1 The purpose of these Rules is to ensure all participants have equal chance to enter the Prize Game and win prizes after meeting the requirements set forth in these Rules. MPG d.o.o. (with their registered office at Nova Ves 17, Zagreb, Croatian tax number (OIB): ) hereinafter referred to as the Administrator and Personal Data Processor will conduct the Prize Game and process personal data on behalf of the Organizer. In keeping with the Act on Organisation of Games of Chance and Prize Games (OG 87/09, 35/13, 158/13, 41/14 and 143/14) and Ordinance on the Organization of Games of Chance (OG 08/10) the Organizer Zagrebačka banka d.d., Zagreb, Trg bana J. Jelačića 10, Croatian tax number (OIB): , (hereinafter: the Bank/Organizer) is the Data Controller in accordance with the General Data Protection Regulation, Regulation (EU) 2016/679, and hereby establishes the following RULES OF THE PRIZE GAME Sa Zaba karticama dobivam više! Article 1 Participants and the Prize Game The Bank will organize a prize game called Sa Zaba karticama dobivam više! (hereinafter referred to as: the Prize Game). Natural persons who are clients of Zagrebačka banka are eligible to participate in the Prize Game after using any of the following payment cards: - Individual Mastercard card (Standard, Gold, Platinum and Student Mastercard card) and go!card Mastercard credit card - Maestro debit card issued with the Bank s current account (hereinafter referred to as: the Participants). Only individual cards issued to natural persons used for payment are eligible. The Prize Game is open to all primary and additional cardholders and authorised users added to the account (hereinafter referred to as: the Participants). The persons directly involved in the Prize Game organization, prize draws and other persons with access to Prize Game data may not participate in the Prize Game. Article 2 Purpose of the Prize Game The purpose of the Prize Game is to promote the use of the Bank s Mastercard and Maestro cards listed in Article 1 of these Rules and to reward their users. Article 3 Duration of the Prize Game The Prize Game is called Sa Zaba karticama dobivam više! and will last from 3 December, 2018 at 00:00 (midnight) until 31 December, 2018 at 23:59 h. 1

2 Article 4 Conditions of participation in the Prize Game The right to participate in the Prize Game and the right to win a prize have the Participants identified in Article 1 of these Rules, who have become of full age not later than on the last day of the Prize Game, who are holders of a valid Mastercard and/or Maestro card from Article 1 herein issued by the Bank on the prize draw date, who are not in unauthorized overdraft on any of their Bank accounts and have not been blocked due to enforcement or on any other legal grounds and have no due outstanding debts toward the Bank. The right to participate in the Prize Game and the right to win a prize is exercised by the Participant who makes at least one purchase at any point of sale in the Republic of Croatia or abroad or via the Internet while the Prize Game is conducted and pays with any of the cards listed in Article 1 of these Rules and applies to participate on Every purchase transaction at a point of sale constitutes one inclusion in the Prize Game. Every following transaction of the Participant using a Mastercard and/or Maestro card from Article 1 of these Rules during the Prize Game will be automatically recorded as the next inclusion in the Prize Game. Therefore, if the Participant completes three transactions during the Prize Game with a minimum value of HRK 0.01 using a Mastercard and/or Maestro card and consents to the Rules of the Prize Game at three inclusions will be recorded automatically and entered in the draw. In establishing whether the Participant is allowed to participate, only purchase transactions eligible according to the date the transaction was recorded in the Bank s database and which are processed in the card system prior to the preparation of the draw data shall be taken into account. If the cardholder of the Mastercard/Maestro cards has several Mastercard/Maestro cards specified in Article 1 of these Rules and has applied to participate in the Prize Game via once, for the prize draw all valid participant s transactions equal to or exceeding HRK 0.01 by all Mastercard and/or Maestro cards of primary and additional cardholders and authorised users added to the account shall be automatically recorded. In order to apply to participate in the Prize Game, cardholders of Mastercard and/or Maestro cards from Article 1 of these Rules by applying at accept the rules of participation in the Prize Game. The following data are required to apply: name and surname, date of birth, street and house number, personal identification number (Croatian tax number - OIB), , town, mobile or landline number and consent to participate in the Prize Game. The right to participate in the Prize Game is not acquired by cash withdrawal at ATMs, in banks, Croatian Post s offices or Financial Agency s offices, or by payment of registration fees, membership fees, accrued interest, payment notices or other fees charged by the Bank for the use of the Bank s Mastercard card and/or Maestro cards from Article 1. Transactions of consumer and cash loans and Maestro card issued with the domestic current account for protected income are not included in the Prize Game. 2

3 Article 5 Prize pool and prize draws The following applies to the Sa Zaba karticama dobivam više! Prize Game: The total prize pool is: HRK 800, The Prize Game includes four weekly prize draws in a way that each week 11 prizes of the following value will be drawn: 1 x HRK 100, on go! card Mastercard card 10 x HRK 10, on go! card Mastercard card as follows: 1st week - from 3 December, 2018 until 9 December, 2018 HRK 200, will be drawn as 11 prizes (1 x HRK 100, on go! card Mastercard card and 10 x HRK 10, on go! card Mastercard card) 2nd week - from 10 December, 2018 until 16 December, 2018 HRK 200, will be drawn as 11 prizes (1 x HRK 100, on go! card Mastercard card and 10 x HRK 10, on go! card Mastercard card) 3rd week from 17 December, 2018 until 23 December, 2018 HRK 200, will be drawn as 11 prizes (1 x HRK 100, on go! card Mastercard card and 10 x HRK 10, on go! card Mastercard card) 4th from 24 December, 2018 until 31 December, 2018 HRK 200, will be drawn as 11 prizes (1 x HRK 100, on go! card Mastercard card and 10 x HRK 10, on go! card Mastercard card). The total weekly prize pool is: HRK 200, Prize game applications for prize draws last from: 1st round from 3 December, 2018 at 00:00 (midnight) to 9 December, 2018 at 23:59 h, 2nd round from 10 December, 2018 at 00:00 (midnight) to 16 December, 2018 at 23:59 h, 3rd round from 17 December, 2018 at 00:00 (midnight) to 23 December, 2018 at 23:59 h, 4th round from 24 December, 2018 at 00:00 (midnight) to 31 December, 2018 at 23:59 h, Article 6 Conditions of participation in the Prize Game The right to participate in the Prize Game is exercised by the Participants who make a purchase and pay using a Mastercard and/or Maestro card from Article 1, complete the Organizer s online application form with personal data ( and accept these Rules as provided in Article 4, paragraph 3, consenting to the publication of personal data in accordance with Article 7 of these Rules and accepting the rights and obligations from these Rules. Article 7 Participant s/winner s consent Participants/Winners by participating in the Prize Game consent to the publication of their personal data (name, surname, town, and photograph) without any compensation, for the purpose of public announcement of Prize Game results, the awards ceremony, publication of media reports and similar materials connected with the Prize Game. 3

4 Article 8 Prize draw procedure The weekly draws will take place at the Administrator s registered office (MPG d.o.o., Nova Ves 17, Zagreb) and shall be carried out based on the random selection of winners by a computer system under the control of a notary public and a three-member committee for each round, according to the following schedule: 1st round 11 December, 2018 at 12:00 noon, 2nd round 18 December, 2018 at 12:00 noon, 3rd round - 28 December, 2018 at 12:00 noon, 4th round 4 January, 2019 at 13:00 h Minutes of the prize draw with winners data and the prize draw procedure will be composed and completed after the draw. The Minutes will be official and binding on all Prize Game Participants and submitted to the Ministry of Finance within 8 days from the end of the Prize Game. Every Participant in the Prize Game may win only one prize from the prize pool. The winner of any prize draw round (HRK 100, or HRK 10,000.00) is not eligible to participate in subsequent prize draw rounds. Prizes will be drawn starting from the last prize toward the 1st (first) prize. If the number of Participants taking part in the Prize Game is lower than required for the prize pool to be spent, the draw will be carried out in a way that the winner of the first prize will be drawn first and then draws of the other winners will take place. The names of weekly prize winners will be published after each round draw dates on the Bank s website and on Winners will be announced within 8 days from the completion of each prize draw round. Article 9 Announcement of winners, prize collection and deadline The Bank guarantees that all prizes in the prize pool will be awarded to winners of prize draws. Prize winners may not ask for a substitute prize to replace the prize they have won. The winners in the Prize Game who have met the requirements established in these Rules will be notified of their wins in writing within 8 days from the prize draw and also via sent by the Bank (Marketing@unicreditgroup.zaba.hr). The winners will collect their prizes within 30 days from receiving a written notification on the results of the prize draw. Prizes will be collected at the Bank s branch offices. If the winners do not claim their prizes in the stated period within 8 days from expiry of the collection deadline the Bank will notify the winners in writing inviting them to collect their prizes in the subsequent period of 8 days starting from the receipt of the second notification. If the prize is not collected on the expiry of 8 days from the receipt of the second notification, the winner will lose the right to collect the prize and the Bank will have no further obligations toward that winner. In such cases the Bank will make a list of uncollected prizes and deliver the list to the Ministry of Finance and the value of the pool of uncollected prizes will be paid to the State Budget within 90 days from the expiry of the prize collection deadline. When collecting their prizes the winners will be given further instructions on how to claim their prizes and will, in person or through authorized attorney, sign a Prize Collection Certificate and Waiver releasing the Bank as the Organizer from any further liability toward the winners. 4

5 Article 10 Cancellation, cessation and suspension of the Prize Game With the Ministry of Finance s approval the Bank may cancel, discontinue or suspend the Prize Game if circumstances occur during the Prize Game that the Bank neither could have predicted, nor control in any way whatsoever due to a case of force majeure at the time of deciding to conduct the Prize Game and which circumstances have or could have a negative effect on the Bank s operations. In cases of circumstances constituting force majeure, the Bank will notify the Participants of cancellation, cessation or suspension of the Prize Game in the same way as they have been notified about these Rules. Article 11 Data processing By applying to participate in the Prize Game, the Participants agree that the Bank, as a Personal Data Controller, may process the data for the purpose of conducting the Prize Game. The Bank will process the data according to the personal data protection laws. The Data Controller and Data Processor shall keep the personal data of the Prize Game participants for the next 120 days as of the date of the Prize Game end, after which the data shall be destroyed, except the personal data of the Prize Game winners which will be kept for 11 years under the provisions of the Accounting Act. Provision of data for this Prize Game is voluntary. If a participant believes that the database processing is contrary to the protection of his or her privacy or contrary to the law, the participant may lodge a complaint with the supervisory authority in charge of data protection and contact the Organiser requesting clarification. Every participant has the right to request access to his or her personal data from the Data Controller as well as their correction or erasure or restrict the processing or object to their processing and portability. The Personal Data Controller shall not reveal or disclose the data to the third parties, except to the Data Processor and only for the purpose of organising the Prize Game and to the Ministry of Finance under Article 16 of the Ordinance on the Organization of Games of Chance. Article 12 Resolution of disputes The Participants will familiarise themselves with the Rules of the Prize Game published on the web pages specified in Article 4 of this agreement. The Participants automatically accept all rights and obligations provided in these Rules by applying to participate in the Prize Game. In case of a dispute between the parties, the matter will be resolved by a Zagreb court having subject-matter jurisdiction. Article 13 Prize Game tax On behalf of the Bank the Administrator of the Prize Game will pay 5% (in words: five percent) of the total prize pool to the Red Cross immediately and prior to the issue of the Prize Game approval. 5

6 Article 14 Other provisions These Rules will apply after approval of the Ministry of Finance of the Republic of Croatia and after being publishes they will remain in effect until the completion of the Prize Game. These Rules of the Prize Game will be published on and at least one day prior to the beginning of the Prize Game, with the date of issue and number of the approval obtained from the Ministry of Finance.
