1 Call for Artists Phase Sidney Seaside Sculpture Walk The Town of Sidney is currently accepting submissions for Phase of the Sidney Seaside Sculpture Walk, a scenic outdoor gallery situated on Sidney s spectacular waterfront promenade. The Sidney Sculpture Walk is a project initiated by the Town of Sidney and the Community Arts Council of the Saanich Peninsula with the mandate to encourage and support the arts while providing an opportunity for visitors and residents to experience a variety of public art that captures the interest and imagination in an open air gallery. Submissions will be accepted from all members of the arts community; there are no geographic restrictions. The goal is to be as inclusive as possible and to encourage and celebrate emerging and established artists. Phase of the Sculpture Walk will add six additional pieces to the existing twelve currently on display. Sculptures accepted for exhibit and the location of each sculpture will be determined by the Acceptance Committee which is comprised of various individuals from the community. Sculptures will be displayed for a two-year term after which time they may be replaced through a new Call for Artists, unless they are purchased. The Town of Sidney will also encourage and support the sale of artwork by providing the opportunity for corporate and individual sponsors to purchase pieces directly from the artist for the purpose of donating it to the Town s permanent collection. The sale of work will be supported by the Town by releasing the artist s work up to one-year prior to the two-year exhibit commitment expires. Preferred Standard Mounting Guidelines Artists are encouraged to give consideration as to how the piece can be installed to withstand the wind loading and corrosive environmental conditions. The Sidney waterfront is exposed to severe winter winds from the southeast. deally, the Town prefers to install the piece on a poured concrete base using a standardized 197mm by 197mm 4 bolt (25mm dia.) See Appendix A Sculpture Walk Standard Exhibit Mounting How to Apply To apply, please note the following: Up to 4 submissions per artist will be accepted. Submissions must be original work made of vandalismresistant, durable material suitable for an outdoor, exposed waterfront location, which is subject to heavy rain, salt spray, and, at times, extreme winds; Complete application form (following on page 2); nclude 1-3 printed photos or 1-3 digital images in jpg or pdf format; nclude a current CV or bio, and an artist statement regarding your submission; and Describe your proposed installation method. 6 PUBLC ART FOR SDNEY SCULPTURE WALK AGREEMENT THS AGREEMENT made this day of, BETWEEN: Artist Somewhere on some street Victoria BC V8X 2S8 (the Artist ) AND TOWN OF SDNEY 2440 Sidney Avenue Sidney BC V8L 1Y7 (the Town ) WHEREAS: A. Sidney Seaside Sculpture Walk Agreement is a license to exhibit the Artist s work (Artwork) on Town of Sidney property; B. The Town wishes to accept the Artwork for public display in Location as shown on Appendix A. C. The Artist has submitted a proposal to the Town to exhibit the Artwork on Town property. THE PARTES AGREE AS FOLLOWS: 1. The Artist agrees to design, fabricate and work with the TOWN OF SDNEY for installation of the art piece which: a) Shall be prepared according to the Artist s proposal dated date, attached as Appendix B. b) Shall conform to the design, composition and all additional details as outlined in the Artist s proposal attached as Appendix B. 2. The Artist warrants that any work submitted is the original work of the Artist and the Artist shall retain full ownership for the entire period of the installation of their work. 3. The Artist agrees to apply best efforts towards completing and installing the Artwork by date, The Artist will provide the Artwork for public exhibit for two years from the date of installation of date, The Artist will remove the Artwork from the Town property at his/her expense within two years and one month from the date of installation of date, The Term of the license to exhibit the Artwork on Town property may be extended by agreement of both parties and can also be reduced at the request of the Artist if the Artwork is sold. 1

7 7. The Artist agrees to pay a commission to the Town of 10% of the sale price of any Artwork sold while the work is on display on Town property. 8. The Town reserves the right to reject any work that differs markedly from the submitted proposal. 9. The Town will provide a standard base foundation for the Artwork at the Town s expense. 10. The Artist shall be responsible for the fabrication, delivery and the installation of the Artwork. 11. n advance of installation the Artist shall submit drawings / illustrations showing the detailed plan of installation and securing of the Artwork to the base provided by the Town. The design shall comply with all current codes and shall be approved by the Town s Director of Engineering and Works and Director of Development Services. 12. The Town reserves the right, at its sole discretion to relocate the Artwork to an alternate location during the term of the display. 13. The Town agrees to notify the Artist in the event that the Artwork is moved to another location. 14. No additions or modifications will be made to the Artwork by the Town or by the Artist. 15. Copyright of the Artwork and the Proposal, including all drawings, designs, images, specifications, photographs and documents incidental thereto, is the property of the Artist. 16. The Artist will repair and maintain the Artwork during the term of the loan. Notwithstanding the above, the Artist will not be responsible to repair any damage resulting from relocation of the Artwork by the Town. 17. The Town will provide Fine Arts Floater insurance (by Seafirst nsurance) for theft and damage. The Town s liability for theft or damage of the Artwork is strictly limited to the insurance proceeds. 18. The Artist hereby waives, indemnifies, and saves harmless the Town, its elected officials, employees, or insurers for any and all claims whatsoever, due to theft, damage or injury associated with the Artwork beyond that amount covered by the Town s insurance. 19. Whenever in this Agreement it is required or permitted that notice be given or served by either party to or on the other, such notice or demand will be in writing and will be validly given or sufficiently communicated if personally delivered, or sent by courier, priority post or registered mail, return receipt requested, to the Artist or the Town, as appropriate, at their respective addresses which appear on Page 1 of this Agreement. Either party by giving notice to the other as noted above may change such addresses from time to time. Notices as noted above will be deemed to be given to the Artist or the Town on the date upon which they are personally delivered or, if mailed, three days after mailing. 20. f the Artist dies or becomes incapacitated and unable to complete the work, the Agreement is terminated with effect from the date of said death or incapacity. 21. The Appendices hereto shall form part of this agreement. 2

8 22. This Agreement shall be binding upon the Artist and his/her heirs, executors, administrators, successors and assigns. 23. This Agreement may not be assigned or transferred. 24. Time is of the essence in this Agreement. 25. This Agreement constitutes the sole and entire agreement between the parties.
