INTELLECTUAL PROPERTY LAW 17 PATENTS Grant to an inventor the exclusive right to the fruits of his invention and the right to exclude others from practicing his invention. Protects new and useful processes, machines, articles of manufacture, or composition, and improvements. TRADEMARKS A word or design placed on products or goods by a manufacturer to identify his goods and distinguish them from others. COPYRIGHT An indication that protects the literary or artistic expression of an idea. TRADE SECRETS Private information that if made public could injure the owner in the market place.
COPYRIGHT 18 Original work of authorship, fixed in tangible medium. In most countries, protection is obtained at time of creation of the original work of authorship. Registration of copyright in governmental office is preferred in some situations. Place notice of copyright on work: Copyright, STMicroelectronics, Inc. (year created) or, STMicroelectronics, Inc. (year created) Place on all originally created works: Software Data books, Datasheets Reports Procedures Specifications
PATENTS: BACKGROUND 19 Recognizes the fundamental principle of freedom that a person can reap what he has sown. Protects the person who invests in R&D from copycats. Basic right recognized by all developed countries and many Third World countries. A patent is a right granted by a government to exclude others from making, using, or selling the claimed invention.
PATENTS: ST's MOTIVATION 20 Stakes out a claim in return for R&D dollars spent. Prestige and respect by investors. Offensive purposes: Royalty income, Provides exclusivity. Defensive purposes: Access to important technology/markets, Lower or no royalties to competitors. Offensive & Defensive = competitive advantage.
PATENTS: NON-PATENTABLE SUBJECT MATTER 21 Mathematical equations and step by step procedures for solving mathematical equations "Mathematical Algorithms" Laws of nature, naturally occurring physical phenomenon and abstract ideas Some methods of doing business are patentable Do not make these determinations yourself - the Patent Department will make this determination.
CRITERIA FOR PATENTABILITY 22 Useful Novel Non Obvious
NOVELTY 23 An invention shall be considered to be new if it does not form part of the State of the Art What is the State of the Art? Everything made available to the public by means of a written or oral description, by use, or in any other way Before the date of filing of the application
