Friday Nov. 15th, The data will be downloaded from the Webserver to our Auction Software System and then executed the at 6 PM. We will start the lot bidding at the high absentee bid that is in our computer. If someone in the crowd bids beyond the high absentee bid amount than the live bidder will win the bid. If no Higher bids are received over the high absentee bid durning the live auction the online absentee bidder will win the bid. 13. Payment: Payment required via Cash, Credit card or local approved check. There will be a 15% Buyer Premium for all online absentee bids. Example. If you bid $100 on an item. There is a 15% Buyer premium added to the bid price for a total of $115. Live bidders pay 13% and that is reduced to 10% if they pay with a cash or check. The 15% Buyer Premium stands regardless of absentee bidder payment type. Maryland Sales tax of 6% will be charged.
