SUPPLIES AND SERVICES. he Utility Furniture (Marking and Supply) Order, 950 The above-styled Order replaces the Furniture (Utility Mark) Order, 949, as amended by the Furniture (Utility Mark) (Amendment) Order, 949. The principal changes are : (a) No distinction is now made between different grades of bedstead ends and new type symbols, F33 and F43, are substituted for the former type symbols F3 and F3, and F4 and F4 respectively. (b) Nev.i type symbols have been given to metal framed wing easy chairs, easy chairs and settees. (c) A minimum area of table top and a minimum height have been laid down for dining tables. (d) Four new descriptions of upholstered divan are added to the utility range (type symbols F80, F8, F8, and F83). The Order comes into force on st October, 950. By Order. J. N. The Utility Furniture (Marking and Supply) Order, 950 I, the said Lieutenant Governor, in exercise of the powers conferred on me by Regulation 55 of the Defence (General) Regulations (Isle of Man) 939, as having effect by virtue of the Supplies and Services (Transitional Powers) (Isle of Man) Order in Council, 946, as extended by the Supplies and Services (Extended Purposes) (Isle of Man) Order in Council, 948, do hereby Order as follows :-. () No person shall apply the mark shown in the Second Schedule hereto (herinafter referred to as the " utility mark ") to furniture of any description whatsoever other than furniture of a description specified in the First Schedule hereto. () No person shall apply the utility mark to furniture of a description specified in the First Schedule hereto except under the authority of a licence granted by or on behalf of the Governor under this paragraph and in accordance with any condition attached thereto. () Any person who applies the utility mark to any furniture of a description specified in the First Schedule hereto shall also and at the same time, apply to that furniture (a) the identification number notified to him by or on behalf of the Governor for the purposes of this Order or any other Order made by the Governor relating to the manufacture or marking of furniture; and (b) the type symbol specified in Column of that Schedule in relation to that description. () Any person who applies the utility mark to any furniture of a description specified in the First Schedule hereto shall apply the said mark, identification number and type symbol in accordance with the provisions of the Third Schedule hereto. (3) No person shall apply a type symbol specified in Column of the First Schedule hereto to furniture of any description whatsoever not being furniture of the description specified in that Schedule in relation to that type symbol. (3) No person shall supply, offer to supply or advertise any furniture upon or in relation to which the word " utility " or any word resembling that word is used, but which is not utility furniture (that is to say, furniture to which the utility mark has been applied in accordance with this Order or any other Order made by the Governor or any Order made by the Board of Trade or by the Ministry of Commerce of Northern Ireland or with the approval in writing of the Governor, Board or Ministry), without taking sufficient steps to prevent the use thereof from importing directly or indirectly a reference to utility furniture. 4. No person shall remove or deface or, with intent to deceive, obscure the utility mark, the identification number or the type symbol duly applied to any furniture. 5. A person shall not, in the course of his business, supply any article of utility furniture bearing two or more different type symbols. 6. Nothing in this Order, except Article, shall prohibit a person from doing, or require him to do, anything if he is otherwise authorised by a licence granted by the Governor under this Article, provided that he complies with any condition attached to that licence. 7. A person disposing by way of liquidation of any assets of any business shall be deemed to be carrying on that business, and any licence granted in respect of that business shall have effect as if it had been granted to that person. 8. The Furniture (Utility Mark) Order, 949, and the Furniture (Utility Mark) (Amendment) Order, 949, are hereby revoked : Provided that any current licence issued thereunder shall have effect as if it had been granted under this Order. 9. This Order may be cited as the Utility Furniture (Marking and Supply) Order, 950, and shall come into operation on the st day of October, 950. Given under my hand this th day of September, 950. G. R. 7 SECOND SCHEDULE The Utility Mark THIRD SCHEDULE Part I. Application of the Utility Mark, the Identification Number and the Type.. The utility mark, the identification number and the type symbol shall be applied in such a manner that they are readily visible.. The utility mark and the identification number shall be applied to furniture of any description specified in Column of the table set out in Part II of this Schedule in the place and in the manner specified in Column and Column 3 respectively of that table in relation to that description. 3. A person who applies the utility mark and the identification number by means of a stamp shall apply them by means of a stamp approved by or on behalf of the Governor for that purpose. 4. Where the utility mark and the identification number are applied by means of a label or transfer, the dimensions of the mark shall not be less than the dimensions of the mark shown in the Second Schedule and the identification number shall be applied immediately under the utility mark in figures not less than /8 inch in height. 5. Where the utility mark and the identification number are applied by means of a label, that label shall be of durable material and shall be securely sewn on to the furniture or applied to it by means of gimp pins. 6. The type symbol of furniture of any description shall be applied immediately below the identification number in letters and figures not less than /8 inch in height. Where the utility mark and the identification number are applied by means of a stamp, the type symbol shall be applied by means of a similar stamp or in indelible ink by means of a rubber stamp. Where the utility mark and the identification number are applied by means of a label or transfer, the type symbol shall be applied in like manner by means of a label or transfer, as the case may be.
