3 Why worry about Avian Electrocution? The landmark case of the U.S. versus Moon Lake Electric Association, Inc Found guilty of violating the Migratory Bird Treaty Act (MBTA) and the Bald and Golden Eagle Protection Act (BGEPA). Ordered to pay $100,000 in fines and restitution Mandated to retrofit all of their lines with bird-safety devices Case has raised the awareness of the electrocution issue Sent a strong message: The MBTA is violated if bird deaths were foreseeable, even if unintentional. Electrocution is unintentional but foreseeable. Utilities must be proactive!!
4 And the Cost of Doing Nothing Continues to Increase PacifiCorp, a MidAmerican Holdings Company, Pleads Guilty of Violating the Migratory Bird Treaty Act (MBTA) and the Bald and Golden Eagle Protection Act (BGEPA). Probe in 2007 found excessive eagle mortalities linked to PacifiCorp electrical equipment in Wyoming. Ordered to pay $510,000 in criminal fines and an additional $900,000 in restitution and is on probation till 2014 Mandated to spend $9.1 million to repair or replace equipment to protect migratory birds from electrocution in Wyoming The message has again been repeated by the U.S. Fish & Wildlife Service: Utilities must be proactive!! Because Electrocution is foreseeable. And the death of birds by electrocution is a violation of the MBTA.

Governmental regulation and pressure from environmental groups for animal friendly systems have created a high demand for protection products.
17 Conclusion Punitive fines require utilities to do something to address animal fatalities. System complexity results in a need for many different types of solutions.
