1 Regular Meeting #11-02 Office January 11, :00 a.m. Commissioners Regular Meeting A regular meeting of the Fairfield County Board of Commissioners was held on Tuesday, January 11, 2011 beginning at 10:00 a.m., with the following Commissioners present: Judith Shupe and Mike Kiger. Steve Davis was absent. Also present were Mary Beth Lane, Brian Kuhn, Carri Brown, Ed Laramee, Aundrea Cordle, Jason Dolin, Jeff Camechis and Staci Knisley. Announcements There were no announcements. Public Comment There were no public comments. Approval of hiring the legal firm Downes Fishel Hass Kim LLP to represent the Fairfield County Engineer s Office On motion of Judith Shupe and second of Mike Kiger, the Board of Commissioners voted to approve the hiring of the legal firm Downes Fishel Hass Kim LLP to represent the Fairfield County Engineer s office, see resolution a Approval of Allowable Weight Reduction on county and township roads for 2011 Fairfield County Engineer On motion of Judith Shupe and second of Mike Kiger, the Board of Commissioners voted to approve of allowable weight reduction on county and township roads for 2011 for the Fairfield County Engineer, see resolution b Jeff Camechis stated that this will be done February 2 nd through April 30 th. Approval of changing a bridge load rating Fairfield County Engineer On motion of Judith Shupe and second of Mike Kiger, the Board of Commissioners voted to approve the changing a bridge load rating for the Fairfield County Engineer, see resolution c Jeff Camechis stated that there had been a study on the bridge. Approval of scheduling Annual Township Trustee Meetings Fairfield County Engineer On motion of Judith Shupe and second of Mike Kiger, the Board of Commissioners voted to approve the scheduling of Annual Township Trustee Meetings for the Fairfield County Engineer, see resolution d Commissioner Shupe asked if date was set yet. Jeff Camechis stated that they have set various dates to have one on one meetings with the townships. PAGE 1

6 Review Session The Board of Commissioners met to review legal issues, pending and future action items and correspondence. Commissioners present were Judith Shupe and Mike Kiger. Commissioner Steve Davis was absent. Also present were Jason Dolin, Brian Kuhn, Mary Beth Lane, Ed Laramee, Jon Slater Jr., Aundrea Cordle, Tony Vogel and Staci Knisley. Mr. Dolin reviewed pending items for his office. Mr. Dolin provided the Board with information relative to the Hocking Township Trustees matter with the Engineer. Hocking Township has hired Isaac, Brant, Ledman & Teetor LLP and the Engineer s office has hired outside counsel. Commissioner Shupe asked Mr. Dolin for an update on the Stoney Hill matter. Mr. Dolin responded that this issue is already in litigation. Commissioner Shupe asked if the County Commissioners were at risk. Mr. Dolin responded that the road was legally on a maintained status for the township and he was not sure if that would remain the same in the future. Mr. Dolin stated that as a reminder Scott Zody was on the Public Safety Committee and that someone would need to replace him. Commissioner Shupe stated that Tony Vogel will take the lead. Commissioner Kiger stated that he would like to look into other alternates. Commissioner Kiger reviewed pending items. A letter from the Humane Society requesting permission to build, Mr. Dolin has recommended that a survey be done of the area and plan. Mr. Dolin also recommended that they are bonded. Commissioner Kiger reviewed that the City of Lancaster prisoner housing contract that is still on pending. Mr. Dolin stated that contract has expired and that a Commissioner should negotiate a new contract. Commissioner Shupe advised Ms. Knisley to schedule a meeting with the Board, Mayor Smith and Mike Courtney. Mr. Dolin stated that the attorneys did not need to get involved at this point. Commissioner Shupe shared with the board a letter from David Fey with Historical Parks. Commissioner Shupe said that 2 of the 3 members have resigned and asked if anyone knew of someone who might be interested. Commissioner Shupe stated that Carri Brown had applied for a Fatherhood Initiative Grant for Fairfield County Job and Family Services. Commissioner Shupe asked Ms. Knisley to make sure the Board of Commissioners are rescheduled with the Carroll Senior Citizens. Commissioner Kiger reviewed invitations and items that need immediate attention. Commissioner Kiger stated that he and his wife Alma will be attending the Baltimore Area Chamber of Commerce Annual Awards Banquet on Saturday, January 15, at 7:00 p.m. Commissioner Shupe stated that she will be going also. Commissioner Kiger and Commissioner Shupe advised Ms. Knisley to make reservations. Commissioner Kiger advised Ms. Knisley to ask Commissioner Davis if he would like to attend any discussed events. Commissioner Kiger stated that he will be attending the trade show for the Lancaster-Fairfield Chamber of Commerce Annual Dinner Saturday, January 22 at 5:00 p.m. Commissioner Shupe stated that she will be attending the dinner at 7:00 p.m. and advised Ms. Knisley to make reservations. Commissioner Kiger stated that he will be attending the Main Street Lancaster & Special Improvement District Annual Dinner Thursday, January 27, at 5:30 p.m. Commissioner Shupe stated that she would be PAGE 6
7 attending also. Commissioner Kiger and Commissioner Shupe advised Ms. Knisley to make reservations. Commissioner Kiger review requests for the Board of Commissioners. Tony Vogel asked the Commissioners to give him authority to sign contracts under a certain amount. Mr. Dolin stated that he could submit a resolution to the Commissioners with a list of contracts for approval on it. Mr. Vogel said that he would work with Staci Knisley to submit the resolution. Commissioner Kiger recommended that the Board of Commissioners change their letterhead and gave the Board examples. Commissioner Shupe and Commissioner Kiger recommended that the Board wait until all three members are present to discuss. Commissioner Kiger stated that he had job descriptions of the Clerk/Manager and he would give each Commissioner copies. Commissioner Kiger stated that the Board would wait until all three members are present to discuss. Commissioner Kiger recommended that the State of the County address date be changed. Commissioner Kiger stated that he would contact Travis Markwood to discuss any other dates. Commissioner Kiger stated that vacancies needed filled for Jon Myers committees. Mr. Myers participated in the LEPC, Health District Advisory Council and was a trustee for the Multi-County Juvenile Detention Center. Commissioner Kiger stated that the President of the Board serves on the Health District Advisory Council, which would be him. Commissioner Shupe stated that she would like to be a trustee for the Multi- County Juvenile Detention Center. Commissioner Shupe advised Ms. Knisley to contact Multi County Juvenile Detention Center to see what had to be completed for her to be a trustee. Commissioner Kiger stated that they would discuss the LEPC position with Commissioner Davis. Commissioner Kiger reviewed the resolution regarding Steve Steffy, the declaration and removal of an obstruction. Mr. Dolin recommended that Ms. Knisley contact Jeff Camechis with the Fairfield County Engineer s office regarding this matter for clarification. Commissioner Kiger reviewed the CORSA invoice for the Health Department. The invoice was coverage for half a year. Commissioner Shupe stated that the coverage for a full year would be almost $12,000. Commissioner Shupe asked Mr. Dolin what we were responsible for. Mr. Dolin responded that the building contents should be covered. Ms. Cordle stated that she would get a breakdown of the coverage. Commissioner Kiger reviewed the CORSA application for Dr. Vajen & Dr. Varney regarding medical professional liability. Ms. Cordle stated that Ginny Shrimplin would be meeting with the Board of Commissioners at the next meeting and will review this and answer any questions. Ms. Cordle added that CORSA has recommended if Dr. Varney is only filling in for Dr. Vajen, that there should only be one contract with Dr. Vajen for and for Dr. Vajen to have a separate contract with Dr. Varney rather than the Board of Commissioners. Commissioner Kiger and Commissioner Shupe asked Ms. Knisley to schedule Dr. Vajen in after the meeting with Ginny Shrimplin. Ms. Cordle stated that she was working with Chip Clark and CORSA to get the square footage of our storage area located at the Olde Shoe Factory. Commissioner Kiger reviewed the request from Deputy Jeff Marvin, Court Security Officer to purchase or replace the control panel for the x-ray machine at the Hall of Justice. Commissioner Kiger questioned if there were any grants that could pay for the control panel. Mr. Vogel stated that he would check with Jon Kochis to see if there were any grant funds that could cover the purchase. Commissioner Kiger asked Mr. Vogel to check with the Judges also. Mr. Vogel asked Ms. Knisley to send him copies of the request. PAGE 7
8 Commissioner Kiger reviewed the Fairfield County Board of Developmental Disabilities appointment. The Board of Commissioner appointed Judith Cottrill on December 21, Ms. Cottrill has to resign due to a conflict of interest. Mr. Dolin stated that Ms. Cottrill will have to send a letter formally resigning. Commissioner Shupe asked Ms. Knisley to contact the Director of the Fairfield County Board of Developmental Disabilities, John Pekar to see if he knew of anyone else interested. Commissioner Kiger reviewed the letter from Downes Fishel Hass Kim law firm regarding their contract rate is increasing from $175 to $180. Commissioner Shupe and Commissioner Kiger agreed to accept the increase and advised Ms. Knisley to proceed. Commissioner Kiger reviewed the Board of Commissioners Informational Items which included a letter from CCAO regarding their regional meetings with Legislators with a list of locations and times. Commissioner Shupe asked that this be put on the Commissioners pending list. Other informational items included a letter from the Board of Elections thanking the Board of Commissioners for use of the Agricultural Center as a polling location, a letter from the Municipal Court Clerk s office regarding criminal/traffic division fines & fees for the month of December 2010, copies of the Prosecutor and Sheriff s Furtherance of Justice reports ending December 31, The Furtherance of Justice reports must be filed with the Board of Commissioners per Ohio Revised Code. Other informational items included a letter from Isaac, Brant, Ledman & Teetor LLP regarding the Patricia Henson versus Fairfield County case. The Board asked Ms. Knisley to contact Isaac, Brant, Ledman & Teetor LLP for status. Other informational items included a letter form COAAA, appointing Mayor Robert Kalish as a member of the COAAA Advisory Council and Frank Jennings of Lithopolis an alternate. Other informational items included a letter from ODNR regarding final approval of flood damage reduction regulations and a letter from the Fairfield County Treasurer regarding November portfolio reports. These reports are to be filed and reviewed by the County Commissioners per the Ohio Revised Code. Mary Beth Lane with the Columbus Dispatch asked Mr. Dolin what the Engineer s dispute is. Mr. Dolin stated that the matter was against the County Engineer and he could not comment any further. Ms. Lane asked the Board of Commissioners what the letter regarding the Humane Society was. Commissioner Shupe stated that they were requesting approval for building on county owned land and that the county is only involved because we are owners of the property.. Adjournment With no further business to come before the Board, on the motion of Judith Shupe and the second of Mike Kiger, the Board of Commissioners voted to adjourn at 10:55 a.m. Roll call vote on the motion resulted as follows: Mike Kiger Steven A.
