3 UDT introduction & law basics ACT OF PARLIAMENT of the 21st December, 2000 ON THE TECHNICAL INSPECTION The technical inspection covers the activities as determined in the Act intended to ensure a safe functioning of the technical devices. The scope of activities of UDT includes inter alia: performance of technical inspection on the technical devices to the extent as provided in the Act; issuance of decisions in the matters resulting from the performance of technical inspection; verification of qualifications of manufacturers, repairers and modernizers as well as of those who operate and maintain technical devices and who carry out nondestructive examination; agreeing the training programmes for the persons operating and maintaining technical devices; analysing the causes and effects of accidents and damages to technical devices.

9 Procedure of verifying the qualifications The persons in charge shall be qualified (operators, maintenance personnel) In this case there are two possibilities: certificates of qualifications obtained in a Member State of EU, the Swiss Confederation and the member countries of the European Free Trade Agreement can be recognized by UDT; UDT is entitled to the recognition of qualifications for regulated following professions: - Lifts operator and lifting devices operator, - Lifts maintenance technician and lifting devices maintenance technician, - Powered industrial trucks operator and powered industrial trucks maintenance technician, - Person filling portable tanks. the operator/maintenance personnel can proceed to the qualification exam in front of the UDT s examination board
10 Procedure of verifying the qualifications QUALIFICATION REQUIREMENTS Candidates applying for verification the qualification should: be over 18 years old, according to the requested scope: - have knowledge and practice skills of maintenance or operations of the technical device; - have knowledge of the technical conditions of technical inspection, standards and regulations relating to scope of applying qualification. The applicant submits the application along with a confirmation of completion fees, directly to UDT s branch office or UDT in Warsaw. The fee is 20% of the lowest wage for work, announced by the Minister responsible for labour.
11 Procedure of verifying the qualifications QUALIFICATION EXAMINATION The qualification examination consists of two parts: oral examination with theoretical knowledge; practical examination, which involves checking the operating and maintenance skills of the technical device. The UDT s examining board selects and presents set of questions. The negative result of the theoretical examination ends the course - The practical examination can be conducted after the positive result of the theoretical examination. CRITERIA AND EXAMINATION RESULT The result of the qualification examination is considered positive if candidate has received a positive grade from the theoretical and the practical examination.

13 Technical conditions for technical inspection Required documentation on the basis of the provisions of the Ordinance of the Minister of Economy, Labour and Social Policy of 29 October 2003 on the technical conditions for technical inspection covering operation of certain transport (lifting) devices (Journal of Laws No. 193, item 1890) 1. 14 Technical conditions for technical inspection Obligations of the operator of the technical devices on the basis of the provisions of the Act of parliament of the 21st December, 2000 on the technical inspection Operator (entrepreneur) at whom the activities of technical inspection are performer is obligated to: Provide the presence of the entrepreneur or a person duly authorized by the entrepreneur, persons operating and maintaining the technical device Provide conditions for making it possible to efficiently perform the said activities Submit documents and to furnish information necessary for the correct performance of the said activities (on request of the inspector) Provide safe conditions of work by assuring safe access of the inspector to the technical device to be inspected, particularly by having discontinued building, installing, repair and other work in the immediate vicinity of the device, likely to imperil inspector s safety
15 Technical Procedureconditions of verifyingfor the technical qualifications inspection Scope of the technical examinations of the technical devices on the basis of the provisions of the Act of parliament of the 21st December, 2000 on the technical inspection Prior to issuing the decision releasing technical devices for service the competent body of technical inspection: Verifies the completeness and correctness of submitted documentation; Inspects the device by checking conformity with the documentation and technical conditions of technical inspection as well as its technical state, accessories and marking; Performs technical testing prior to start-up and under operating conditions to the extent defined in the technical conditions for technical inspection for the particular types of device; Verifies the qualification certificates of the operators and the maintenance personel of technical devices.
