1 Minutes The Respiratory Care Advisory Committee of the Board of Medical Licensure and Supervision met on February 7, 2008 in accordance with the Open Meeting Act. The meeting was held at the office of the Board, 5104 North Francis Avenue, Suite C, Oklahoma City, Oklahoma. Members present were: Julie Fanselau, RCP, Chairwoman Dianne Gasbarra, MD Karen Hart, RCP Jim Porterfield, RCP Garrett Rank, DO Dean Wersal, RCP Members absent: Carol Smith, RCP, Vice Chair Matthew Britt, MD Paul Benien, DO Others present: Patricia Podolec, Assistant Attorney General Robyn Hall, Director of Licensing Kathy Plant, Executive Secretary Noting that a quorum was present, Ms. Fanselau called the meeting to order at 11:32 a.m. The Committee reviewed the minutes from the October 25, 2007 meeting. Mr. Porterfield moved to approve the minutes as presented. Ms. Hart seconded the WILLARD FREEMAN appeared in support of his application for Respiratory Care Practitioner licensure. Mr. Freeman had been out of practice since He testified regarding his activities since his license expired. Ms. Hart moved to recommend approval of the application. Dr. Gasbarra seconded the motion. The Committee discussed having him work under supervision for a time. Ms. Hart withdrew her motion and Dr. Gasbarra withdrew her second. After further discussion, Ms. Hart moved to recommend approval of the application pending satisfactory completion of 90 days practice under direct supervision. Dr. Gasbarra seconded the

2 The application of LYNERRY WAYNE HENNING for Respiratory Care Practitioner licensure was next on the agenda. Mr. Henning was not present and staff had not received the supervisor s report requested by the Committee at the last meeting. Ms. Hart moved to table the application until Mr. Henning provides the requested information. Mr. Porterfield seconded the motion and the vote was unanimous in the affirmative. JAMES MICHAEL GORDON appeared in support of his application for Respiratory Care Practitioner licensure. Mr. Gordon testified regarding his difficulties in Florida and Kansas. Ms. Fanselau moved to enter into Executive Session. Mr. Porterfield seconded the Ms. Hart made the motion to return to open session. Dr. Gasbarra seconded the motion and the vote was unanimous in the affirmative. Dr. Rank moved to table the application until Kansas and Florida can be contacted to verify Mr. Gordon s current status and to see if any complaints have been filed. Mr. Porterfield asked for an amendment to allow Mr. Gordon to continue practicing under his temporary licensed unless a problem is reported and then the Board Secretary could remove the temporary license. Dr. Rank accepted the amendment to the motion. Mr. Wersal seconded the motion. Ms. Fanselau asked that Mr. Gordon provide an evaluation from his supervisor when he appears at the next meeting. Dr. Rank accepted the amendment to his motion. Mr. Wersal seconded the amended The next appearance on the agenda was KEESHA NICOLE DANIELS, applicant for Respiratory Care Practitioner licensure. Ms. Daniels was not present and consideration of the application was tabled until later in the meeting. KERVIN WASHINGTON appeared in support of his application for Respiratory Care Practitioner licensure. Mr. Washington answered questions about his substance abuse related arrests and the action taken by the North Carolina licensure sure board. He stated that he worked in Oklahoma from 1995 to 1997, although he did not possess an Oklahoma license. Ms. Hart moved to recommend approval of the application under terms of an Agreement allowing the Board to monitor for substance abuse pending satisfactory completion of 90 days of practice under direct supervision. She further moved to place a letter in Mr. Washington s file stating there would be no tolerance if he again practiced in Oklahoma without an active license. Mr. Wersal seconded the RICHARD LEE GILLISPIE appeared in support of his application for reinstatement of Respiratory Care Practitioner licensure. Mr. Gillispie had been out of

3 practice since November Mr. Gillispie testified regarding his administrative duties at Comanche County Memorial Hospital. He stated he had completed 14 hours of continuing education. Dr. Rank moved to recommend approval of the application pending satisfactory completion of six months of practice under direct supervision. Ms. Hart seconded the MARCUS LYNN LOGAN appeared in support of his application for Respiratory Care Practitioner licensure. Mr. Logan had not practice since 1995, had never been credentialed but was applying under the grandfather clause based on his experience prior to Ms. Hart moved to recommend approval of the application pending passing the NBRC exam. Mr. Wersal seconded the motion. Mr. Logan testified regarding his job responsibilities with a home health company. The application of JUDY ANN PALMER for Respiratory Care Practitioner licensure was next on the agenda. Ms. Palmer was not present. Mr. Wersal moved to table the application until Ms. Palmer requests an appearance. Dr. Rank seconded the The application or RACHEL ANN MOORE for Respiratory Care Practitioner licensure was called. Ms. Moore was not present. Ms. Fanselau moved to table the application until Ms. Moore requests an appearance. Mr. Wersal seconded the motion and the vote was unanimous in the affirmative. STUART JOHN RAY appeared in support of his application for Provisional Respiratory Care Practitioner licensure. Mr. Ray answered questions regarding his failure to list on his licensure application a misdemeanor received for writing a worthless check. Mr. Ray apologized as said it was not intentional as he did not even know about the misdemeanor on his record. Ms. Hart moved to recommend approval of the application. Mr. Porterfield seconded the motion and the vote was unanimous in the affirmative.

4 MICHELLE A. FERGUSON, RC appeared at the request of the Board Secretary to discuss her dismissal from Integris Baptist Medical Center. Elizabeth Scott, Assistant Attorney General, briefed the Committee on the facts behind Ms. Ferguson s dismissal. Ms. Ferguson testified regarding the incident that led up to her losing her job. The Committee asked staff to verify Ms. Ferguson s response regarding the hospital s NICU ventilator check policy and patient blood gas documentation. If Ms. Ferguson s story is confirmed by the documentation, the Committee directed staff to place a letter of no tolerance in her file. Ms. Scott advised that if the information is not confirmed by the documentation, then staff would discuss the next step with the Committee Chair. The application of KEESHA NICOLE DANIELS was called from the table. Ms. Daniels still was not present. Mr. Wersal moved to table the application until Ms. Daniels requests an appearance. Ms. Hart seconded the motion and the vote was unanimous in the affirmative. Applications for licensure were reviewed.
