2 Foreword About the Protocol The Legal Sector Alliance (LSA) s Executive members have all measured their carbon footprint using the LSA Carbon Footprint Protocol. This report contains a summary of the carbon footprint for each firm. The 2009 LSA Carbon Protocol report also includes carbon footprint data from additional member firms that agreed to publicly disclose their footprint, to improve transparency and gain further knowledge of the carbon performance of our members. The LSA Protocol provides sector-specific guidance on carbon footprint measurement, streamlining current advice on calculating carbon footprints and providing a credible, transparent and user-friendly methodology for the legal profession. The measurement tool has been adapted from the existing Greenhouse Gas (GHG) Protocol developed by the World Resources Institute (WRI) and the World Business Council for Sustainable Development (WBCSD). The LSA Protocol uses the most up to date Department for Environment, Food and Rural Affairs (Defra) and Department for Energy and Climate Change (DECC) GHG conversion factors. The LSA Protocol was developed in consultation with the Carbon Trust. The calculation methodology and technical content of the measurement tool has been verified by the Edinburgh Centre for Carbon Management. The LSA Protocol has been developed by the sector for the sector, distilling the experiences of those firms that have already measured their carbon footprint to support those that have not. This process helps firms reduce their individual footprint and contribute to reducing the collective footprint of the profession. As advisors to businesses and to private individuals, lawyers have a responsibility to address this issue, both by reducing their own emissions and encouraging reductions by clients and suppliers and by helping businesses adapt to inevitable changes arising from climate change. The LSA Protocol helps firms to calculate their footprint easily and also improves transparency, consistency and comparability within the sector. 3 2009 Performance LSA members vary significantly in size, from global organisations to small and regional law firms and therefore emissions will vary significantly. However, the process that LSA members have gone through to report their emissions, together with a commitment to reduce and report on them, is important. Sharing the results amongst the participating firms and with the profession more widely helps our members to understand their own emissions performance and provide an opportunity to share good practice in reducing their emissions. Although members varying size and structure has a significant impact on their carbon emissions, reporting members annual mean carbon data provides law firms with an indication of what constitutes typical performance in the legal sector. Going forward the LSA annual carbon report will contain increasingly comprehensive performance data as an increasing number of members publicly report performance year on year. The results of the 2009 LSA Principles Report showed that 57% of LSA members had calculated their organisation s carbon footprint and an additional 33% were planning to do so in The LSA s diverse knowledge-sharing environment also enables us to ensure that we are providing guidance on key issues that are suitable to every type of law firm. As this is the first year that firms beyond the Executive membership have publicly reported their carbon performance, year on year performance analysis compares Executive members performance only. Energy use in buildings is the most significant contributor to law firms footprints, with business travel the second largest component. LSA members can reduce building energy use through behavioural changes and investment in efficient technology, with even greater savings possible where the firm owns its premises. Some energy-saving investments can involve significant pay back times but many of the actions members can take to cut carbon simply involve behavioural changes that also result in cost reductions. Reducing costs makes business sense in any economic climate and is even more crucial during a recession. Reducing emissions from business travel is also important for most LSA members and presents a real challenge going forward as their businesses expand internationally. Despite significant adverse business impacts associated with the macro-level economic downturn, LSA Executive members absolute carbon emissions have reduced by almost 4% since the first public report in December 2008, demonstrating that carbon management remains a priority for members. Members reported that these reductions largely resulted from capturing efficiency gains associated with an improved knowledge of their firm s carbon and energy footprint. The annual average carbon emitted per employee decreased very slightly (0.14%) against a backdrop of significant headcount reductions amongst LSA members in This year s Carbon Protocol tool also captured data regarding the building space occupied by law firms. The LSA provided an additional two metrics, energy use (kwh/m2) and building emissions per employee, to enable more detailed understanding of members carbon footprints. As LSA members report on carbon performance going forward, their ability to capture data will continue to advance as they improve data gathering mechanisms and gain a greater knowledge of their operational footprint. As data capturing processes become increasingly robust this may lead to recorded energy increases and concomitant carbon increases in the short term. Ensuring ongoing environmental improvement is a major challenge for the LSA. LSA members recognise that by continuing to collaborate on carbon they significantly improve their ability to do so. 3

4 The table below details LSA Executive members carbon emissions during 2007/8 and 2008/9. Data for 2007/08 has been updated to incorporate the latest Defra GHG conversion factors. These conversion factors enable activity data (e.g. litres of fuel used, number of miles driven) to be converted into tonnes of carbon dioxide equivalent (CO 2 e). CO 2 e is the CO 2 equivalent of any gas which has global warming potential (GWP). For example, methane has a GWP of 21 times carbon dioxide. Direct comparisons of members carbon footprints are not instructive, as each fi rm has different operating hours, building types and building age. However, the Energy Use metric (kwh/m 2 ) gives a good fl avour of the building effi ciency of each fi rm, given that some fi rms have more than one site. Those fi rms highlighted in green are non-executive members of the LSA who have submitted data for the first time this year 1. Each year the firm carries out a global environmental audit so that it can track progress against targets. In 2009 its Environmental Management System was awarded the internationallyrecognised certification, ISO Achieving this involves establishing an environmental policy, setting environmental targets, introducing improvement programmes to meet those targets, and conducting regular audits and management reviews. In 2007 the firm commissioned an independent report on its environmental impact, focusing on stationery, waste, energy, water and transport and has subsequently implemented a number of improvements in these key areas () 8
