19 Double-crested cormorants Environmental Assessment Availability of final EA and Finding of No Significant Impact published in Federal Register Nov. 15, 2017 Scope is to issue permits to: manage cormorant damage to aquaculture facilities protect human health and safety protect threatened and endangered wildlife alleviate property damage Applies to 37 states and District of Columbia

23 Solicitor s M-Opinion New Interpretation of MBTA Incidental take of migratory birds (i.e., unintentional take as a result of an activity but not the purpose of the activity) not enforceable under MBTA FWS receiving additional input & guidance to incorporate M-Opinion into day-to-day activities ESA & BGEPA, as well as state laws and regulations, still apply to certain species
