Fluvanna Correctional Center for Women Class Action Wiley Rein filed this class action lawsuit in 2012 in collaboration with the Legal Aid Justice Center in Charlottesville, VA and the Prisoners Project of the Washington Lawyers Committee for Civil Rights and Urban Affairs. The complaint described substandard health care conditions that led to numerous life-threatening complications for the clients, significant pain and suffering, and premature deaths. The lawsuit alleged that the Virginia Department of Corrections (VDOC) and its private, for-profit medical care contractors violated the female inmates constitutional rights by failing to provide adequate medical care in contravention of the Eighth Amendment prohibition against cruel and unusual punishment. Wiley Rein negotiated a favorable settlement in the case on behalf of nearly 1,200 prisoners at the Fluvanna Correctional Center for Women. Maryland ACLU Civil Liberties Case Wiley Rein represented the ACLU of Maryland and 11 individuals in a case stemming from government officials unlawful compilation of personal information regarding the perceived political enemies of an incumbent politician. The suit was filed in 2012 against Anne Arundel County, former County Executive John Leopold, and two police officials, alleging that Mr. Leopold had directed his staff and police officials to compile dossiers including personal information about the individual plaintiffs, whom he perceived to be political rivals. Mr. Leopold resigned from office in 2013 after being convicted of misconduct. One key question in this case was whether the individuals had a private cause of action under the Maryland Public Information Act against local governments and government officials who collect and disseminate private citizens personal information in violation of the Act. The Circuit Court ruled against the plaintiffs on this issue, but on appeal, Maryland s intermediate appellate court reversed, holding that a private cause of action exists, even in the absence of actual damages. CAIR Coalition Jamaica Asylum Case Wiley Rein attorneys represented an individual from Jamaica who faced the prospect of being deported back to his native country, where he had previously faced persecution and serious physical abuse based upon his sexual orientation. This was an uphill battle from the outset as the client had a criminal record and had allowed the statute of limitations to lapse on his claim seeking asylum. Also, due to the physical and mental trauma to which the client had been subjected, he was unable to be of as much assistance as would have been preferred in regard to details of his case, and he had some history to overcome in order to prove his homosexuality. After briefing and argument, the Immigration Judge granted withholding from removal allowing the client to lawfully remain in and be eligible to obtain a work permit in the U.S. List up to three pro bono matters that are highlights (e.g., a Supreme Court case). On behalf of The Equal Rights Center, Wiley Rein and the Washington Lawyers Committee for Civil Rights and Urban Affairs secured a multimillion dollar settlement of a class action lawsuit brought against MetroAccess, the DC metropolitan area public transportation system, alleging that Metro had violated the Americans with Disabilities Act and the Rehabilitation Act by failing to provide adequate service to customers with disabilities. In 2008, The Washington Lawyers Committee for Civil Rights and Urban Affairs presented Wiley Rein with its Outstanding Achievement Award in the field of Disability Rights for the firm s representation on this matter. In resolution of pro bono litigation pursued on behalf of DC Central Detention Facility (DC Jail) inmates by Wiley Rein s Theodore A. Howard, the DC government agreed to establish and enforce a 2,164-inmate population cap at the DC Jail. Mr. Howard, in conjunction with the DC Prisoners Project of the Washington Lawyers Committee for Civil Rights and Urban Affairs, sued the District of Columbia in June 2005 to force compliance with the DC Jail Improvement Act of a law enacted in order to alleviate dangerous conditions in the jail attributed to overcrowding. In August 2007, DC Superior Court Judge Melvin R. Wright granted Mr. Howard s clients summary judgment and ordered the city to submit in writing its plan to adhere to the law and implement a population cap. Wiley Rein secured an important pro bono victory against the operators of a years-old realty scheme to defraud poor and homeless persons in the Washington, DC metropolitan area. Attorney Daniel P. Graham, in conjunction with The Washington Legal Clinic for the Homeless, represented one of the scam s victims in a DC Superior Court lawsuit. According to the suit, Mr. Graham s client paid the scam entity - Apartment Finders and its proprietor, Jasmine Worthy - a non-refundable application fee, as well as a security deposit and the first month s rent for the promise of low-rent housing. The client never received housing and Apartment Finders stopped responding to her inquiries. The court judgment in this case imposed the maximum civil penalty available under the DC Consumer Protection Procedures Act.
