3 Intellectual Property Importance IP is considered the official and legal way to protect and support innovation and ideas whether in industrial property or literary and artistic property. Industrial property and in particular patents is considered one of the most important reasons for technology transfer and the economical and industrial development around the world. WIPO indicate that there is a huge increase in patents filling from 800,000 in early 80 s to more than 2,9 million in 2015 on Strong Growth From China; Demand Also Increased for Other Intellectual Property Rights. Innovators in China powered global patent applications to a new record in 2015, filing more than a million applications for the first time ever within a single year amid rising worldwide demand for intellectual property rights that undergird economic activity. 6 History of Research Activities at KSU Historically, research at KSU has always followed the publication only path. This path alone does not guarantee that the public will benefit from the innovative ideas developed at KSU. Very little of the work published by KSU constituents has found its way to the public in the form of tangible results or products. The missing link is: transferring the technology developed at KSU to the public for the benefit of society. KSU decided to establish Intellectual Property & Technology Licensing Program (IPTL) in order to become the channel through which KSU inventors can obtain all methods of support for protecting, marketing and transforming their inventions into commercial and industrial products. 10 Patents & Technology Transfer Invention: An idea developed by the inventor that results in a solution of a certain problem in the field of technology. Protection document: The document granted by the SPO for one of the subject matters of protection. It may either be a patent, a certificate of layout design, a plant patent, or a certificate of an industrial design. 11 The Criteria for Obtaining a Patent A patent may be issued on an invention, in accordance with the provisions of this Law, if it is new, involves an inventive step, and capable of industrial application. The invention may be a product, a process or relates to either. Novelty: An invention is new if it is not anticipated by prior art. In this respect, prior art means all that is disclosed to the public anywhere by means of written or oral disclosure, by use or by any other way through which knowledge of the invention is realized. This has to be prior to the filing date of the patent application or the priority application. The disclosure of the invention to the public shall not count if it takes place during the priority period. The Regulations shall specify other cases of invention disclosure which do not fall within the meaning of prior art and the provisions governing temporary protection of inventions. 12 The Criteria for Obtaining a Patent Inventive Step: An invention is deemed to involve an inventive step if, with regard to prior art related to the patent application, it is not obvious to a person with ordinary skills in the art. Industrially applicable: An invention is deemed industrially applicable if it can be manufactured or used in any type of industry or agriculture, including handicrafts, fishing and services. Article Six: (a) The employer shall be the owner of the protection document, unless the work contract stipulates otherwise, where its subject matter results from the execution of a contract, or an obligation providing for exerting efforts to develop it, or if the employer proves that the employee would not have developed the subject matter of the protection had he not used facilities, means or data made available through his employment. (b) This shall be without prejudice to the employee s right to receive a special award to be agreed upon with the consent of both parties, or assessed by the Committee in light of the various circumstances of the contract of employment, and the economic importance of the subject matter of the protection. Any special agreement depriving the employee of this right shall be null and void. (c) An application for a protection document filed by the employee within two years from the date of termination of employment shall be deemed as if submitted during the employment. (d) The previous provisions shall apply to government employees. (e) If the subject matter of protection developed relates to national security, it shall be governed by the provisions stipulated in the Implementing Regulations. Jan 01,

14 Patent Ownership Intellectual Property and Technology Licensing Program Bylaws at King Saud University Article 20: KSU shall be the proprietor of all patents filed by inventors of its employees or students if they reach such inventions while practicing their regular functional or academic duties; or because of the financial, technical or material support granted to them directly by KSU or as a result of using KSU equipment, tools, labs, incubators or research chairs. According to provisions of paragraph 2 of article 4 of these bylaws, any patents filed via the Program shall be KSU Property. Article 21: Taking into consideration the provisions of article 20, KSU has the sole rights of property to the invention, and can exploit it commercially or industrially by all legal methods. KSU may, upon recommendation of University Council, assign all or some of such rights in return of money or free of charge. Article 22: Inventor shall have the right of Property to his invention and all other indirect rights in the following cases: If Program Management resolves to reject filing the invention, unless the rejection was due to negligence or deliberate default from the applicant. If the inventor has accomplished his invention before joining KSU. If the inventor proves to Program Management that he has accomplished his invention using his own resources and efforts, and did not get any financial, technical or material support from KSU. Average patent filing (2,35 patent per year) (92,41 patent per year). USPTO represents the largest share in the total number of patents with 350 patents, by about 42,73% of the total KSU s patents. 28 A Big Leap for King Saud University in 2015 and 2016 KSU was granted 266 patents, bringing the number of patents granted to KSU to 526 patents, which are distributed in Saudi Patent Office, GCCPO, and USPTO, as well as Canada, China, Japan and EPO with the validation in Germany, France and Great Britain. 49,43% 50,57% Granted Patents in Total of Granted Patents Hence, the 2015 and 2016 represents the highest rate of granted patents to KSU of up to 50,57% of the total of granted patents. 29 KSU In the Top 50 Worldwide Universities Granted US Utility Patents KSU was ranked (49) in the top 100 worldwide universities granted US utility patents in 2015 with total (43) US utility patents, which already it was ranked (63) in 2014 with total (33) US utility patents. It was also that in 2013, KSU was ranked (74) with total (27) US utility patents. KSU will be among the top (40) worldwide universities granted patents with total (+60) US utility patents

30 Technology Licensing Composition Comprising Nanoparticles and a Method for the Preparation Thereof: This product is protected at the SPO, EPO and USPTO. It is distinguished among other products in the market because of its the low cost, safety, concentration, effectiveness and multi-purpose medical and industrial applications. KSU is at the final stage to sign a contract with a European company to license one of the IPs which is related to renewable energy technology. KSU will examine all of its IPs and then will support the eligible ones to enter the market using domestic and foreign assessment. KSU will try to accelerate the process of getting revenues from its IPs either by licensing them, selling them or transforming them to emerging companies which can form joint venture with domestic or foreign companies.
