The hearing room is located on the ground floor of the Andrew Jackson Building. Entry to all Tennessee State Office Buildings requires picture identification; such as a driver s license. This hearing is the public s opportunity to comment on preliminary proposed changes to the DRAFT 2018 Low- Income Housing Tax Credit Qualified Allocation Plan (the draft 2018 QAP ) developed by THDA staff. The Developer Forum and public hearing will not be conducted in a question and answer format, however, THDA reserves the right to make clarifying comments and to ask questions to help THDA staff understand particular comments. We encourage your participation. Preliminary proposed changes to the draft 2018 QAP are available on THDA s web site. Individual comments will be limited to five (5) minutes. Perrey Executive Director MEMORANDUM TO: FROM: SUBJECT: Persons Interested in the Low-Income Housing Tax Credit Program Donna Duarte Director of Multifamily Programs Proposed Changes for Low-Income Housing Tax Credit 2018 Qualified Allocation Plan DATE: April 5, 2017 The following documents specify the changes THDA staff are proposing for the Low-Income Housing Tax Credit 2018 Qualified Allocation Plan ( 2018 QAP Proposed Changes ). More specifically: 1. Important dates; 2. Description of 2018 QAP Proposed Changes; 3. Proposed 2018 QAP scoring criteria values; and 4. Proposed 2018 QAP County Needs Score by County and Opportunity Score by Census Tract. The information presented is an initial staff proposal with regard to the 2018 QAP Proposed Changes. Staff will take comments received by the specified deadline into account in preparing the proposed changes that will be presented to the THDA Tax Credit Committee for consideration at the May meeting. These 2018 QAP Proposed Changes may be accepted, rejected, or modified in any respect. Changes or modifications not reflected in these 2018 QAP Proposed Changes may also be made. Draft Exhibit 2A and Draft Exhibit 2B DO NOT INCLUDE 2017 ALLOCATION DATA. Staff urges those interested in the Low-Income Housing Tax Credit Program to NOT take actions based on the County Needs Score on Draft Exhibit 2A or on Draft Exhibit 2B. a) Scores update to incorporate more current data. The variables used for the County Needs Score are the same as those used for the 2017 QAP. Changes in any score are the result of incorporating more current data. b) For New Construction - See Exhibit 2A (DRAFT) c) For Preservation and Rehabilitation - See Exhibit 2B (DRAFT) 3) Add Opportunity Score by census tract - See Exhibit 2C (DRAFT) Staff Comments: Designed to attempt to avoid overconcentration of low income housing tax credits within a particular county. Draft Exhibit 2C DOES NOT INCLUDE 2017 ALLOCATION DATA. Staff urges those interested in the Low-Income Housing Tax Credit Program to NOT take actions based on the Opportunity Score on Draft Exhibit 2C. a) Opportunity Score variables i) High rents median gross rent ii) High cost burdens median rent as a percentage of household income iii) Close to employment percentage of workers whose commute times are less than 15 minutes iv) High workforce participation percent of adult population (ages 16-65) that worked in the last 12 months v) Low levels of abandoned housing overall housing vacancy rate vi) Strong rental market rental market vacancy rate/lihtc vacancy vii) Supply pipeline LIHTC allocations yet to place in service
5 4) Change RAD Set-Aside Staff Comments: The current interest rate environment is more favorable than usual regarding Tax-Exempt Bond financed developments, lowering demand for the competitive Set-Aside. a) Rename RAD Set-Aside to PHA Set-Aside b) Lower PHA (formerly RAD) Set-Aside from 30.0% to 15.0% c) Maintain preference for CNI and RAD developments within PHA Set-Aside 5) Remove Opt-Out provisions for developments with a Housing Assistance Payment ( HAP ) Contract Staff Comments: Causes LIHTC and HAP Contract requirements to be consistent. 6) Add cost control measures Staff Comments: Addresses concerns at the national level regarding public perception of high costs for affordable housing. a) Add scoring criterion for ratio of hard costs to total costs i) Express in.000 format and award percentage of one available point b) Add total cost per unit cap i) Urban New Construction $175,000/unit ii) Urban Other $115,000/unit iii) Rural/Suburban New Construction $155,000/unit iv) Rural/Suburban Other $90,000/unit 7) Revise Innovation Set-Aside Staff Comments: Scholar house will be absorbed into the Innovation Round which allows Scholar House applicants to receive a full [not partial] allocation of Tax Credits. Advance announcement of Innovation Round theme will allow applicants greater time to develop their proposals. a) Have themed Innovation Set-Aside i) Theme for 2018 is Scholar House ii) Announce 2019 and 2020 themes in late 2017 b) Make up to 3 Innovation Set-Aside allocations 8) Changes Affecting Rural Areas Staff Comments: Assists developments proposed for rural counties and potentially allows a greater mix of development types and geographic locations to be successful. a) Allow non-urban new construction developments to participate in the General Pool b) Remove rural cross-counting provisions
6 9) Change compliance requirements in Part XIII Staff Comments: Changes allow owners more flexibility to address noncompliance issues. a) Amend initial noncompliance correction period from 60 to 90 days b) Amend extended noncompliance correction period from 120 to 180 days c) Remove requirement for owners to post THDA Customer Response Center poster 10) Authorization to modify Part VI: Application Submission as necessary to accommodate electronic submission of applications in the new Tennessee Housing Online Management Application System (THOMAS) Staff Comments: Staff will need to have the ability to modify Part VI as the THOMAS system is brought online. 11) Housekeeping changes
