Some of that money was used to build the county s first courthouse, a two-story, hewn-log building. In 1858, it built a replacement courthouse, made from brick, in the center of the town square. After 40 years of operation, that building was destroyed by fire. The county functioned without a courthouse while a levy to build a courthouse was rejected six different times. Finally, in 1911, citizens authorized an appropriation to build the county s present courthouse. The board of directors meets on the third Wednesday of designated months in Jefferson City to promote passage of priority bills and monitor other legislation before the state General Assembly and the United States Congress. 4 Transportation Task Force Looks for a Funding Fix Missouri s transportation infrastructure will once again be examined to see if the funding fiasco can be averted. HCR 47, which establishes the 21st Century Missouri Transportation System Task Force, was passed during the 2017 session. According to Rep. Kevin Corlew, the resolution s sponsor, the task force is charged with finding broadbased support for Missouri s dire infrastructure needs in order to serve the needs of citizens in future years. The 26 member committee includes lawmakers, state agency representatives and citizens, who include the following: Chairman Corlew, Reps. Bill Reiboldt, Nate Tate, Greg Razer, and Joe Runions, Sens. Bill Eigel, Caleb Rowden, Dave Schatz, Shalonn Curls, Jacob Hummel, and Gov. Eric Greitens. Members of the Legislature will work with the executive branch and private-sector task force members and, with input from the public, will make recommendations to the Legislature about on transportation funding, said Corlew. The recommendations will focus not only on what resources are needed now to fix our roads and bridges, but also on what kind of investment the state should make to ensure that we have a world-class transportation system that will serve the needs of our citizens into the future. The task force also includes MoDOT Director Patrick McKenna, who gave a transportation funding breakdown during the first meeting on June 28. According to Missourinet, McKenna said, Two thirds of the department s $2.5 billion in revenues was provided by fuel taxes, registration fees and vehicle sales taxes in An additional $900 million came through federal matching funds. Only $18 million in general revenue funds were used to support the Transportation Department. In addition to Missouri s 10,400 state-owned bridges, there are 14,000 bridges on the off-system and counties are responsible for 91 percent of these, as well as the 73,484 county-owned road miles. Missouri has the seventh largest state highway system, with 33,873 miles of roadway. Missouri s state gas tax is 17 cents per gallon, and 47th for funding in the nation. Missouri s fuel tax hasn t had an increase for 21 years. The issue of fixing our roads and bridges is important to Missouri residents, said Corlew. The issue has come up at nearly every community meeting I ve attended or held over the past 3-4 years. Our roads are crumbling, and our constituents are grumbling. A consensus exists that something needs to be done, but there is no consensus about how to pay for repairing and improving our highway system. 5 Right-to-Work Hits a Snag The new Right-to-Work law, SB 19, is once again facing hurdles. Organized labor is trying to delay it from going into effect. SB 19 could find its way onto the November 2018 ballot, and then would face repeal. Right-to- Work prohibits employers from forcing its employees to join a labor organization (union) and the payment of dues. This new law is supposed to go into effect on Aug. 28, As of February 2017, 28 states had right-to-work laws in place. The unions have filed a referendum petition, which has been approved by the Missouri Secretary of State s office to circulate. The bill is attached to a signature sheet, and circulators must collect signatures of 5 percent of registered voters who participated in Missouri's 2016 gubernatorial election in at least six of Missouri's eight congressional districts (about 90,000) by August 28. According to MissouriNet, every union is assisting in collecting the signatures, and there were more than 50 drive-thru sign ups held around the state. Once all the signatures are collected, they will be examined by the Secretary of State s office to determine their validity. According to the Missouri Secretary of State, referendum petitions allow bills that have been signed by the governor to go to a public vote before they go into effect. According to Missourinet, referendum petitions have placed a measure on the ballot 26 times. In all but two instances, voters overturned the laws passed by the Legislature. 5

6 Legal Update Decisions of the Missouri Courts of Appeal & Supreme Court Travis A. Elliott Ellis, Ellis, Hammons & Johnson and MAC General Counsel Since the May Board meeting, there have been a handful of cases decided that are relevant to county government encompassing a couple of different areas of the law. The first two cases involve a discussion of the public policy exception to the employment at-will doctrine. One case, Bishop & Associates, LLC v. Ameren Corporation, made it clear that an independent contractor cannot make a claim for wrongful discharge. The second case, Ballard v. Siwak, held that an employer cannot demand that an employee withdraw an order of protection against a co-worker as a condition of continued employment. The third decision, Hedrick v. Big O Tires, discusses what type of conduct is considered an accident for purposes of a workers compensation claim. The fourth and final decision, Judicial Finance Commission Lincoln 6 Since Member SIPC and NYSE. 12/10 CM piperjaffray.com County Commission v. 45th Judicial Circuit, clarifies what constitutes a reasonable budget request from the circuit court as part of the County Budget Law process. Employment Public Policy Exception -Independent Contractor Bishop & Associates, LLC v. Ameren Corporation Bishop was a commercial plumbing company hired as an independent contractor by Ameren to perform testing, emergency services and preventive maintenance. In January 2010, Ameren rejected a 3-year contract proposed by Bishop. Four months later, Bishop asked to meet with a building maintenance supervisor to discuss concerns with Ameren s plumbing projects. In July 2010, Ameren gave notice to Bishop that it was terminating its relationship with Bishop. Bishop sued Ameren and three of its supervisors alleging that Ameren wrongfully discharged Bishop in violation of public policy. The trial court granted summary judgment in favor of Ameren. On appeal, the Supreme Court upheld that decision on the basis that Missouri law does not recognize a claim for wrongful discharge in violation of public policy for independent contractors, and that doctrine has never been applied outside of the context of an employer-employee relationship. Public Policy Exception Order of Protection Ballard v. Siwak In this case, the employer demanded that an employee withdraw her full order of protection against a co-worker as a condition of continued employment. The employee had been abused by her co-worker during a prior romantic relationship. The employer ultimately refused to place the employee on the work schedule until she withdrew the full order of protection. The employee left her position with the employer and filed suit claiming wrongful discharge in violation of public policy. The court found that the employee was an at-will employee, but held that an employer may not demand as a condition of continued employment that an employee withdraw a full order of protection. continued on page 8

8 continued from page 6 In short, an employer may not terminate an at-will employee where the termination would violate a clear mandate of public policy, which includes (1) refusing to perform an illegal act, (2) reporting the employer or fellow employees to superiors or third parties for violations of law or public policy, (3) acting in a manner that public policy would encourage, or (4) filing a claim for worker s compensation. The Court found that such an action violates the public policy exception to the at-will employment doctrine. Workers Compensation Hedrick v. Big O Tires An employee intentionally lit a can of glue held in a co-worker s hand on fire with a lighter. The startled co-worker dropped the flaming can, which exploded on impact and severely burned both men. The Labor and Industrial Relations Commission denied the claim for workers compensation benefits. The Southern District Court of Appeals upheld the decision of the Commission because the claimant s intentional ignition of the glue was not an accident as that term is defined in the Workers Compensation Act. An accident is defined as an unexpected traumatic event or unusual strain identifiable by time and place of occurrence and producing at the time objective symptoms of an injury caused by a specific event during a single work shift. An injury is not compensable because work was a triggering or precipitating factor. County Budget Law Judicial Finance Commission Lincoln County Commission v. 45th Judicial Circuit The 45th Judicial Circuit has been involved in various litigation matters with the Lincoln County Commission over the last several 8 years regarding the circuit s budget. When the circuit submitted its 2016 budget estimate to the county commission, it included an estimate of $35,000 for attorney fees to represent the circuit in litigation or other legal matters. The county commission contested the estimate and petitioned for review before the Judicial Finance Commission. The Judicial Finance Commission determined that certain attorney fees already incurred were reasonable, but reversed the remaining $26,525 from the estimated budget for prospective attorney fees, concluding that this portion of the budget request was entirely speculative and unreasonable. The circuit appealed. On appeal, the Eastern District held that the amount representing an estimate of future attorney fees was an unreasonable budget request. The Judicial Finance Commission has statutory authority to make factual determinations regarding a circuit court s budget, including the discretion to determine the reasonableness both of any particular budget item as well as the total amount budgeted. The court noted that it was clear from the record that the amount estimated for future attorney fees was a speculative and unreasonable budget request because those actions have not been brought and may never be brought. 10 Two Percent More Revenue Projected for FY 18 CART Funds Missouri Department of Transportation (MoDOT) officials project that for FY 18 each penny of the state gas tax is expected to bring in $41.7 million. With the total gas tax set at 17 cents, that means $709 million will be divided among the state, counties and cities for road and bridge maintenance and repair. For 2018, the county share of the gas tax is projected to be approximately $82.7 million. MoDOT also projects the county intake from the 18 motor vehicle sales/use tax will be $16 million. Finally, they project vehicle fees for the new state fiscal year will net counties an estimated $11.2 million. Total county revenues from these three sources should be approximately $109.9 million. To compute your county s portion of 2018 County Aid Road Trust (CART) revenues, you may simply use the $109.9 million times your new percentage share listed on this page. Example #1 (for Audrain County) $109.9 million X.0077 = $846,230 If, however, you want to know the breakdown from each of the three sources that make up county CART revenues, use the following steps: Example #2 (for Audrain County) Gas Tax Revenues $82.7 million X.0077 = $636,790 Motor Vehicle Sales/Use Tax Revenues $16 million X.0077 = $123,200 Motor Vehicle Fees $11.2 million X.0077 = $86,240 The tally of these three figures will approximate the amount in Example #1 and provide your county s estimated CART revenues for the state s FY 18 year. 10 County Aid Road Trust (CART) Funds CART Funds are apportioned to counties on the basis of two factors: one-half of the funds are credited to the county based on the ratio that its road mileage bears to the total county road mileage in the unincorporated areas of the state, and one-half is credited to the county based on the ratio that its rural land valuation bears to the rural land valuation of the entire state. Total 2017 Missouri county road mileage is 73, Total 2017 assessed valuation in the unincorporated areas is $23,851,524,732. The CART distribution percentages for 2018 (shown in the accompanying table) are based on these 2017 figures. 18 Finally Here! Opening of the Randolph County Courthouse Alex Lindley Moberly Monitor-Index The public now have the chance to see the culmination of a Randolph County project that s been years in the making the Randolph County Justice Center. The new courthouse and administrative building at 372 Highway JJ in Huntsville held an open house from 2:30 to 4 p.m. on Saturday, May 20. The new facility brings the previously scattered Randolph County administrative offices all under one big, brand new roof. The Justice Center was paid for by the public. In April of 2014, Randolph County voters approved Proposition County Facilities Consolidation. The proposition applied a quarter-cent sales tax to the county that was at the time estimated to bring in around $600,000 annually. The sales tax was to last for 12 years. Presiding Commissioner John Truesdell previously told the Monitor-Index that the sales tax will cover the cost of the new facility, and that he would advocate that the tax is not ended early. There s no advantage to paying it off early, I don t think, he previously said. Here s the beautiful thing about the sales tax: 53 percent of the money that comes to the county from sales tax comes from outside the county, so people who are not citizens and residents are likely paying for more of the building than the county is. Truesdell said that, according to estimates, the average Randolph County household pays $1.68 per month toward the tax. If we go the full 12 years, that allows the county to turn around and capture the maximum the tax will capture, and with that money, if we see additional enhancements or add back some of the ideas we took out, we have the ability to do Courtroom in the new Randolph County courthouse. Truesdell previously said the county commission used the opportunity of building the new facility to implement security measures that could prevent some of the violence and security problems that aren t uncommon on the national news. A local event also played a part. Truesdell referenced the murder of two Randolph County jailers in a botched jail break in Our county is different from other counties, he previously said. We ve spilled blood over this issue. Randolph County is acting on (security improvements) while other counties are just thinking about it. We would not be prudent after we have been shown that this can happen in a place like this. If we didn t try to make it safer for all of our citizens, we would be to blame. Part of the improved security at the Randolph County Justice Center includes a metal detector at the entrance to the new building. Bags must pass through an X-ray machine. Additionally, all county employees will receive electronic, continued on page 20 19

20 continued from page 19 magnetic identity badges. Those badges, Truesdell said, can be programmed to only allow employees to go through the doors they need to enter. The new building also includes secure areas to be used in the event of a hostile situation. County officials also recently purchased new surveillance cameras and a lockdown system for the Randolph County Jail. Randolph County Commissioner Wayne Wilcox previously told the Monitor-Index that former commissioners Jerry Crutchfield and Susan Carter were instrumental in the Justice Center project. Commissioner Jerry Crutchfield has worked around the clock overseeing the moving, Presiding Commissioner Truesdell previously said. He has put his heart and soul into it. Since 2014, work on the new facility has been a large part of the county commission s agenda. The years of work of commissioners, other officials and contractors with the help of sales tax dollars from the public culminated during the open house. ti 20

22 Brass Ceiling Broken not Once, but Twice Missouri Boasts Two Female Sheriffs Nancy Zoellner-Hogland Missouri Sheriffs Association In November, for the first time in history, Missourians elected two women to serve as sheriffs. Katy McCutcheon was chosen as sheriff of Madison County, and Cindi Mullins was elected sheriff of Saline County. Mullins had been serving as sheriff since February 2016, when the former sheriff stepped down and she was appointed to fill out his term. Ironically, neither envisioned working in law enforcement as they were growing up. Until my first semester of college at Southeast Missouri State University, I thought I wanted to be a veterinarian, said McCutcheon. After two years, I quit because I no longer knew what I wanted to be. My brother had attended the police academy and was working over at Ste. Genevieve County, and that peaked my interest especially the forensics that I thought would be part of the job. It was back in 2000 when the TV show CSI started, and because I had already taken biology and chemistry for vet school, I had all kinds of ideas about what I d be doing! The reality was, I got out of the academy in 2001 and took a road position with the Fredericktown Police Department, so the only forensics I got to dabble in was fingerprint powder! McCutcheon stayed with the department until 2005, when she took a road deputy s spot with the Madison County Sheriff s Office. During that time, she also returned to college, finishing her bachelor s degree. In 2013, she left the sheriff s office to take a job as the director of the Madison County 911 Communications Center. At the same 22 time, she also obtained an advanced mortuary degree from the Des Moines Area Community College, necessary because, for the past five years, she s also served as deputy coroner and worked at the Follis and Sons Funeral Home. McCutcheon said although she felt her 15 years of combined law enforcement experience qualified her to serve as sheriff, she still sat in amazement as election results rolled in. I really couldn t believe it! 23 Missouri s Past Female Sheriffs Although women have served as sheriffs in the past, they had always been appointed to fill out the terms of husbands who had passed away. The first was Nancy Hays Williams, sworn into office Jan. 27, 1912, possibly making her the first female ever to be appointed to the office, not only in the state, but across the nation. She served until February 17 of the same year when a special election was held to replace her husband, J.S. Williams, who had died a few days earlier. In 1933, Sarah Tucker Jones was appointed to serve as sheriff of Christian County after her husband died from injuries sustained in an auto accident. Bernice Uhrmacher served as sheriff for Livingston County from 1954 to 1956 after her husband, Bill, died in After Carroll County Sheriff Alex Goodson Sr. died while in office, his wife Minne took the reins until their son, Alex Jr., was elected. In May 1960, Helen Church was appointed Jefferson County sheriff after her husband, Leo Church, died from injuries sustained in an auto accident. Madison Co. Sheriff Katy McCutcheon she said with a laugh. I worked hard for it so I guess it shows that if you want something badly enough, and if you re willing to work for it, good things do come to you. McCutcheon said she s more than excited about the opportunity to serve. I love this county and I love this community. I, of course, have some ideas on things I d like to change, but for right now I m just looking forward to settling in and being the very best sheriff I can be, she said. Mullins said she started in law enforcement in 1991 as a parttime dispatcher in Slater. She had been working as editor for the local newspaper but it wasn t all she had hoped it would be, and she was looking for something else to do. I really liked working as a dispatcher, so when a full-time position opened up, I took it. Next, they sent me to the law enforcement academy. A female officer had worked there in the past but she had left and they wanted to replace her, she explained, adding that after graduating from the academy, she worked full-time as a dispatcher and part-time as a reserve. In 1996, she took a job with the Saline County Sheriff s Office as a dispatcher and jail officer. Eleven months later, she transferred to the road, where she worked until she was promoted to chief deputy in I guess I m kind of a nerd, she admitted. I like processes policies and procedures. You couldn t tell it by looking at my desk right now, but I like organization. And I even like paperwork! When the former sheriff left office, she was appointed by the county commission to fill the spot. She already had developed good working relationships with the prosecutor s office, the county clerk s office, the court clerks the people she would continue to come in contact with a lot so that helped make the transition easier. At election time, because she grew up in the area and was considered a local girl, and because she worked the road so many years and had gotten to know many residents, she was well-received by the community. Mullins said that although she was opposed in the election, her sex was never discussed. In fact, the only male-female issue was addressed during a candidate forum when she was asked if she supported females in law enforcement. Of course, what am I going to say, she laughed. But I did let people know through that forum that, although we have one part-time female reserve deputy, I am the only full-time commissioned female in our department only because other women haven t applied. Her desire to be the chief law enforcement officer in the county was also supported by her parents, children and step-children, and her husband, Melvin, who served several years as Slater s police chief. They know how badly I wanted this. I m truly honored and look forward to continuing to serve the citizens of Saline County, she said. 23

24 Justice Reinvestment Initiative Underway The number of Missouri s prisoners is on the rise and remains above the national average. Missouri s problems also include an uptick in violent crime, a fastgrowing female prison population, and a sizeable portion of prison admissions that are driven by failures of supervision. In June, Governor Eric Greitens signed an executive order to form the Missouri State Justice Reinvestment Task Force. According to the Governor, the task force will follow a data-driven approach to develop policies that improve public safety, reduce corrections spending, and reinvest savings in strategies that can decrease crime and reduce recidivism. Our prison system wastes your money and it wastes people s lives, said Greitens. We have to fix it. Director of Corrections, Anne Precythe, is trying to reform Missouri s corrections system. According to the Governor, she inherited a mess: morale was low, officers were mistreated, not all inmates had a plan for their release. The task force is made up of designees from all three branches of Missouri s government and state and local criminal justice system stakeholders. Under the direction of the task force, CSG Justice Center staff will conduct a comprehensive analysis of data collected from various relevant state agencies and departments within all three branches of the state s government. To build a more comprehensive picture of statewide criminal justice trends, data on jail and community corrections will be collected from local governments and analyzed where possible. CSG Justice Center staff will also convene focus groups and lead interviews with key stakeholders in Missouri s criminal justice system. Based on the findings from these extensive quantitative and qualitative analyses, the task force will develop options for the legislature s consideration that are designed to both increase public safety and contain the cost of corrections. The task force will also explore opportunities to reinvest in strategies that will further public safety and cost savings. Counties want to know the huge problem of recovering costs of housing state prisoners from the Department of Corrections will be addressed. 25 county jails consumes a significant portion of county budgets. Not only does insufficient reimbursement by the State of Missouri contributes to the financial hardship upon county governments, but also the late payment of the funds is crippling Missouri counties. MAC recently contacted Missouri counties for information regarding the untimeliness of prisoner per diem reimbursement. The following is a sampling of responses: Greene County is 7 months behind in receiving reimbursements and is owed $1,405,773.94; Gasconade County is 5 months behind in receiving reimbursements and is owed $23,026.48; Morgan County hasn t received a reimbursement since February 2016 and is owed $143,517.46; and Phelps County has not had a payment in 2017 and is owed over $200,000. Audrain County Commissioner Steve Hobbs represents MAC on the 22 member task force. Other members include the Governor, Director of the Missouri Department of Corrections, a representative from the Missouri Sheriffs Association, a representative from the Missouri Association of Prosecuting Attorneys, and other Missouri legislative members and government officials. I am excited about the opportunity to represent MAC in the process, said Hobbs. We re going to make sure the task force understands the important role counties play. 25

28 Must Counties Use the State Rate? State Mileage Rate Remains at 37 Cents per Mile At press time, the state mileage allowance remains at 37 cents per mile for privately owned automobiles on state business. Chap , RSMo, permits any county (with the exception of 1st-class charter who have their own authority) to pay a mileage allowance at the rate authorized by the state Commissioner of Administration. Due to Missouri s up-and-down budget problems, the state rate (one of the lowest in the nation) has remained at 37 cents since May For continued updated information, log on to oa.mo.gov and search for state mileage rate. Most counties do follow the state rate. However, a previous legal opinion points to the fact that the county commission can set the rate at whatever level it chooses. When Chap is read in light of the other statute (the one cited above), the county commission can set the rate at whatever level it chooses, especially in light of the introductory wording notwithstanding any other law. Even though there is a potential conflict, usually courts read the laws in light of compatibility, rather than conflict. Also, Chap. 33 is primarily the administrative power of OA over state agencies and state budget administration, not regulation of other governmental entities. As such, the rate would be applicable to state moneys reimbursed to county governments under grants, etc., where vehicles are used for activity. Though it may be subject to more than one interpretation, neither statute has been interpreted by the courts. Just as county governments may continue using the 37- cent per mile rate authorized by the state or establish their own rates, this same rate will apply when determining the rate for workers comp cases (for an injured employee s reimbursement for travel expenses for medical treatment), as well as for witness reimbursement. However, two new mandates have been passed subsequent to Chap According to Chap , RSMo, sheriffs who use their own vehicles for work purposes shall receive the mileage rate allotted by the IRS. Until Dec. 31, 2017, that amount is 53.5 cents per mile. In addition, Chap , RSMo, states that officeholders and employees shall be paid at the highest rate allotted to any officer. In counties where sheriffs use their own vehicles for work purposes, county officials are entitled to the IRS rate of 53.5 cents.
