List up to three pro bono matters that are representative of the pro bono work your firm participates in. A client seeks an increase of his veterans benefits as a result of additional medical problems for which he is not already being compensated. The firm is asked to obtain 501(c)(3) status from the IRS for a newly organized nonprofit corporation that will provide recreational services to youth in underserved areas. At the request of the adult child of a mentally incompetent, institutionalized parent, the firm undertakes setting up a guardianship. List up to three pro bono matters that are highlights: Attorneys from the firm represent a husband and wife. He is an American-born United States citizen and a combat veteran of the first Gulf War who received an honorable discharge after more than a decade of active service. She is a naturalized United States citizen, having emigrated from Pakistan over 30 years ago when she was a child. They are both Muslim. He supports his family through his employment as a commercial airline pilot. In mid-2008, his employer suspended him without pay, however, because his name appeared on the Transportation Security Administration s Selectee watch list. Prior to that time, they had experienced significant difficulties and delays while traveling, apparently due to their improper inclusion on that list. Attorneys from the firm filed a lawsuit against several governmental agencies on behalf of the couple in late summer Shortly thereafter, Defendants apparently permitted the client s employer to return him to work. Plaintiffs lawsuit alleges that Defendants failure to provide any procedural due process and, more particularly a name-clearing hearing, to allow plaintiffs to contest their designation on the watch list violates their due process rights under the Fifth Amendment to the U.S. Constitution. Plaintiffs also allege that Defendants selected them for and maintained them on the watch lists because of their Muslim faith and attendant religious activities, which violates the Free Exercise Clause of the First Amendment, is intentional discrimination in violation of the Fifth Amendment, and amounts to retaliation for constitutionally protected activity under the First Amendment. Plaintiffs action is currently pending in the United States District Court for the Middle District of Pennsylvania. A Navy veteran, with the help of Saul Ewing, was finally successful in obtaining benefits 23 years after discharge. After unsuccessfully applying for benefits in 1987, the veteran sought to reopen his case in 1995, and again in August The third attempt to establish entitlement to benefits initially failed. The basis for each of the denials was the veteran had failed to establish that his mental illness was service-connected. Although the veteran began experiencing symptoms of mental illness during his service and was prescribed antipsychotic medication within nine months of discharge, he was not formally diagnosed with paranoid schizophrenia until 13 months after discharge, outside the service connection period. In denying the third attempt, the Board of Veterans Appeals violated its review standards and ignored the substantial medical and lay evidence submitted by the veteran. Instead, it relied only on its own psychologist, who incorrectly concluded that the veteran did not complain of symptoms of mental illness during or immediately after his service. Upon rehearing Saul Ewing submitted additional medical evidence, including a report from a VA psychologist treating the veteran, and thoroughly laid out the overwhelming medical and lay testimony showing that the Veteran was suffering from mental illness immediately after discharge, if not during his service, and that illness continued to the present. In January 2009, the Veterans Board of Appeals sided with the veteran, found service connection and awarded him benefits dating back to the start of his last appeal, In legal circles, the term secondment has come to describe the practice in which a lawyer from one organization (such as a law firm) temporarily acts as in-house counsel for another organization (such as a client, a government agency, or a charity). The lawyer is seconded (or lent) to another organization for a temporary period of time. The recent economic climate has put increased pressure on the providers of legal services for the poor. On a pro bono basis, Saul Ewing was consulted about a secondment issue involving two separate legal services organizations which provide free civil legal services to low-income individuals. Sometimes, those organizations represented parties which were adverse in a given proceeding. Saul Ewing provided advice about how to structure a secondment between the two legal services organizations so that they could pool certain of their attorneys in order to meet a spike in demand for certain services while dealing with the potential ethical conflicts of interest issues. In an unprecedented move the firm selected two underserved populations veterans and elders as its signature causes.
