1 CHAIRS: Stephan Luciw, Assistant Deputy Commissioner, Competition Bureau Stephan Luciw is a lawyer by training having earned a law degree from the University of Windsor and a Masters in Law degree specializing in International Trade and Competition Law from Osgoode Hall. During his career, Stephan has worked in both the private and public sectors. Stephan began his career with a Bay Street law firm, where he practiced for 3 years. While practicing law, Stephan acted in a wide variety of competition and corporate/commercial matters. His competition work included assessments of misleading advertising work, the filing of merger notifications, assessing compliance of corporations with the Competition Act, and making regular updates to the book Canadian Advertising and Marketing Law. For the past 13 years, Stephan has worked for the Competition Bureau of Canada. During his time at the Bureau, Stephan has worked for both the former Fair Business Practices Branch and the former Criminal Matters Branch. His work in these Branches has included cases involving false and misleading representations, deceptive telemarketing, mass marketing fraud and ordinary selling price issues, as well as the supervision and investigation of numerous criminal cartel cases dealing with bid-rigging and price fixing. Stephan is a frequent lecturer at the University of Toronto Law School and Ryerson MBA program. Stephan is currently the Assistant Deputy Commissioner of Competition responsible for the Cartels and Deceptive Marketing Practices Branch in the Ontario Region. Danielle Royal, Stikeman Elliott LLP Danielle Royal is a partner in the litigation department of the Toronto office. Her practice focuses on complex commercial litigation, class actions and competition litigation. Danielle has appeared before all levels of Court in Ontario, the Federal Court of Appeal and the Supreme Court of Canada. She has represented clients on several cross-border class actions involving claims of price-fixing and conspiracy, other commercial disputes, as well as a range of product liability claims. Danielle has significant experience advising and assisting companies regarding internal investigations and responding to regulatory or quasi-criminal investigations and the class action litigation that often accompanies allegations of regulatory misconduct. Ms. Royal is recognized by The Best Lawyers in Canada 2015 for her expertise in Competition/Antitrust Law. FACULTY: The Honourable Justice Denis Gascon, Chairperson, Competition Tribunal & Federal Court of Canada The Honourable Denis Gascon was appointed Judge of the Federal Court on February 26, He was also appointed Chairperson of the Competition Tribunal on April 30, Prior to joining the Federal Court, he was a partner with Norton Rose Fulbright Canada in Montreal, where he was heading the firm s Antitrust and Competition Team in Canada. He was also part of the Norton Rose Fulbright global leadership group for their Antitrust and Competition practice. Mr. Justice Gascon practised competition law and international trade law at Ogilvy Renault (now Norton Rose Fulbright Canada) for 25 years, after being called to the Bar of Quebec in Over the years, he advised Canadian and international companies on all aspects of competition and international trade laws, including Canadian and multi-jurisdictional merger transactions, criminal cartel and conspiracy cases, distribution strategies and pricing practices, compliance programs and trade remedy cases. He has regularly appeared before the Canadian Competition Bureau and the Competition Tribunal. He has also assisted companies in foreign investment reviews under the Investment Canada Act. Mr. Justice Gascon has been on the executive of the Canadian Bar Association Competition Law Section for several years and acted as Chair of the Section in He was a member of the Canadian Bar Association, the International Bar Association and the American Bar Association. Throughout his career as a lawyer, Mr. Justice Gascon has been recognized as one of Canada s leading competition and international trade lawyers, notably in the Canadian Lexpert Directory and in Best Lawyers in Canada as well as in various international publications such as Chambers Global, Global Competition Review, Legal Media Group and PLC Cross-border Competition Law Handbook. He was also an experienced author and frequent speaker who has written or co-written numerous articles and books in the areas of competition law and international trade. Mr. Justice Gascon received his

2 Bachelor of Laws from the Université de Montréal in He also has a Bachelor of Science in economics as well as a Diplôme d'études approfondies (D.E.A.) in economics. Antonio Di Domenico, Fasken Martineau DuMoulin LLP Tony is Regional Leader of Fasken Martineau s National Antitrust/Competition & Marketing Group in Toronto and a partner in the Litigation, Class Action and White Collar Crime, Investigations & Compliance groups. Tony advises on all aspects of Canadian competition law, including mergers, criminal/cartel investigations, class actions, advertising and marketing practices and investigations (including price advertising, performance claims and other consumer matters), abuse of dominance and other reviewable practices. Tony recently re-joined the firm after serving a special appointment as counsel to Canada's Commissioner of Competition from (Department of Justice Canada). In this role, Tony represented the Commissioner in respect of complaints and investigations, enforcement matters, the review of mergers, major litigated proceedings and the negotiation of remedies and orders. Tony also secured numerous production orders/subpoenas (i.e. section 11 orders) on behalf of the Commissioner and provided advice regarding enforcement guidelines and other policy matters. Tony has extensive trial and appellate experience and has appeared as counsel before the Competition Tribunal, all levels of court in Ontario, the Federal Court of Canada and the Supreme Court of Canada. Tony has represented clients in investigations under the criminal provisions of the Competition Act, including immunity and leniency applicants, and clients involved in matters under Canada s Corruption of Foreign Public Officials Act. Tony has also represented clients in matters with multi-jurisdictional and parallel civil and criminal components, including parallel criminal investigations and class action litigation. Sandra A. Jonathan Hood, Department of Justice, Competition Bureau Legal Services Jonathan Hood is counsel at the Department of Justice, Competition Bureau Legal Services. He has been litigation counsel to the Commissioner of Competition in multiple contested competition law cases before the Competition Tribunal, Federal Court of Appeal, and Supreme Court of Canada, including: the Commissioner s application to the Competition Tribunal challenging Tervita s acquisition of Complete Environmental and subsequent appeals to the Federal Court of Appeal and to the Supreme Court of Canada; the Commissioner s application to the Competition Tribunal challenging Air Canada and United Continental s transborder joint venture under the merger provisions of the Competition Act where he had multiple appearances before the Competition Tribunal; and, the Commissioner s abuse of dominance applications against Reliance and Direct Energy where he had multiple appearances before the Competition Tribunal and appearances before the Federal Court of Appeal and before the Supreme Court of Canada in an application for leave to appeal. He has also acted on numerous merger reviews. Prior to joining the Department of Justice, Jonathan practiced litigation, competition, and trade law for 5 years at McMillan LLP. Russell Jutlah, Senior Competition Law Officer, Competition Bureau Russell Jutlah is a Senior Competition Law Officer at the Competition Bureau, where he has worked since Russell has worked at the Bureau s offices in Gatineau, Vancouver, and Toronto, where he is now based.

3 Following several years work in the Mergers Branch, Russell joined the Cartels and Deceptive Marketing Practices Branch in 2005, where he leads antitrust investigations into alleged international and domestic pricefixing and bid-rigging cartels. In 2016, Russell served for six months as Acting Assistant Deputy Commissioner of Competition, Ontario Region. Prior to joining the Competition Bureau, Russell practiced civil and commercial litigation for several years at a law firm in Vancouver. He holds a Bachelor of Arts degree in Economics from Queen s University, an LL.B. from Osgoode Hall, and an LL.M. from the University of British Columbia. Katherine L. Kay, Stikeman Elliott LLP Katherine Kay is a partner with the litigation and competition departments of Stikeman Elliott LLP, based in the Toronto office and litigating cases throughout Canada. Katherine is known as a dynamic and highly effective courtroom advocate with a razor-sharp strategic approach. She is a first call for bet the farm litigation and investigations. Katherine s practice concentrates on complex commercial litigation, often involving the interplay between regulatory, civil and criminal law regimes across multiple jurisdictions, with particular subject matter expertise in the areas of competition, product liability, class action defence, international law, corruption and other white collar matters. She has been described by Chambers Global as virtually insurmountable in the area of competition litigation and by Global Competition Review as arguably the best competition litigator Canada has to offer. Katherine was named Canadian Competition Litigator of the Year by Benchmark Litigation, and is recognized in The Best Lawyers in Canada; Lexpert Guide to the Leading US/Canada Cross-border Litigation Lawyers in Canada; Chambers Global and Chambers Canada; among others. She has served on the firm s partnership board, executive committee and Toronto management committee. Evangelia Kriaris, Blake, Cassels & Graydon LLP Evangelia (Litsa) advises clients on all aspects of Canadian competition law, including mergers and acquisitions, joint ventures and strategic alliances, abuse of dominance, conspiracies and bid-rigging, criminal and civil investigations and compliance matters relating to the Competition Act. She also provides advice on foreign investment review matters relating to the Investment Canada Act. Litsa has represented clients in complex M&A transactions, investigations relating to criminal cartel matters and as litigation counsel in antitrust class actions. She has appeared as counsel before all levels of court in Ontario, the Supreme Court of British Columbia and the Federal Court of Canada. Robert E. Kwinter, Blake, Cassels & Graydon LLP Rob has extensive experience in all areas of competition law and regularly advises clients with respect to conspiracy, bid-rigging, trade association activities, misleading advertising, mergers and other reviewable trade practices mergers, the criminal and non-criminal matters and the misleading advertising provisions of the Competition Act. Rob regularly advises clients with respect to regulatory approval under the Competition Act and the Investment Canada Act, in respect of major transactions. He has acted as litigation counsel in cases under various provisions of the Competition Act, including as lead counsel to Visa Canada in a 2012 proceeding before the Competition Tribunal. He has extensive experience in class actions, including DRAM, air cargo, hydrogen peroxide, EPDM, chocolate, LCD and credit cards. He has also developed a recognized expertise in the misleading advertising field and has frequently appeared successfully before the Competition Tribunal and various trial and appellate courts. Rob regularly participates on various committees of the Canadian Bar Association and the American Bar Association, and has been an active contributor to the work of the International Competition Network as a non-governmental adviser. He is a member of the American Bar Association's International Task Force and a vice-chair of the Competition Law and Policy Committee of the Canadian Chamber of Commerce. Christopher P. Naudie, Osler, Hoskin & Harcourt LLP Christopher practises corporate and commercial litigation, with a strong focus on corporate litigation, class action defence and cross-border litigation. He is co-chair of Osler s National Class Action Specialty Group, and

4 he has acted as counsel in a number of the largest and most complex class proceedings across Canada covering a broad range of tort and statutory claims, including allegations of anti-competitive conduct, securities violations, insider trading, oppression and derivative claims, misleading advertising, product liability, economic torts, as well as negligence and fraud. Christopher has extensive experience in litigating complex commercial disputes involving shareholder rights, director and officer liability, auditor s negligence, valuation proceedings, insurance disputes, privacy and data breaches and professional liability. Christopher has also acted in a number of leading antitrust, securities and disciplinary investigations and enforcement proceedings, and he regularly acts in matters involving the Competition Bureau, the OSC, the RCMP/IMET, IIROC and the ICAO. Christopher has argued cases before trial and appellate courts across the country, including the Ontario Court of Appeal, the B.C. Court of Appeal, the Federal Court of Appeal and the Supreme Court of Canada. Prior to joining Osler, Christopher served as a law clerk for the Right Honourable Antonio Lamer, Chief Justice of the Supreme Court of Canada. Chris is currently ranked as a leading litigation lawyer in Canada in Chambers Global: The World s Leading Business Lawyers 2014, Benchmark Litigation Canada 2014 and The Best Lawyers in Canada In his younger days, Chris was recognized by Lexpert as one of the Top 40 Under 40 lawyers in Canada in Margaret F. Sanderson, Charles River Associates Margaret F. Sanderson has in-depth experience analyzing the economic issues inherent in a wide range of mergers, antitrust/competition, class certification, damages, finance, energy, and telecommunications projects. She has consulted to legal counsel, governments, and private-sector clients in a diverse range of industries. Ms. Sanderson has testified before Canadian courts and regulatory authorities and the U.S. Federal Trade Commission. Prior to joining CRA, she headed the Economics unit at the Competition Bureau, where she directed the economic expertise applied within the Bureau to enforcement cases, enforcement policy, and regulatory interventions. Ms. Sanderson has published various articles on mergers and antitrust/competition policy and taught courses on antitrust/competition economics. Terence Stechysin, Competition Bureau Terence Stechysin is a senior officer in the Competition Promotion Branch at the Competition Bureau, where he works with and advises the Competition Bureau s Compliance Unit. Terry joined the Bureau in 2002, and has held a variety of positions as an investigator, lead officer and Major Case Director in the areas of merger enforcement and policy development, having led major enforcement files, including the Loblaws/Shoppers Drug Mart, Tervita, Suncor/Petro-Canada matters and the Agricore litigation and related merger reviews, and led or contributed to the development of a number of the Bureau s enforcement policies and guidelines. More recently, he led the effort to revise the Bureau s Corporate Compliance Programs Bulletin, to establish the Compliance Unit, and to promote corporate compliance in both the private and public sectors. Terry holds an honours Bachelor of Arts degree in Political Science from Concordia University and a Bachelor s degree in Common Law from the University of Ottawa, is called to the Bar in Ontario, and is certified by the Society for Corporate Compliance and Ethics as a Certified Compliance and Ethics Professional-International (CCEP-I). Charles Wright, Siskinds LLP Charles is a Siskinds partner and leader of Siskinds' Price Fixing Class Action Group. He has been counsel to the class in numerous successful class actions, including the areas of price-fixing, securities, products liability, and consumer protection.
