1 The 2018 Kwik Fill Driving America Sweepstakes OFFICIAL RULES and REGULATIONS The 2018 Kwik Fill Driving America Sweepstakes, (the "Game"), is offered by United Refining Company of Pa., DBA Kwik Fill / Red Apple Food Mart, who will hereinafter will be referred to as the "Game Sponsor". NO PURCHASE NECESSARY TO PLAY. For details, see Rule 4 How to Obtain an Official Game Card, on page 2. Making a purchase will not improve chances of winning. GENERAL GAME INFORMATION: The Game is being offered through participating Kwik Fill / Red Apple Food Mart Stores in New York, Pennsylvania and Ohio to eligible individuals, (see Rule 1 Who Can Play, below), during the Game Period, see Rule 2 Game Dates, below. Void elsewhere and where prohibited. The Game features an Enter-to-Win sweepstakes with additional Instant-Win opportunities. See Rule 5A & 5B Available Prizes and Odds of Winning for list of instant prizes, on page 2. Entry in the sweepstakes is completed through Online Entry (two types) and/or Mail-In Entry. See Rule 3 How to Play, below. Online Entry at kwikfill.com requires an official 2018 Kwik Fill Driving America Sweepstakes Game Card (Game Code) obtained through authorized, legitimate channels. See Rule 4 How to Obtain an Official Game Card, on page 2. Ten Grand Prize Finalists will be randomly drawn from all available entries at the end of the Game, see Rule 2 Game Dates, below. Grand Prize Finalists will win a VIP Weekend Getaway for two where they will participate in a random drawing to determine which one of the ten grand prizes they will win. See Rule 5D Grand Prizes for list of prizes, on page 2 and Rule 7 Prize Drawings on page 3. 1) WHO CAN PLAY (Eligibility): The Game is open to all legal residents of the New York, Pennsylvania, and Ohio who are 18 years of age or older as of Game Start Date. Employees of Game Sponsor, its parent company, affiliates, subsidiaries, distributors, sales representatives, advertising and promotion agencies, agents, or any entity the Game Sponsor contracts with, specific to this Game, and members of the immediate families (defined, for these purposes as including spouse, parents, children, siblings, and each of their respective spouses) and/or households (whether related or not) of any of the above, are NOT eligible to play or win prizes in this Game. The Game is subject to all applicable federal, state, and local laws and regulations and is void where prohibited. Participation constitutes Entrant's full and unconditional agreement to these Official Rules and Game Sponsor's decisions, which are final and binding in all matters related to the Game. Winning any prize is contingent upon fulfilling all requirements set forth herein. 2) GAME DATES: The Game begins at the start of business on June 1, 2018, (the "Game Start Date"), and is scheduled to end in-store at 11:59 p.m. on August 31, 2018 E.S.T. (the "Scheduled Game End Date") or whenever Game Card supplies are exhausted, whichever comes first. The period between the Game Start Date and the Scheduled Game End Date is known as the "Game Period". Online Entries must be submitted by 11:59 p.m., September 3, 2018 E.S.T. The Grand Prize Finalists will be randomly drawn from all available entries and notified on September 4, See Rule 7 Prize Drawings, on page 4. 3) HOW TO PLAY: There are three ways to enter the Game: 1. Online Entry with a Game Card (Game Code): During the Game Period, eligible Entrants can enter online at using a Game Code obtained from an Official Kwik Fill Driving America Sweepstakes Game Card. Rule 4 explains how to obtain an Official Game Card, see page 2. The Game Card has two sections with two scratch areas: a. First Chance Instant Winner Section and Scratch Area The top First Chance Instant Winner scratch area will reveal: 1) Instant Winner Prize to be redeemed in the Store, or 2) Instant Winner Prize to be redeemed by mail, or 3) Not a 1st Chance Instant Winner. Enter Game Code at kwikfill.com for a 2nd Chance to win an instant prize! See Rule 5 for list of available Instant Winner Prizes on page 2. See Rule 6 for redemption instructions on page 3. b. Grand Prize Entry Code and Second Chance Instant Winner Section and Scratch Area The bottom scratch area contains a Game Code allowing one entry in the sweepstakes and offering the Entrant a second chance to win an instant prize. Entrants will be notified at the completion of the entry process if an entry is a Second Chance Instant Winner. A Second Chance Winner will select preferred method of receiving certain prizes, see Rule 5C for Second Chance Prizes on page 2. Next to the Game Code box is an Employee Code box used to track and reward Kwik Fill employees. Use the Game Code and the Employee Code (if supplied) to complete one sweepstakes entry at kwikfill.com. NOTE: Not every Game Card will contain an Employee Code; your entry can still be completed even if the employee code box is empty. Multiple Game Codes can be entered at the same time. Registered Kwik Rewards Club VIP members will have all of their Online Game Code entries doubled, see 3-c Bonus Entries, below. Basic personal information including name, address, , and phone will be collected. See Rule 13, Use of Data, on page 4. Use of any automated system to participate is prohibited and will result in disqualification. c. Bonus Entries (Kwik Rewards Club VIP) Kwik Rewards Club VIP members have all of their Game Code entries doubled. To become a Kwik Rewards Club VIP member, customers must register their Kwik Rewards Club Card number at kwikfill.com by creating a personal Kwik Fill Website Account. For each Game Code the registered VIP Entrant submits Online, they will receive an automatically recorded bonus entry. Basic personal information including name, address, , and phone will be collected. See Rule 13, Use of Data, on page 4. After submitting Game Codes Online, all registered Entrants can check their account dashboard to see how many entries they have accumulated. 1

Online Entry without a Game Card (requires Facebook account): During the Game Period, eligible Entrants who follow our Facebook page can register for the sweepstakes once daily by following a Special Facebook Entry Link posted at facebook.com/kwikfill and then completing an entry form. The published link ( directs Facebook followers to a dedicated entry form. This entry method does not require a Game Card. No purchase is necessary. Basic personal information including name, address, , and phone will be collected. Entrants may choose to create a Website Account to speed up subsequent entries. See 13 Use of Data, Online Privacy Policy on page 4. Entries accumulate throughout the game period. This Game is in no way sponsored, endorsed or administered by, or associated with Facebook. Any questions, comments or complaints regarding the promotion will be directed to Game Sponsor, not Facebook. 3. Mail-In Entry (No Purchase Necessary): Eligible Entrants without access to the Internet or an address, or those who wish to enter without making a purchase, can enter by mail. Entrants are required to include their Name, Address, City, State, Zip, and Phone along with a self-addressed, stamped envelope, in an envelope addressed to: 2018 Kwik Fill D.A.S., P.O. Box 808, Warren, PA Each mail-in entry will be manually entered into the sweepstakes, and the self-addressed, stamped envelope will be used to send an official Game Card to allow the opportunity to win Instant Prizes. Note: All entry requests received not containing a self-addressed stamped envelope, and/or do not provide all required personal information will not be eligible for entry into the Sweepstakes. Only one entry per outer mailing envelope. Mail-in Entries must be received by August 24, ) HOW TO OBTAIN AN OFFICIAL GAME CARD A. Obtain a Game Card or Cards from any authorized store personnel when making a qualifying purchase at participating Kwik Fill stores. First Chance Instant Prize In-store Redemptions: If the First Chance Instant Winner scratch area of the Game Card indicates a First Chance Instant Winner prize listed in Rule 5A, on page 2, the prize must be redeemed at any participating Kwik Fill location. Of the four prizes in this category, three (3) are products and one (1) is discount coupon. These Instant Winner prizes may be redeemed alone, without any obligation to purchase additional products. Prizes cannot be substituted or redeemed for cash, in part or in whole, except by Game Sponsor who may substitute a prize of equal or greater value should an advertised prize become unavailable. To redeem one of these prizes, present and surrender the top portion of the original Game Card to a cashier/attendant at a participating Kwik Fill location. Coffee prizes can only be redeemed at Kwik Fill locations that sell coffee. It is the sole responsibility of Entrant to redeem First Chance Instant Winner Game Cards at participating Kwik Fill stores. See coupon restrictions in Rule 6C, below. B. First Chance Instant Prize Mail-in Redemptions: If the First Chance Instant Winner scratch area of the game the card indicates a First Chance Instant Winner prize listed in Rule 5B, on page 2, the prize must be redeemed by mail. Make a photocopy of the Game Card for your records. Send the original top portion of the Game Card along with full contact information including; full name, physical address (no P.O. Boxes), and telephone number to: 2018 Kwik Fill D.A.S. Redemption, P.O. Box 808, Warren, PA Requests must be postmarked no later than August 24, Upon Game Card and eligibility verification, the prize will be shipped to the address provided. Allow approximately two (2) to four (4) weeks for delivery of prizes following verification. First Chance Instant Winner prizes listed in Rule 5B, on page 2, cannot be redeemed at a Kwik Fill location. C. 50-Cents-Off Coupon Redemption Restrictions: A maximum of four (4) 50-Cent-Off Coupons can be redeemed per purchase transaction (for a maximum $2.00 discount). 50-Cents Off Coupons cannot be used or applied towards the purchase of the following items; 1.) Lottery tickets 2.) Alcoholic beverages 3.) Cigarettes or tobacco products First Chance Instant Winner prizes must be redeemed by midnight E.S.T. or the close of business (whichever occurs first) on September 30, Coupons cannot be redeemed for cash and have no cash value. D. Second Chance Instant Prize Redemption Instructions. At the completion of an Online entry with a Game Code at kwikfill.com, Entrants will be informed if they are a Second Chance Instant Winner. See Rule 5C, on page 2, for list of Second Chance Prizes. Every 100th entry will win a $5-off coupon. Every 1,000th entry will win a coupon for a free $10 Kwik Fill Gift Card. Every 10,000th entry will win a $50 Kwik Fill Gift Card. Every 100,000th entry will win a $250 Kwik Fill Gift Card. For the $5 off coupon and $10 gift card prizes, Entrants will be asked how they would prefer to receive those prizes: 1) Electronic Delivery of a redemption coupon to a Smartphone or 2) USPS Delivery of a paper coupon. The $50 and $250 Kwik Fill Gift Card Second Chance Instant Prizes will be shipped UPS with a signature required at time of delivery to ensure delivery. 3

4 7) PRIZE DRAWINGS: On September 4, 2018, ten (10) grand prize finalists will be randomly selected from all available Online, Mail-In, and Event Entries. Grand Prize finalists will be notified by phone or . If a potential grand prize finalist cannot be contacted or fails to respond, another finalist will be drawn until ten finalists are verified. Each Grand Prize Finalist wins a VIP Resort Weekend Getaway for two featuring deluxe hotel accommodations, meals, two $100 resort gift cards, one $100 Kwik Fill Gas Card for travel expenses, and one of the ten grand prizes listed in Rule 5D on page 2. Grand prizes will be awarded to grand prize finalists in a random drawing on September 22, 2018 during the VIP Resort Weekend Getaway at Holiday Valley, Ellicottville, N.Y. Grand Prize Finalists MUST be present at the VIP Resort Weekend Getaway to participate in the final grand prize drawing. If a finalist is unable to attend, the finalist forfeits the resort weekend prize and the ability to participate in the final grand prize drawing. The finalist will instead receive a $250 Kwik Fill Gift Card consolation prize and another finalist will be drawn. Except where prohibited, grand prize winners will be required to sign an Affidavit of Eligibility and Liability in Publicity Release ("Affidavit") in order to claim the prize. In the event that the potential grand prize finalist is disqualified, Administrator will draw another finalist from all available sweepstakes entries until all prizes are awarded. Finalist status and the VIP Weekend Getaway are not transferrable. 8) GENERAL TERMS AND CONDITIONS: Participation in the Game constitutes the Entrant's ("you" or "your") full and unconditional agreement to and acceptance of these Official Rules including the decisions of Game Sponsor and its designees, which are final with respect to all matters relating to the Game. This Game is void outside Pennsylvania, New York, and Ohio and where prohibited by law, and is subject to all applicable federal, state, and local laws and regulations. All income taxes, fees and all other expenses on prizes are the sole responsibility of the prizewinners. 9) RELEASE AND LIMITATIONS OF LIABILITY: By participating in the Game, Entrants agree to release and hold harmless the Sponsor, the Administrator, their respective parents, subsidiaries, affiliates, distributors, sales representatives, advertising and promotional agencies (collectively, the Released Parties ) from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of any prize, including, but not limited to: (a) any technical errors that may prevent an Entrant from submitting an entry; (b) unauthorized human intervention in the Sweepstakes; (c) printing errors; (d) errors in the administration of the Sweepstakes or the processing of entries; or (e) injury, death, or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant s participation in the Sweepstakes or receipt of any prize. Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Released Parties are not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer online systems, servers, or providers, computer equipment, software, failure of any or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to Entrant's or any other person's computer relating to or resulting from participation in this Sweepstakes or downloading any materials in this Sweepstakes. Entrant further agrees that in any cause of action, the Released Parties liability will be limited to the cost of entering and participating in the Sweepstakes, and in no event shall the Released Parties be liable for attorney s fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. 10) WINNER OBLIGATIONS: Receiving the prize is contingent upon compliance with these Official Rules. Winners of prizes valued over $600 will be required to furnish appropriate proof of ID and W-9 forms in accordance with any and all applicable Federal and State tax laws. A 1099 Form will be issued showing any applicable winnings. If you are 18 years of age but considered a minor in the state in which you reside, your parent or legal guardian must also sign the required documents. If you fail to return the documents within the stated period, or if you are deemed ineligible for any reason, you will be disqualified and the prize to which your claim related will be forfeited. Prizes consist only of the items described herein. All other costs, fees and taxes associated with or accruing from the winners receipt of the prizes will be the responsibility of the winners. All properly claimed prizes will be awarded. By accepting a prize, each winner in this Game agrees to release the Game Sponsor, its parent company, affiliates, subsidiaries, advertising, promotional and fulfillment agencies, legal advisors and the directors, officers, shareholders, employees and agents of each of the foregoing, from and against any and all liability arising from or in connection with participation in the Game or the acceptance, possession or use/misuse of any prize, or participation in any prize related activities, including but not limited to travel related thereto. If any prize or prize notification from Game Sponsor is returned as undeliverable, the potential winner will be disqualified and will be deemed to have forfeited the prize in question. 11) PUBLICITY: Acceptance of a prize constitutes permission for Game Sponsor to use any winner s name, likeness, voice, and/or comments for advertising, trade or promotional purposes worldwide in commerce and in any media without limitation or additional compensation unless prohibited by law. As a condition of receiving the prize, the winner may be required to sign a written permission form effecting said permission for the aforementioned purposes. The names of major prize winners will be posted at and will also be available by mail request following verification of all prize winners, as noted in Rule 12 Restrictions, below. 12) RESTRICTIONS: The following are prohibited and will result in automatic disqualification from the Game: 1) using any method that artificially increases odds of winning; 2) non-compliance with these Official Rules; and 3) any other act which the Game Sponsor determines in its sole discretion, jeopardizes the integrity or proper conduct of the Game. Game Sponsor further reserves the right, at its sole discretion, to prosecute any individual who tampers with or attempts to tamper with the entry process. CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY CORRUPT THE GAME OR TO UNDERMINE THE LEGITIMATE OPERATION OF THE GAME MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY, PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. 13) USE OF DATA: All information submitted by Entrants will be treated according to Sponsor s privacy policy, available at By participating in the Sweepstakes and providing your address or any other applicable contact information, Entrants hereby agree to Sponsor s collection and usage of their personal information for the purpose of this Game and acknowledge that they have read and accepted Sponsor s Privacy Policy. With the exception of a winning notification, Entrants will not receive Kwik Fill correspondence unless requested. Opt-In opportunities will be clearly marked and are completely optional. 14) DISPUTES: By entering the Sweepstakes, Entrants agree that 1) Any and all disputes, claims, and causes of action arising out of or connected with the Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action; 2) Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes but in no event attorneys' fees; and 3) Under no circumstances will any Entrant be permitted to obtain any award for, and Entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these 4

5 Official Rules, or the rights and obligations of the Entrants and Sponsor or the Released Parties in connection with the Sweepstakes, shall be governed by, and construed in accordance with United States law the law of Pennsylvania. Any legal proceedings arising out of this Sweepstakes or relating to these Official Rules shall be instituted only in the federal or state courts of serving Pennsylvania, and Entrants and the parties consent to jurisdiction therein with respect to any legal proceedings or disputes of whatever nature arising under or relating to these Official Rules. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. 15) LIST OF WINNERS: After winner confirmation is complete, the names of the major prize winners will be available at or by sending a self-addressed, stamped envelope by October 1, 2018 to: 2018 Kwik Fill Driving America Sweepstakes, P.O.
