3 CATHERINE A. CHRISTIAN, ESQ. BIOGRAPHY Catherine A. Christian is the New York County District Attorney s Office Special Assistant District Attorney for External Affairs and Chief of the Elder Abuse Unit. She is also a member of the Office s Conviction Integrity Program and its Police Brady/Giglio and Exoneration Review Committees. After graduating from Dickinson School of Law in 1988 she began her legal career as an Assistant District Attorney in the Office s Trial Division under Robert M. Morgenthau. She prosecuted a wide variety of crimes, including, domestic violence and homicides. In 1995, she joined a private law firm, and later served as an Assistant Counsel for the New York State Commission of Investigation. She subsequently served as the Principal Law Clerk to the Honorable Rosalyn Richter. Catherine was reappointed as an ADA in 1998 and assigned to the Office of the Special Narcotics Prosecutor, serving in various positions, including, as a member of the Executive Staff. In 2014, District Attorney Cyrus R. Vance Jr appointed Catherine Chief of the Elder Abuse Unit. Catherine is a member of the Appellate Division First Department s Attorney Grievance Committee and Character and Fitness Committee. From , Catherine was President of the New York County Lawyers' Association. She was the first African American, the youngest person, and the second woman to be inducted as NYCLA's President

5 JOSEPH V. DEMARCO, ESQ. BIOGRAPHY Joseph V. DeMarco is a partner at DeVore & DeMarco LLP where he specializes in counseling clients on complex issues involving information privacy and security, theft of intellectual property, computer intrusions, on-line fraud, and the lawful use of new technology. His years of experience in private practice and in government handling the most difficult cybercrime investigations handled by the United States Attorney's Office have made him one of the nation's leading experts on Internet crime and the law relating to emerging technologies. From 1997 to 2007, Mr. DeMarco served an Assistant United States Attorney for the Southern District of New York, where he founded and headed the Computer Hacking and Intellectual Property (CHIPs) Program, a group of five prosecutors dedicated to investigating and prosecuting violations of federal cybercrime laws and intellectual property offenses. Under his leadership, CHIPs prosecutions grew from a trickle in 1997 to a top priority of the United States Attorney's Office, encompassing all forms of criminal activity affecting e-commerce and critical infrastructures including computer hacking crimes; transmission of Internet worms and viruses; electronic theft of trade secrets; illegal use of spyware ; webbased frauds; unlawful Internet gambling; and criminal copyright and trademark infringement offenses. As a recognized expert in the field, Mr. DeMarco was frequently asked to counsel prosecutors and law enforcement agents regarding novel investigative and surveillance techniques and methodologies, and regularly provided advice to the United States Attorney concerning the Office's most sensitive computer-related investigations. In 2001, Mr. DeMarco also served as a visiting Trial Attorney at the Department of Justice Computer Crimes and Intellectual Property Section in Washington, D.C., where he focused on Internet privacy, gaming, and theft of intellectual property. Since 2002, Mr. DeMarco has served as an Adjunct Professor at Columbia Law School, where he teaches the upper-class Internet and Computer Crimes seminar. He has spoken throughout the world on cybercrime, e-commerce, and IP enforcement. He has lectured on the subject of cybercrime at Harvard Law School, the Practicing Law Institute, the National Advocacy Center, and at the FBI Academy in Quantico, Virginia, and has served as an instructor on cybercrime to judges attending the New York State Judicial Institute. Prior to joining the United States Attorney's Office, Mr. DeMarco was a litigation associate at Cravath, Swaine & Moore in New York City, where he concentrated on intellectual property, antitrust, and securities law issues for various high-technology clients. Prior to that, Mr. DeMarco served as law clerk to the Honorable J. Daniel Mahoney, United States Circuit Judge for the Second Circuit Court of Appeals. Mr. DeMarco is a Martindale-Hubbell AV-rated lawyer for Computers and Software, Litigation and Internet Law, and is listed in Band 2 of Chambers USA: America s Leading Lawyers for Business guide as a leading lawyer nationwide in Privacy and Data Security. He has also been named as a SuperLawyer for his expertise and work in the area of Intellectual Property Litigation. In 2013, his Firm was named IP Boutique of the Year by ACQ Magazine. He has published numerous articles and appeared on major news programs in his practice areas and is a member of the Professional Editorial Board of the prestigious Computer Law and Security Review (Elsevier) and serves on the Board of Advisors of the Center for Law and Information Policy at Fordham University School of Law. He is also a member of the cyber- security initiative of Business Executives for National Security. Mr. DeMarco has received numerous professional awards, including the U.S. Department of Justice Director s Award for Superior Performance, as well as the Lawyer of Integrity Award from the Institute for Jewish Humanities. In his spare time he enjoys parenting, golf, and listening to classical piano.

7 LYNN W. L. FAHEY, ESQ. BIOGRAPHY Lynn W. L. Fahey is an honors graduate of Cornell Law School. She has practiced criminal law since 1971, with an emphasis on appellate criminal law since From 1974 to 1995, she was with the Criminal Appeals Bureau of The Legal Aid Society, serving as Assistant Attorney-in- Charge from 1986 to From 1996 to the present, she has been President and Attorney-in- Charge of Appellate Advocates. She is one of the co-authors of the West book New York Criminal Law (first, second, third, and fourth editions), for which she wrote the chapters on Assault, Homicide, Trespass and Burglary, Criminal Mischief and Related Crimes, Robbery, and Forgery. She has lectured on appellate advocacy and various issues relating to criminal law and procedure for indigent defense offices, bar associations, the New York State Defenders Association, the New York Association of Criminal Defense Attorneys, and the Office of Court Administration. She is the recipient of the New York State Bar Association's Criminal Justice Section award for "Outstanding Contribution in the Field of Appellate Advocacy."

9 BRENDA L. FISCHER, ESQ. BIOGRAPHY Brenda is the Chief of the Cybercrime and Identity Theft Bureau (CITB) at the New York County District Attorney s Office. Brenda joined the Office in 1996, and spent four years as a misdemeanor and felony assistant in Trial Bureau 80. In 2000, she was assigned to the Special Prosecutions Bureau, where she investigated and prosecuted cases of fraud and corruption. Among her cases in Special Prosecutions were the investigation and prosecution of theft of $15 million by more than 100 individuals from the Municipal Credit Union in the wake of the September 11 attacks. In 2004, Brenda moved to the former Labor Racketeering Unit (LRU), and was elevated to Deputy Unit Chief in During her tenure in LRU, she investigated and prosecuted widespread money laundering and tax evasion by contractors and subcontractors in the construction industry, as well as other corrupt businesses and labor unions. When LRU merged into the expanded Rackets Bureau in 2010, Brenda was appointed Chief of the Labor Investigations and Construction Fraud. In that capacity, she supervised extensive investigations of fraud and corruption within the interior construction industry, labor unions, and labor coalitions, as well as tax evasion and money laundering by and through commercial check cashers. Brenda has also investigated and supervised cases involving fraud and abuse in state and federal government programs, including an indictment of 134 individuals, the majority of which were former NYPD and FDNY retirees, for Social Security Disability fraud that cost taxpayers hundreds of millions of dollars. As Chief of CITB, Brenda oversees prosecutions involving cybercrime which include intellectual property theft, child pornography, cyber-stalking and cyber-harassment, identity theft, check and credit card fraud, and money laundering. She received her undergraduate degree from Georgetown University and her J.D. from Brooklyn Law School.

11 LAWRENCE T. (TED) HAUSMAN, ESQ. BIOGRAPHY Lawrence T. (Ted) Hausman is a supervising attorney at the Criminal Appeals Bureau of The Legal Aid Society in New York City. Mr. Hausman began working as a staff attorney at the Criminal Appeals Bureau in 1994 and became a supervising attorney in Mr. Hausman has been a member of the New York State Bar Association s Committee on Professional Ethics since He also was a member of the Appellate Standards and Best Practices Working Group of the New York State Office of Indigent Legal Services. Prior to working at The Legal Aid Society, Mr. Hausman was an associate at the law firm of White & Case and then clerked for Justice Alan B. Handler, Associate Justice of The New Jersey Supreme Court.

13 LEONARD JOBLOVE, ESQ. BIOGRAPHY Leonard Joblove is Chief of the Appeals Bureau at the Kings County District Attorney's Office, where he has been an assistant district attorney since Mr. Joblove has argued a number of cases of interest, including a pretrial appeal to the New York Court of Appeals in the case against the Zodiac killer (People v. Seda); a certification from the United States Court of Appeals for the Second Circuit to the New York Court of Appeals of questions regarding the law defining depraved indifference murder (Policano v. Herbert); a rehearing en banc, in the Second Circuit, of a constitutional challenge to New York s discretionary persistent felony offender sentencing law (Portalatin v. Graham); and, most recently, one of the appeals to the New York Court of Appeals that is the subject of today s panel discussion (People v. Young). Mr. Joblove attended Cornell University (B.A. 1979) and Yale Law School (J.D. 1982).

15 ASSOCIATE JUSTICE JOSEPH J. MALTESE BIOGRAPHY Joseph J. Maltese is an Associate Justice of the Appellate Division Second Department of the Supreme Court of New York. Justice Maltese previously presided in the New York Supreme Court handling civil and criminal matters. He also serves as the Presiding Justice on the New York State Litigation Coordinating Panel, which oversees complex litigation pending in more than one county of New York. Prior to serving in the New York Supreme Court, he sat in the New York City Criminal and Civil Courts. Before coming to the bench, Joseph Maltese was an attorney in the private practice of law concentrating in civil and criminal litigation in New York and New Jersey. He previously as served a Law Clerk to a Judge and is a member of the bars of New York, New Jersey and Florida, as well as the federal courts. Justice Maltese is an Adjunct Professor of Law at New York Law School and also teaches courses on scientific evidence to judges at the National Judicial College and at the New York State Judicial Institute. He is a Fellow of the Advanced Science & Technology Adjudication Resource (ASTAR) Program and a Fellow of The American Academy of Forensic Sciences where he was the Chair of the Jurisprudence Section. Justice Maltese was a Co-Editor of the Resource Guide for Managing Complex Litigation published by the National Judicial College. He also serves on the publications committee of the Bench Book for Trial Judges of New York.

17 CHARLES (CHUCK) A. ROSS, ESQ. BIOGRAPHY Chuck Ross, founding partner of Charles A. Ross & Associates, is an outstanding defense attorney at home in any kind of criminal case. Whether he represents an individual person at trial in the courtroom or advises a company on how best to negotiate the dangerous shoals of an investigation, Mr. Ross is sought out for his skill, expertise and dedication to achieve the best for his clients. The firm maintains offices in the Wall Street area of Manhattan and in downtown Miami. Mr. Ross was formerly the Chair of the White Collar Defense Group at Herrick Feinstein, LLP and was previously a name partner at Brafman & Ross, P.C., a boutique criminal defense firm. In that role, he was lead on numerous jury trials, as well providing representation for individuals under investigation. Mr. Ross has successfully represented clients in New York City and in a variety of other jurisdictions around the country, including stock brokers, investment advisors, hedge fund managers, compliance officers and other securities professionals in both the criminal and administrative arenas. In the corporate arena, Mr. Ross has represented a major national insurance company in connection with allegations of contingent commission practices; conducted an investigation into unfair competition and competitor kickbacks on behalf of a national medical laboratory and advised a hedge fund in connection with a grand jury investigation involving mortgage and construction fraud. He has represented numerous individual business professionals including chief executives, accounting officers and others involved in criminal fraud investigations and prosecutions. He has defended criminal matters on behalf of physicians, physician s assistants, and medical and hospital administrators in health care fraud cases, including an international pharmaceuticals company executive in an investigation involving off-label medication marketing. Mr. Ross has also represented individuals in public corruption cases including prosecutions of city government officials as well as union leaders and political party members. He has handled criminal cases for insurance professionals including adjusters, brokers and sales professionals on an assortment of charges, including wire fraud, mail fraud, tax evasion and money laundering, as well as law enforcement officials, former law enforcement officers and private investigators on many types of criminal charges. Mr. Ross has represented liquor business retailers and real estate professionals in the area of criminal anti-trust allegations. Mr. Ross has counted among his clients noted musicians, athletes and other entertainers. In addition, his cases included an individual in the nationwide crackdown on spy shops ; a clothing importing company on customs duty and quota evasion allegations and owners and employees of currency remitting and transfer businesses. Mr. Ross has also handled diverse criminal matters including allegations of possession of child pornography, narcotics distribution, gambling, racketeering, murder, rape and assault. In recent trials matters, he has represented an independent insurance broker charged with committing a fraud against the country s largest credit insurance company; a New York City Buildings Department official charged with corruption; an investment advisor charged with marketing materials fraud and soft dollar rebate fraud; a former police officer charged with attempted murder; an anesthesiologist accused of fraudulently billing insurance providers; a local government official on tax evasion charges; an individual charged with attempted murder in

18 connection with a night club assault; an elderly woman charged with mail fraud and money laundering in a highly publicized matter involving allegations of insurance fraud and murder and a banking official on charges of money laundering. From 1988 to 1991, Mr. Ross was Assistant Federal Public Defender in the Southern District office of the Legal Aid Society s Federal Unit, where his prior experience included conducting numerous jury trials to verdict. Previously, he was a trial attorney for the Criminal Defense Division of Legal Aid in the South Bronx for over six years. A 1981 cum laude graduate of New York Law School, Mr. Ross serves as vice-chair of the New York City Bar Association s Committee on the Judiciary. He is a member of the National Association of Criminal Defense Lawyers; New York Council of Defense Lawyers and the Federal Bar Council, and frequently lectures on topics involving white collar defense and criminal trial skills and strategy. He also has consulted on criminal justice issues for a select group of media outlets including the Wall Street Journal, New York Times and CNBC and Court TV.

19 JOHNNETTE TRAILL, ESQ. BIOGRAPHY Johnnette Traill has been an Assistant District Attorney in the Queens County District Attorney s Office since In 2014, she was promoted to Chief of the Appeals Bureau. Ms. Traill has briefed, argued, and edited more than 500 criminal appeals and federal habeas corpus cases as both Appellant and Respondent in the New York Court of Appeals, the United States Court of Appeals for the Second Circuit, the United States District Court for the Eastern District of New York, and the Appellate Division, Second Department. Some of her significant cases include People v. Monserrate, an assault conviction of a senator-elect; People v. Minucci, a racially motivated robbery/assault in Howard Beach; and Ramon v. Racette, where defendant sought to proceed pro se while simultaneously absenting himself from the court room. Ms. Traill graduated from Hamilton College in 1988 and Albany Law School in 1992.
