Are they excessive or cost prohibitive? Are any unusual or ongoing costs likely? d) What are the artist's suggestions for protection of the work should it be subject to vandalism? Liability and Safety a) Are any aspects of the work a potential safety hazard? b) Does the work meet building code requirements? C) Will fencing or other types of security measures be required? PROCESS Public Art Project Selection Methods One of the following selection methods may be used to select artist or artist teams for eligible public art projects: a) Open nvitation: Open to all qualified artists without restriction. The Artist Colony of Zanesville (ArtCoZ) is advertised and project guidelines are published. b) Limited nvitation/focused nvitation: A selected group of artists is invited or are pre-selected as candidates for a particular project or site. c) nterest by Artist Any artist or organization that wishes to have their artwork installed in or on public property or right-of-way, shall submit an application to the mayor's office. The application shall be provided by the City of Zanesville. i. The request will be routed to the following city departments and other appropriate boards/commissions for their review and comments: Planning, Public SeNice (Engineering), Community Development (Zoning), Human Resources/ADA, and the AC.
2 Ordinance No f) Crafts: in clay, fiber and textiles, wood, metal, plastics, stained glass and other materials, both functional and nonfunctional; g) Photography; both digital and traditional photographic print media h) Mixed media which may include any combination of two- and three-dimensional forms of media, including collage; i) Earth works, environmental installations and environmental art; j) Decorative, ornamental or functional elements designed by practicing artists or other persons submitting as artists, including but not limited to design professionals who are not participating members of the City's design team for the project; k) Light-based or luminal art: including experiential site specific or installation based work that explores optical phenomena, work comprised of transmitted light, artificial or natural light sources, projections or sculpture which incorporate light sources as major compositional and expressive elements. Sound art: media with primarily aural based expressive elements which can include electronic, audio media, found or experimental sound sources ) Video and animation: including projected or displayed on a video monitor m) Portable art that may be displayed at locations other than its substantially permanent location or adjacent to the project site; N) Temporary performance or time-based art. CRTERA FOR SELECTON The following questions may be used as criteria when conducting reviews of proposed artworks as a part of the selection panel process: Aesthetic Quality and Artistic Merit a) What has the artist accomplished with the work and does it align with the proposed project goals? b) Does the work under consideration have artistic merit? c) s the work relevant to the City of Zanesville, our values, culture and people, and does it contribute to the fabric of the City? d) s the work an integral component of the overall project? e) s the work of art appropriate for the community that it serves? Placement f Siting a) What is the relationship of the work to the site? s it appropriately scaled? b) Will the work help to anchor and activate the site and enhance the surrounding area? c) Will there be convenient public access to the site? d) Will additional parking or access accommodations be required? e) What are the utility requirements of the artwork?
3 Ordinance No , ii. iii. iv. The artist shall provide a rendering and shall depict in substantial form, the art to be displayed. The AC shall make recommendation to approve or deny application. f the artwork is approved, the artist shall provide a waiver of liability for any damage. GENERAL TERMS a) f any discrepancy to what has been approved is submitted, the City of Zanesville has the right to revoke artwork and corresponding approvals. b) n no way shall the artwork interfere with the normal operation of the right-of-way. c) All City board approvals must be obtained prior to the installation of artwork (Downtown Design Review Board, Board of Zoning Appeals)., d) Notification of the final action taken by the Mayor's Office will be issued to the City Council, the AC and the appropriate City Director. WHEREAS, the Muskingum Valley Park District was created under the Ohio Revised Code, Section 1S45, and is considered a political subdivision under the state of Ohio; and WHEREAS, the District is looking to further deve lop Olga's Children's Garden, which is an existing garden with in Mission Oaks Gardens; and WHEREAS, the Children's Garden is in need of a wat er supply for the ongoing maintenance and care of the landscaping and shrubbery, which would be made available to the site at a cost of $2,679.46; and and WHEREAS, the Park District will provide the initial and ongoing investment into the Children's Garden; WHEREAS, Olga's Children's Garden provides educational and aesthetic benefits to Zanesvi lle City Schools and area residents, therefore making it in the public's interest to waive the City's water tap fees for said project; and WHEREAS, this is a one-time waive r of fees as a courtesy for this specific project, and does not set a precedent for continued waiving of any other associated fees. 7 Ordinance No / 01/2017 Dear Mr. Roberts, Enclosed you will find a claim that filed with Zanesville City this past winter. The claim was denied and was advised that could pursue a "moral claim" if desired. Not mentioned in the initial claim was the fact that during this advised repair, a gas line was ruptured in the process. This was not mentioned in the previous claim because was initially told by Columbia Gas that would not be charged for the repair; therefore despite the annoyance of the issue did not have a reason to seek reimbursement. Since the initial claim was filed with Zanesville, this past winter, received a bill from Columbia Gas for the amount 04:r061.ij) was able to speak and negotiate with a representative from Columbia Gas to get the price lowered by 19% bringing the new amount owed to $ This new bill is enclosed with the rest of the claim. Also not mentioned in the initial claim was evidence of the identical city water repair to numerous homes on our same street, Fairmont Avenue. This leads myself to believe that the City had strong knowledge and awareness of my particular problem and that this was a common issue on Fairmont Avenue. You will find pictures of these water main repairs enclosed, with the addresses of the corresponding homes. With that being said, ask for your review of this claim. n addition to the amount requested on the reimbursement page, would like to add an additional $ to cover the gas line repair. Had we not had to excavate the entire back yard for this repair just to find the problem was never ours to begin with, this damage would have never occurred, nor would have incurred the other costs involved with this water main replacement. The amount requested is to cover the ";ate rials, rentals, damage repair, and the invoice for the excavation. The inten.se physical labor, stress, frustration, time and burden on.the homeowner are asked to be taken into consideration upon review of this claim.
