Brust SUBJECT: Proposal for Public Art at the Marine Safety Center RECOMMENDATION: That the City Council: 1) Consider the recommendations for public art at the Marine Safety Center; and 2) Consider allocating City funds for Project 1, ($60,000); and 3) Authorize the City Manager, with the City Attorney, to develop a Memorandum of Understanding between the City and the Surfing Madonna Oceans Project Foundation for Project 2, ($20,000), and Project 6, ($10,000). STRATEGIC PLAN: This item applies to the Arts and Culture Focus Area. FISCAL CONSIDERATIONS: If Council approves Project 1, ($60,000), (Attachment 1), a budget adjustment will need to be brought back for consideration by Council in FY Funding for Project 2, ($20,000), and Project 6, ($10,000), will be provided by the Surfing Madonna Oceans Project Foundation. Funding has not yet been identified for the remaining projects: Project 3, ($30,000), and Project 4, ($5,000). Ongoing maintenance for public art is budgeted in FY BACKGROUND: On November 18, 2015, the City Council gave direction to the Commission for the Arts to develop a recommendation for public art at the Marine Safety Center at Moonlight State Beach. The recommendation was to also include a project(s) that could potentially be funded by the Surfing Madonna Oceans Project Foundation, which had expressed interest in funding public art at the Marine Safety Center. Proposals for public art on City property follow the process identified by the City s Public Art Policy, (#C002), (Attachment 2). All proposals are forwarded to the Commission for the Arts for review and consideration. A recommendation is then presented to the City Council. All public art projects on City property, that are funded by the community, must be donated to the City, and will become the property of the City Item 10F 1 of 87

2 The Public Art Advisory Committee and Surfing Madonna Oceans Project Foundation, along with City staff, developed recommendations for public art at the Marine Safety Center, Marine Garage and Concession Building. The recommendations have the potential to serve as a Master Plan for Public Art at Moonlight State Beach, (Attachment 1). The recommendations received unanimous approval by the Commission for the Arts at their meeting on February 1, The Surfing Madonna Oceans Project Foundation approved the recommendations on Feb. 8, 2016, and selected Project 2, ($20,000), for funding. On April 7, 2016, the Surfing Madonna Oceans Project Foundation requested an additional public art project be added to the recommendations, an interactive analemmatic sundial. An individual can tell the time by standing on the sundial, year-round. Funding for Project 2, ($10,000), will be provided by the Surfing Madonna Oceans Project Foundation. At their meeting on April 11, 2016, the Commission for the Arts approved the recommendation and added the sundial to the recommendations for public art, (Attachment 2). The Parks and Recreation Commission approved the recommendations at their meeting on April 19, ANALYSIS: Public art has been determined to be a desirable addition to Moonlight State Beach by key community stakeholders. The venue is the City s most popular tourist destination, drawing thousands of residents and visitors annually. It is located adjacent to the City s vibrant downtown, one of the remaining classic California beach business districts along a 6-mile stretch of Coast Highway 101. Historically, Moonlight State Beach was a popular community gathering space for the Kumeyaay Indians, who would socialize, bathe and wash clothes, in Cottonwood Creek, which spills into the Pacific Ocean. The name Moonlight Beach dates back several generations and is purported to be derived from seeing moonlight reflected on the stones on the beach. In the early Twentieth Century, Encinitas was a flourishing agricultural community. On weekends, residents would gather to socialize and dance in an outdoor pavilion on the sand. Recycled wood from this venue would later be used to build the Boat Houses, located on 3 rd Street. Project 1, for which City funding is being requested, will be the largest of the public art projects at a length of forty (40) linear feet, covering two (2) walls of the Marine Safety Center. The artwork will be attached to the wall surface and can be made of mosaic tile, metal, glass and other artistic medium. The budget is $60,000. Artists from Encinitas and San Diego County will be invited to submit artist designs for consideration. The artistic content of the public art projects may be based on the following: 1) Interpretive (a visual representation of the ocean, sea life, or beach activity, as defined in the Moonlight Beach General Plan (Attachment 3). 2) Kumeyaay Indian culture. 3) Historical Encinitas. For each project, a request for proposals will be issued to solicit artist designs. State Parks Agency staff will review the designs and forward their recommendations. A Selection Committee, comprised of members of the Commission for the Arts and key stakeholders, will review the recommendations and evaluate the designs. The selected designs will be reviewed by the public for a 30 day period. The Selection Committee will review the public comments and forward a final design recommendation to the City Council for their review and selection. The City Manager, with the City Attorney, will develop a Memorandum of Understanding between the City and the Surfing Madonna Oceans Project Foundation to donate funds for Project 2, ($20,000), and Project 6, ($10,000), and formalize the agreement for public art at Moonlight State Beach Item 10F 2 of 87

3 ENVIRONMENTAL CONSIDERATIONS: The action considered is exempt from the California Environmental Quality Act, (CEQA), because it is not a project under Section 15378(b)(5) of CEQA Guidelines. The action involves an organizational or administrative activity of government that will not result in the direct or indirect physical change in the environment. Philosophy The City Council recognizes the value of an ongoing program in Public Art that respects cultural heritage, promotes artistic development, and adds dignity and beauty to the public spaces of the City of Encinitas. II. Purpose To provide guidelines for Public Art projects in the City of Encinitas. Public Art may come to the City in a number of ways; this policy establishes a procedure for that process. Public Art projects may be proposed to the City by gifts and donations, loan, solicited or unsolicited proposals, City public works projects, business or private developer projects, and memorials. III. Method All proposals for Public Art are to be forwarded to the Commission for the Arts who will review the project and present an analysis and recommendation to the City Council for their consideration. The City Council will make the determination to accept or reject the proposal; or to return the proposal to the Commission for the Arts for additional review. IV. Definitions 5/12/16 A. The following criterion will be considered in making an analysis and recommendation for Public Art proposals. 1. Artwork. An original work of art, two-dimensional or three-dimensional, that is unencumbered of debt, and becomes the sole property of the City of Encinitas. 2. Art Collection. All artworks, owned by the City, and permanently located on City property, will comprise the City of Encinitas Public Art Collection. 3. Artist. An individual, recognized by critics and peers as a professional practitioner in the visual arts. Artists will be identified and selected through a Request for Proposals (RFP) or Request for Qualifications (RFQ) process. 4. Location. A public site, that is appropriate for the artwork, will be determined based on input from the City Council, Commission for the Arts, City staff and the community. 5. Design Process. Proposed designs for Public Art projects will be reviewed by the City Council, Commission for the Arts, City staff and the community. 6. Quality. A determination of the quality of the artwork, its aesthetic value, enhancement to the community, and appropriateness, will be conducted. 7. Maintenance. The City, as owner, will be responsible for cleaning, maintenance and repair of public works of art. In the case of a repair, if possible, the original Item 10F 9 of 87

10 C. Gifts and Donation D. Loan of Artworks artist will be contracted to complete repairs to return the artwork to its original condition. If the original artist is not available, an artist, or conservationist, skilled in the appropriate art form, will be contracted to complete the repair. 8. Registry. The City will maintain an inventory of all City owned public artworks, to include the title of the artwork, date the artwork was completed, name, address and contact information of the artist, media, location of the artwork, name of donor, date it became the property of the City, fabrication, contractor and vendor information, date of deassession, and any other pertinent data. 9. Signage. Each artwork will have a permanent identification plaque placed near it that lists the title of the work, artist, media, donor and owner. A plaque, for twodimensional artworks, is not to exceed five (5) square inches in diameter and will be placed on the wall at the lower right hand corner adjacent to the artwork. A plaque, for three-dimensional artworks, is not to exceed ten (10) square inches in diameter and can be placed in a location mutually agreed upon by the artist and City staff. 10. Deaccession. The City, as owner, may choose, at any time, to deaccess an artwork. 1. The City will accept donations of works of art from individuals, organizations, foundations, corporations, and government entities. 2. All works of art must be unencumbered of debt and will become the sole property of the City. 3. The acceptance by the City of donations of Public Art is subject to the conditions contained in Administrative Policy F007, City Receipt of Donations. 4. All proposals for a gift or donation of Public Art are to be forwarded to the Commission for the Arts who will review the proposal and present an analysis and recommendation to the City Council for their consideration. The City Council will make the determination to accept or reject the proposal; or return the proposal to the Commission for the Arts for additional review. 1. The City, as owner, may loan a piece of art, by agreement, to an arts institution or museum, or other entity deemed appropriate. Security, insurance, location, proper care for the artwork and its environment, including climate and humidity, are to be considered. The institution or museum shall provide evidence of liability insurance in the amount of one million dollars which would cover the value of the artwork and any associated liability. 2. The City may accept the loan of two-dimensional, and/or three-dimensional artworks, by agreement, to the City. Duration of the loan, security, insurance, location, access by the public, proper care for the artwork and its environment, including climate and humidity, are to be considered. City Risk Management shall be advised prior to the loan of an artwork in order to obtain adequate liability insurance. Capital Improvement Projects 1. The incorporation of artistic design elements in Capital Improvement Projects (CIP) at the pre-design stage is encouraged. This may include input and participation by artists, architects and design firms, and such things as a specific piece of art, and/or artistic design elements. 5/12/ Item 10F 10 of 87
