2 IED: BAT and emerging techniques IED Art 19 Developments in best available techniques Member States shall ensure that the competent authority follows or is informed of developments in best available techniques and of the publication of any new or updated BAT conclusions and shall make that information available to the public concerned. IED Art 27 Emerging techniques 1. Member States shall, where appropriate, encourage the development and application of emerging techniques, in particular for those emerging techniques identified in BAT reference documents. 2. The Commission shall establish guidance to assist Member States in encouraging the development and application of emerging techniques as referred to in paragraph 1. 2
3 IED and exchange of information IED Article 13: BAT reference documents and exchange of information the exchange of information is to address, amongst others, the environmental performance of installations and techniques, the best available techniques and the emerging techniques. Experience shows that information exchange under IED: tends to focus on existing installations / techniques generates limited amount of information on cuttingedge techniques used in new installations and on emerging techniques 3
4 Objective of project Improve exchange of information on: Techniques which are already used in new installations or in existing and recently upgraded plants (in or outside the EU) which should be considered as candidates for BAT under the IED (cutting-edge techniques). Emerging techniques IED Art 3(14): a novel technique for an industrial activity that, if commercially developed, could provide either a higher general level of protection of the environment or at least the same level of protection of the environment and higher cost savings than existing best available techniques. 4
5 Commission activities Study (contracted to ICF International) Supporting information exchange on new facilities and the development and identification of emerging techniques in the context of IED. DG ENV arrangement with JRC IPTS EIPPCB Development of a mechanism allowing increased consideration of innovation in the process of drafting BREFs under IED. 5
6 Study 'Supporting IED information exchange on new facilities and the development and identification of emerging techniques' (1/2) Task 1: Identify cutting-edge techniques already applied in recently built facilities and emerging techniques, that could be applied to new or existing facilities, which could be referred to as emerging techniques in BREFs. Task 2: Propose methods aimed at enabling, encouraging and increasing the consideration of existing cutting-edge techniques and emerging techniques in the exchange of information under the IED. 6
7 Study 'Supporting IED information exchange on new facilities and the development and identification of emerging techniques' (2/2) Task 3: Identification of good practices in Member States regarding methods to encourage the development and application of emerging techniques. Task 4: Organise a half-day workshop to discuss the provisional results with relevant stakeholders. Task 5: Summarise the findings in a report including recommendations on further needs and ways to address these. 7
8 ENV/EIPPCB project: objectives and scope Develop a mechanism allowing for continuous identification and screening of information on cutting-edge techniques (used in newly built or recently upgraded installations) and on emerging techniques in the exchange of information under the IED, and ensure sufficient coverage of such techniques in BREFs. Explore options for establishing a 'Novel Techniques Observatory' (building on results of the point above). Explore options for establishing a network of experts for ad hoc participation in the BREF exchange of information process. Draft a report setting out a long-term vision for a permanent screening mechanism/observatory/network. 8
