As the largest tuna cmpany in the wrld, Thai Unin is uniquely psitined t help drive the industry in the right directin and wrk with its supply chains t find slutins. Presented belw is an agreement between Thai Unin and Greenpeace that seeks t drive psitive change within the industry by addressing fur verarching issue areas (fish aggregating devices [FADs], lnglines, transhipment, labur) that have been identified as drivers f ne r mre f the prblems utlined belw. Despite psitive initiatives in sme crners f the industry, the sustainable harvest f tuna stcks has failed fr varius reasns. The capacity f tuna fleets cntinues t grw beynd tuna stcks ability t maintain sustainable levels. This includes the increased efficiency in the purse seine and lngline fleets due t a pwerful cmbinatin f technlgical advances, the veruse f FADs, practices like transhipment that allw vessels t catch fish further afield and fr extended perids, and the cnstructin f large, factry vessels driving vercapacity acrss the industry. This is cmpunded by illegal, unreprted and unregulated (IUU) fishing that undermines fisheries management and enfrcement effrts, as fleets culd ptentially exceed allwable catches and taint supply chains with laundered fish. A lack f mnitring, cntrl and surveillance make plicing all f the vessels difficult, while inadequate prcurement plicies and supplier requirements have allwed supply chains t bend r break rules, and smetimes g unpunished. Tuna species are amng the mst verfished predatry fish, and nn-target species that are incidentally, r intentinally, caught as a result f indiscriminate fishing methds have als suffered declines. Threatened and vulnerable sharks, turtles, seabirds and ther species are caught and ften killed in tuna fisheries. 1
The nature f the tuna sectr and certain specific practices als create the cnditins fr mistreatment, and even severe human rights vilatins, f wrkers at sea. Unfair treatment, particularly f migrant wrkers, and even human trafficking, have been well dcumented in respected internatinal media. Safe and legal labur envirnments need t be prvided and guaranteed amng tuna vessels. Currently, nt enugh is being dne t ensure the fair and ethical treatment f the peple wh catch, prcess and bring tuna t supermarket shelves. Thrugh this agreement, Thai Unin has made significant and far-reaching cmmitments that aim t supprt current best practice fisheries, imprve ther fisheries, reduce illegal and unethical practices frm glbal supply chains, and bring mre respnsibly-caught tuna t key markets. This package f refrms psitin the cmpany well t help build the necessary mmentum twards a mre sustainable, scially respnsible and transparent industry. The agreement is nt a silver bullet that eliminates the tuna sectr s eclgical and scial ftprint, but it presents an pprtunity t begin t change the way tuna is caught and brught t market t help safeguard the future f impacted species and peple. The implementatin f Thai Unin s cmmitments represents a significant new wrklad fr Thai Unin that will require apprximately five additinal staff and cst arund US$750,000 in implementatin per year. At the end f 2018, an independent third-party will review prgress t-date n the cmmitments made in the agreement. Greenpeace supprts the initiatives detailed in the agreement and will clsely fllw its prgress and implementatin. The actins detailed in this agreement will nly be successful with the full cperatin f Thai Unin s suppliers and partners. LABOUR - Greenpeace and Thai Unin agree that labur and human rights abuses have n place in the seafd supply chain and shuld be eliminated as sn as pssible. The prblem and ur shared interest in reslving it Greenpeace and Thai Unin share an understanding that the prblem f labur and human rights vilatins in glbal tuna supply chains include, but are nt limited t, the fllwing: Frced labur and human rights abuses in the extended seafd supply chain, especially in cmmercial fleets that stay ut at sea fr extended perids f time. The lack f fair remuneratin and decent wrking cnditins fr wrkers in the fishing sectr. The absence f cllective bargaining rights and freedm f assciatin, especially fr migrant wrkers in the fishing sectr. The lack f cntracts in a language that the wrkers can understand. The methd f recruitment fr wrkers n fishing bats thrugh brkers that perpetuate labur and human rights abuse. Our agreements t date Vessel cde f cnduct - Thai Unin cmmits t create a vessel cde f cnduct with an accmpanying auditable standard acrss its glbal supply chain by January 2018. 3
Audits will be cnducted n an nging basis by a reputable third party with a prven track recrd f delivering cmprehensive and respected scial audit reprts. The audit prgram will be initiated by 2018 in line with Thai Unin s SeaChange prgram, and cntinue beynd as part f cntinuus imprvement. The Vessel Cde f Cnduct will be cmmunicated t all vessel suppliers in 2018, with the ntificatin that they can expect t be audited against this Cde at any pint. Supprt fr rganizing rights and cllective bargaining - Thai Unin reaffirms its cmmitment t supprting freedm f assciatin and cllective bargaining in its wn facilities and thrughut its glbal supply chains. Electrnic Catch Data and Traceability (ecdt) -Thai Unin cmmits t expand scalable platfrms fr electrnic Catch Data and Traceability (ecdt) systems that includes wrker vice at sea t vessels thrughut its glbal supply chain. In 2017, Thai Unin will run 2 pilt prgrams t test scalable platfrms fr electrnic Catch Data and Traceability (ecdt) systems that utilize mbile applicatins and satellite cnnectivity t prmte wrker vice at sea and demnstrate fair labur cmpliance in Thai fisheries. The results f the trial will be made publicly available by the end f 2017. Thai Unin cmmits t trials f ecdt n lngline vessels in selected fleets in 2018, as part f nging fishery imprvement prjects (FIPs). Greenpeace and Thai Unin agree that prgress will be shared and reviews made n a six-mnth basis as part f ur agreement review prcess. This will include a re-evaluatin f technlgical advancements t accelerate full adptin acrss Thai Unin s glbal supply chain. Details f strategy, learning and evaluatin will be shared under the agreement review prcess, with a public cmmunicatin n the SeaChange website every six mnths. Audits and transparency - Cmmitment t rbust third party auditing plan and schedule fr the labur cmmitments described herein. Thai Unin will research and address labur abuse at sea issues thrugh its scial audit prgram, with a fcus n frced labur, transhipment, existing mechanisms fr prmting wrker vice, recruitment and cntracts. Findings frm these audits will be built int perfrmance imprvement prgrams within Thai Unin supply chains and where pssible acrss the industry. Generalized results f the audits will be shared publicly n an annual basis t prmte transparency and industry cllabratin. Thai Unin reaffirms its cmmitment t address labur issues in its wn facilities that are audited t internatinal standards by third parties and its prgram t certify all f Thai Unin wned factries t BSCI standard by 2020. BSCI is a glbally recgnized standard fr scial audits. Evidence f cmpliance with the audits will be the certificatin f the factries. 4
Ethical recruitment - Cmmitment t signal Thai Unin s supprt fr its current plicy n zer recruitment fees in Thailand t be expanded acrss its glbal supply chain and the seafd industry mre bradly. Thai Unin will ensure that n recruitment fee language is in cntracts fr thse it emplys and will encurage its suppliers within 6 mnths f finalizing this agreement. Thai Unin will require suppliers t prvide infrmatin n hw they are recruiting wrkers as part f the scial audit prgram. Within 6 mnths f finalizing this agreement, Thai Unin will add language t the English versin f the Business Ethics and Labur Cde f Cnduct t reflect the pints abve and t apply t the whle supply chain. LONGLINING - Thai Unin and Greenpeace agree that lngline fishing presents a risk fr the incidental catch f nn-target species, and current practices increase risk fr illegal practices such as IUU fishing and human rights abuses. The prblem and ur shared interest in reslving it The indiscriminate nature f lngline fishing leads t the incidental, and smetimes intentinal, catch f ther nn-target species and has cntributed t pressure n threatened species f sharks, seabirds and sea turtles. The majrity f current lngline fisheries lack adequate mnitring, cntrl and surveillance, and in high seas fisheries, unreprted catch under-reprting and illegal activities including but nt limited t sharkfinning ccur. Lack f versight and practices assciated with lngline fishing, such as transhipment at sea, enable the cnditins fr these illegal practices, as well as labur and human rights abuses. Our agreements t date Supprt f ple & line and best practice fishing by transitining a prtin f lngline-caught prduct - This will be priritised fr utilizatin in the Nrth American market. 6
Bycatch mitigatin best practice implementatin plan Thai Unin will wrk t emply best practice mitigatin measures acrss all lngline vessels it surces frm. Thai Unin s bycatch mitigatin best practice implementatin plan will be drafted by the end f September 2017 and cntain clear milestnes and verall timeline estimates. Greenpeace will be prvided an advanced draft t prvide feedback and agree t next steps. By the beginning f 2018, Thai Unin will ensure RFMO requirements n seabirds are being met in the WCPO, and cmmunicate and begin implementatin f the best practice mitigatin plan with suppliers. Imprving bycatch data sharing Thai Unin recgnizes that bycatch data availability and sharing is weak within the lngline sectr and will wrk with the fleets it surces frm t share raw bycatch data with relevant RFMO scientific bdies, and wrk with scientists t ensure best practice data cllectin is taking place. Increasing human and electrnic bserver cverage Thai Unin will emply 100% bserver cverage (human and electrnic) n the lngline vessels it surces frm by 2020. Thai Unin is engaging with sme f its key lngline suppliers t trial the ability t increase the use f bth human bservers and e-bservers with the intent t ensure 5% human cverage acrss fleets surced frm is met and t increase human bserver cverage acrss vessels in Thai Unin s supply chain. 7
TRANSHIPMENT AT SEA Thai Unin and Greenpeace agree that transhipment presents a high risk pint within the tuna supply chain, particularly fr IUU fishing and labur abuses. The prblem and ur shared interest in reslving it Transhipment presents a high risk pint within tuna supply chains, particularly fr IUU fishing and labur abuse, allwing vessels t remain at sea fr years withut adequate regulatry versight. Our agreements t date Thai Unin agrees t extend its mratrium n transhipment at sea acrss its entire tuna lngline supply chains unless suppliers meet a strict set f cnditins t ensure the critical issues surrunding the practice are addressed t its satisfactin, and immediately start wrking with its suppliers t implement this strict set f standards. At-sea transhipment cnditins: Observer cverage - Thai Unin will nly surce tuna frm lngline vessels that have human bservers fr bth vessels transshipping at sea t ensure cmpliance with Thai Unin s labur cdes f cnduct. The human bserver prgram will begin rllut in 2018. T further reduce the risk f IUU fishing and practices like shark finning, Thai Unin will expand its bserver prgram by the end f 2020, and wrk with suppliers t help ensure human bservers address bth envirnmental 8
and scial issues assciated with at-sea transhipment in the lngline sectr. Limits n time at sea - T reduce the risks assciated with extended perids f time at sea, Thai Unin agrees t nly surce frm vessels that spend a maximum f 9-mnths at sea befre returning t prt and allwing crew t access prt services. MCS/Transparency Thai Unin agrees t require that any vessel authrized t transship at sea shuld have mandatry AIS r equivalent technlgy. Enfrcement and nn-cmpliance - Any nn-cmpliance by suppliers fund thrugh the scial audit prgram will be addressed thrugh a perfrmance imprvement prgram. Fr critical issues, such as frced labur, issues will require immediate reslutin. Fr ther issues an agreed prgram f perfrmance imprvement and a timeline will be agreed with the supplier. Any suppliers unwilling r unable t meet the Thai Unin standards will be suspended fr a minimum f ne year. Prt inspectins/psma Thai Unin recgnizes the imprtance f the PSMA but als the challenges that sme cuntries face t effectively implement its prvisins, especially prer castal State natins. Hwever, it strngly believes that the benefits greatly utweigh the csts, particularly given the well dcumented impacts and ecnmic cst f IUU fishing t develping castal States. Thai Unin therefre encurages cuntries t ratify the agreement and put in place the means t implement it. Ultimately Thai Unin s aim will be t nly surce fish transiting thrugh prts belnging t cuntries that are fully implementing the PSMA. Data cllectin/traceability Thai Unin is cmmitted t full digital traceability, frm catch t cnsumptin. Traceability is the backbne f sustainability and respnsible surcing. E-lgbks and e-cdt are the future f digital traceability and Thai Unin will supprt trials and regulatr cmmitment t mving frm paper based t electrnic systems. IMO Numbers - Thai Unin will require that all vessels it surces frm that are capable f receiving an IMO number btain ne, and all ther vessels will be required t have a UVI r equivalent registratin number. Observer recruitment - Thai Unin will preferentially surce frm vessels emplying reginal bservers, and where reginal bservers are nt available, will emply natinal r independent third party bservers. Transprt vessels/reefers audits - Thai Unin will implement an audit scheme fr carriers transshipping at-sea, starting in 2018 (Nte: this requirement will nt apply t vessels that transship in prt). 9
FADs - Greenpeace and Thai Unin agree that the sustainable management f tuna stcks requires management and reductin f FADs in each fishery. The prblem and ur shared interest in reslving it Thai Unin agrees with Greenpeace that the veruse f FADs leads t verfishing and cean pllutin as waste FADs remain uncllected. As such, Thai Unin is cmmitted t wrking tgether with the fleets frm which it surces t reduce the number f FADs deplyed in tuna fisheries with the verall bjective f the sustainable management f the tuna stck status in fisheries frm which it surces. Our agreements t date FAD reductin plan and increase f verified FAD-free supply - Thai Unin cmmits t reduce the number f fish aggregating devices (FADs) used glbally in its supply chains by an average f 50% by 2020, while dubling the amunt f verifiable FAD-free fish available in markets glbally in the same perid. Agreement t nly deply nn-entangling FADs frm large seiners - By 30/06/2017, all large scale purse seiner vessels must have a plicy t deply nn-entangling FADs, with the aim t nly deply nn-entangling FADS by 31/03/2018. 10
Exclusive use f nn-entangling and bidegradable FADs - By 31/12/2020 all vessels Thai Unin purchases frm will deply nly nn-entangling FADs. Thai Unin cmmits t mve the fleets frm which it surces twards fully bidegradable FADs, and t be an early adpter f scientifically prven fully bidegradable FAD materials/technlgies (excepting the buy). Addressing Supply Vessels - Thai Unin supprts the IOTC s initiative t address the subject f supply vessels as it relates t vercapacity and verfishing. It encurages ther RFMOs t develp a scientific basis fr decisins n the impact f supply vessels n fish stcks, and apprpriate regulatin. Thai Unin cmmits t asking all f its supplying fleets t immediately begin prviding accurate data t the relevant RFMO n their current use f supply vessels and call n RFMOs t expedite analysis n the impact f supply vessels n capacity in the Indian Ocean and Pacific. FAD management plans in FIPs - Fr each tuna FIP in which Thai Unin is active where FADs are utilised, a FAD management plan will be develped which will include better regulatin by castal states and RFMOs, and mapping f the number f FADs deplyed t measure reductin prgress. Transparency f FAD use data Thai Unin recgnises the value f reliable and accessible data n FAD use in imprving, understanding and managing the impacts f FADs. As such, Thai Unin will ask and expect all f the fleets / purse seiners it surces frm t share their data n FADs with RFMO Scientific Cmmittees within 4 mnths f the end f the fishing trip. Thai Unin will ask and expect all f the fleets it surces frm t share data in this way and will be clear with them that it sees this becming a required standard fr the cmpany. Thai Unin will urge all f the RFMOs t step up their ability t receive and utilise such data in the management f FADs. Infrmatin fr Cnsumers -Thai Unin will prvide mre details n FAD free tuna n its can tracker websites t imprve the ability f cnsumers t understand the prducts they are buying. RFMO Regulatins n FADs Thai Unin agrees t maintain its wn targets while they are strnger, but publicly supprt any RFMO actin plans that attempt t further reduce the use f FADs. 11
