15 Recognizing the NewSpace Mindset 1. Things move quickly - development happens on the scale of weeks & months, not years 2. Operations are flexible - systems can be designed around license conditions and/or coordination requirements a. a smallsat may only need 95% downlink availability, rather than 99.9%, and can work around existing systems 3. Yes, but is much preferred to No Answer - launches will go with or without smallsats a. regulators need to not stand in the way of innovation, but rather, impose conditions for responsible use and evolve together with the operators
16 Licensing Challenges Things that stay the same: Basic design of the satellites Radio Frequency bands used Basic details of imagery resolution and spectral bands Things that change: Launch manifest (orbits, # of satellites, launch schedule launch vehicles) Numbers and locations of Earth Stations Some RF characteristics (e.g. antenna properties, output power, bandwidth, modulation + FEC) Some imaging characteristics (specific details on imaging resolution, based on orbital altitude, and spectral filters) CONOPS (e.g. addition of radio ranging, constellation spread, improved Earth Station pointing)
17 Beware of Double Licensing Planet Inuvik ground station is currently under review by both ISED and GAC: ISED ISED process focuses on the specific ground station ISED also ensuring Planet coordinating with affected Canadian satellite operators GAC GAC evaluating the ground station site and the entire end-to-end satellite system
18 Canada is Unique Planet has licensed ground stations in the following countries with no additional remote sensing review: United Kingdom New Zealand Germany Australia Iceland South Africa Norway Chile
19 Taller Fences, Smaller Areas The U.S. quickly realized regulators are getting overwhelmed by processing smallsat applications Adopting a policy of Taller Fences, Smaller Areas to focus on the truly sensitive technologies and providing regulatory-lite for many smallsats Downgrade of many satellites from ITAR to EAR NOAA threshold for full licensing process based on satellite capability FCC considering expedited licensing process for short duration missions
20 Regulatory Tools Experimental license - lighter/faster process that gets you in orbit, but without the full protection of an operational system Special Temporary Authority - allows for temporary (between 30 to 120 days) authority while main application under review, or for one-offs (e.g. LEOP) Blanket Approvals - smallsats don t always know final system details (e.g. launch parameters), so an operational box is defined to allow for flexibility but also evaluates worst-case impact
