6 Original Page 5 I. APPLICATION OF RATE SCHEDULE A. This Rate Schedule applies to channels between the overseas terminal central office in Honolulu, Hawaii and the overseas, terminal central offices in other destinations as specified herein, subject to the jurisdiction of the Federal Communications Commission. This Rate Schedule contains the schedules of rates and specific conditions and regulations applicable to the provision of Private Line Telephone Service of Verizon Hawaii International Inc., hereinafter referred to as the Carrier, or furnished jointly by the Carrier and concurring carriers. The private line user may engage in resale of the international private line for the provision of a switched, basic telecommunications service upon authorization from the Commission under Section 214 of the Communications Act of 1934, as amended, and provided that the private line is used only (1) on a route where the resale carrier exchanges switched traffic with a foreign carrier that the Commission has determined lacks market power, or (2) on any route for which the Commission has authorized the provision of switched services over international private lines. B. Channels Within the State of Hawaii Rate Schedule provisions applicable for connection between the overseas terminal central office in Honolulu, Hawaii, and points in the State of Hawaii are those established Verizon Telephone Companies Tariff F.C.C. No. 14. FULL PERIOD SERVICE A. Regulations The following regulations apply to Private Line Telephone Service and Channels: 1. Scope of Service (a) (b) Full period Private Line Telephone Service is that of providing the requisite facilities, including channels and station equipment, to enable Customer and authorized or joint users to communicate between specified locations. Full period Private Line Telephone Service channels may terminate in private branch exchange switchboards, in telephone instruments or in channel derivation equipment as Customer desires.

Scope of Service (Continued) (c) Full period Private Line Telephone Service channels may be used as channels for the following purposes as provided for within this Rate Schedule: data transmission, telephotograph transmission and teletypewriter transmission. 2. Limitations (a) (b) (c) The use and restoration of service shall be in accordance with Part 64, Subpart D of the Federal Communications Commission's Rules and Regulations, which specifies the priority system for such activities. Private Line Telephone Service and Channels may be limited in order to comply with orders issued under wartime authority of the President of the United States. It my also be limited in the case of those private line services to, from or through a foreign country, by orders of the government of such country or by the United States Government. The furnishing of service under this Rate Schedule will require certain physical arrangements of the channels and equipment of Carrier and is therefore subject to the availability of such channels and equipment. 3. Minimum and Fractional Rates and Charges (a) (b) The minimum period for which service is furnished is one month except when temporary service is furnished or when the cost of special equipment or special construction is such as to necessitate a longer contract period. When service is furnished on a monthly basis, charges for a fractional part of a month which follows and is consecutive with a full month will be a proportionate part of the monthly charge using the same ratio that the actual number of days service is furnished bears to 30 days.

Minimum and Fractional Rates and Charges (Continued) (c) The determination of the actual number of days service is furnished will take into account the following provisions: (1) When a new service is started, or when a new station is added to an existing service, or when additional equipment is provided at an existing station, billing begins on the day after service commences. (2) When a service, a station, or equipment is changed or rearranged, the revised billing will take effect on the same day the change or rearrangement is actually put into effect. (3) When a service, a station, or equipment is discontinued, the last day that any service is furnished will be counted as a day of service for billing purposes. (d) (e) (f) In determining the minimum service period, the day billing commences is considered to be the first day of the minimum service period. The provisions of c.(l) and (2) preceding do not apply to temporary service. Billing for this offering is on the basis of the time service is actually available to Customer. When rates involve a fraction of a cent, the fraction is carried throughout the computation of the charges. When the computed charge includes a fraction of a cent, fractions of one-half cent or more are treated as one cent and fractions of less than one-half cent are disregarded.

Daily Periods of Time for Which Service Is Furnished Service will be furnished for 24-hours per day, seven days per week. 5. Allowance for Interruptions When service furnished by Carrier is interrupted due to causes other than the negligence of Customer or to failure of facilities furnished by Customer, a credit allowance will be made as set forth in a. through d. following: (a) For the transpacific channel portion of the service interruption, allowance will be made as follows: Interruptions of 24 hours or less: Length of Interruption Credit Less than 30 minutes None 30 minutes up to but not including 3 hours 1/10 day 3 hours up to but not including 6 hours 1/5 day 6 hours up to but not including 9 hours 2/5 day 9 hours up to but not including 12 hours 3/5 day 12 hours up to but not including 15 hours 4/5 day 15 hours up to 24 hours inclusive One day Two or more interruptions of 30 minutes or over during any period of 3 hours shall be considered as one interruption. Interruptions over 24 hours Credit will be allowed in 1/5 day multiples for each 3-hour period or fraction thereof of interruption. No more than one full day's credit will be allowed for any period of 24 hours.

Allowance for Interruptions (Continued) (b) (c) (d) When service furnished by Carrier is connected with overseas facilities of other carriers and interruptions to service are caused by a failure of the overseas facilities, credit will be allowed on the service furnished by Carrier in accordance with a. preceding for those interruptions for which Customer is entitled to an interruption allowance on the overseas facilities in accordance with the Rate Schedule of Carrier providing the overseas facilities. For the purpose of determining the amount of allowance every month is considered to have 30 days. International Message Toll Telephone Service furnished at Customer s request, when the Private Line Telephone Service is interrupted, is charged for at the message toll telephone rates contained in the Verizon Long Distance International RTC No Use of Private Line Telephone Service for Certain Purposes Customer-provided equipment for the transmission and reception of pictures and similar material, for remote operation of mobile radio-telephone systems and for data transmission may be used in connecting with Private Line Telephone Service under the following conditions: (a) (b) When the service is used for transmission and reception which requires terminal equipment (data sets), such terminal equipment may be provided by Customer or Carrier at the option of Customer. On a given private line all such terminal equipment at all premises must be provided either by Customer or Carrier. No direct physical connection of Customer's transmitting or receiving equipment shall be made to the facilities furnished by Carrier except where protective connection equipment is provided by Carrier for this purpose. Private Line Telephone Service furnished by Carrier is not represented as adapted to the telephotographic or facsimile transmission of pictures and similar material. The use of such service by Customer for such purpose is permitted only on the condition that Carrier's liability shall be limited as set forth in A.8. following.

Liability of the Carrier (a) In view of the fact that Customer has exclusive control of his communications over the facilities furnished him by Carrier, and of the other uses for which facilities may be furnished him by Carrier, and because of unavoidableness of errors incident to the services and to the use of such facilities of Carrier, the services and facilities furnished by Carrier are subject to the terms, conditions and limitations herein specified and to such particular terms, conditions and limitations as set out in other Rate Schedules applicable to particular services and facilities. (b) The liability of Carrier for damages arising out of mistakes, omissions, interruptions, delays, or errors or defects in transmission occurring in the course of furnishing service, channels, or other facilities and not caused by the negligence of Customer, or of Carrier, in failing to maintain proper standards of maintenance and operation and to exercise reasonable supervision, shall in no event exceed an amount equivalent to the proportionate charge to Customer for the period of service during which such mistake, omission, interruption, delay, or error or defect in transmission occurs. (c) Customer indemnifies and saves Carrier harmless against claims for libel, slander, or infringement of copyright arising from the improper use of material transmitted over its facilities and recorded; against claims for infringement of patents arising from combining with, or using in connection with, facilities of Carrier apparatus and systems of Customer; and against all other claims arising out of any act or omission of Customer in connection with facilities provided by Carrier. (d) When the lines of other telephone carriers are used in establishing connections to points not reached, by Carrier's lines, Carrier is not liable for any act or omission of the other carrier or carriers.

Channel Derivation (a) Additional channels may not be created from a channel furnished for International Private Line Telephone Service by Carrier except as provided for in (1) through (2) following: (1) Where a private line involves an overseas point and the overseas channel is furnished by Carrier, defense agencies of the United States Government, by the use of Carrier-provided or Customer-provided equipment, may create additional channels for alternate or simultaneous voice and non-voice communications on telephone channels from a service point in the State of Hawaii on the one hand and to Tokyo, Japan; Seoul, Korea; Manila or Clark Air Force Base, Philippines; and Bangkok, Thailand on the other hand. (2) Where a private line involves an overseas point and the overseas channel is furnished by an overseas carrier other than Carrier, Customers by the use of Customer-provided equipment and to the extent permitted by the normal characteristics of the grade of channel ordered, may create additional channels for any type of communication including different types of communication simultaneously, by subdividing a voice channel furnished for voice and/or data transmission. Use of Customer-provided equipment is limited to two-point services furnished between points in the State of Hawaii and the point of connection with overseas facilities of other carriers. (3) Carrier-provided channel derivation equipment may be installed on the premises of Customer or on the premises of Carrier. Installation on the premises of Carrier is at the option of Carrier. (4) Channels created by Customer in accordance with the provisions of (1) through (3) preceding, may be connected at Customer's premises, to local channels furnished by Carrier. If the overseas channel is furnished by an overseas carrier other than Carrier, such Customer-created channels may also be connected to local channels furnished to Customer by Carrier at the terminal office of the overseas carrier if Customer so elects.

Termination Liability Where a termination charge is applicable to a given service, the charge shown is the maximum charge. If a service which has a termination charge is discontinued by a customer within the specified time period after service is initiated, a termination charge applies. The amount of Customer liability is determined by dividing the maximum termination charge by the number of months in the specified period and deducting the resulting amount, multiplied by the number of months and fraction of a month that the service has been in use, from the maximum termination charge. For the purpose of the computation, each month will be considered to have 30 days. In applying termination charges to a partial disconnection, the last item installed will be considered the first to be removed.

14 Original Page 13 FULL PERIOD SERVICE(Continued) A. Regulations (Continued) 10. Classifications of Channels Private Line Telephone Service channels are classified as follows: 1. Series 2000 channels Type and Description Channels with a bandwidth not exceeding 4,000 Hertz. These channels are furnished for half-duplex operation on a two-point or multi-point basis. Conditioning for these channels is available as set forth in V.B. and C. following. Type Approximate bandwidth of Hertz. Furnished for voice transmission. May be used for duplex operation on a two-point basis. These channels may be used for data transmission subject to the provisions of A.6. preceding. 2. Series 3000 channels Type and description Channels with a bandwidth not exceeding 4000 Hertz, designed to meet certain specifications based on Carrier standards of measurement for data transmission. These channels are furnished for half-duplex or duplex operation on a two-point or multi-point basis. Conditioning for these channels is available as set forth in V.B. and C. following. Type Approximate bandwidth of Hertz. Furnished for voice and data on an alternate use basis. 11. Payment Arrangements 1. Payment of Charges and Deposits (a) Customer is responsible for payment of all charges for facilities and services furnished the customer. Charges are due when billed and are payable at any business office of Carrier, at any other location designated by Carrier or to a duly authorized collector of Carrier. Billing for service will normally be for one month and as nearly as possible at regular intervals.

Payment Arrangements (Continued) (a) Payment of Charges and Deposits (Continued) (2) Carrier, in order to safeguard its interests, may require an applicant or Customer to make a deposit intended to guarantee the payment of charges for Private Line Telephone Service and Channels until credit is established or reestablished. Such deposit shall be a sum up to an amount equal to the installation charge, if applicable, plus one month's recurring charge for the service rendered or to be rendered. The fact that a deposit has been made in no way relieves the applicant or Customer from complying with Carrier's regulations as to prompt payment of bills on presentation. Simple interest on deposits at the percentage rate specified in the General/Local Exchange Rate Schedule shall be paid by Carrier for the time it is held by Carrier, provided, that if refund of the deposit is made within 30 days of the date of deposit, no interest payment will be made. If Carrier retains the deposit more than 30 days after the date of deposit, payment of interest shall be retroactive to the date of such deposit. The deposit shall cease to draw interest on the date it is returned, on the date service is terminated or on the date notice is sent to Customer's last known address that the deposit is no longer required. At the option of Carrier such a deposit, plus accrued interest, may be refunded or credited to Customer's account at any time prior to termination of the service. (b) Discontinuance of Service for Cause Carrier, by written notice to Customer, may immediately discontinue the furnishing of Customer's service without incurring any liability upon: (1) nonpayment of any sum due Carrier, (2) a violation of any of the conditions governing the furnishing of service or (3) upon use of any service for the purpose of performing any service which would duplicate the service which Carrier may now or hereafter furnish. The use of equipment in such a manner as to adversely affect Carrier's equipment or its service to other Customers, or tampering with any facilities of Carrier are causes for which service may be terminated without notice. (C) Returned Check and Late Payment Charges The returned check and late payment charge application is that established in the General/Local Exchange Rate Schedule.

Payment Arrangements (Continued) (d) General Excise Tax When utility or telecommunications assessments, franchise fees, or privilege, license, occupational, excise, or other similar taxes or fees, based on international receipts or other bases are imposed by certain taxing jurisdictions upon Carrier, the amounts of such taxes or fees will be billed to subscribers. The amount of charge is determined by the international telecommunications services provided to and billed to a subscriber account, with the aggregate of such charges equal to the amount of the tax or fee imposed upon or passed on to Carrier. The taxing jurisdictions in which the charges will be applicable are: Jurisdiction Tax Factors (e) Miscellaneous Rates and Charges State of Hawaii 1.99% Carrier may adjust its rates and charges or impose additional rates and charges on its Customers in order to recover amounts it is required by governmental or quasigovernmental authorities to collect from or pay to others in support of statutory or regulatory programs. An example of such a program includes, but is not limited to, the Federal Universal Service Fund. (1) Federal Universal Service Fee Services provided pursuant to this Rate Schedule are subject to an undiscountable Federal Universal Service Fee, which is a recurring monthly charge equal to 9.2% of Customer s total net international charges, after application of all applicable discounts and credits. (R) Carrier will waive the Federal Universal Service Fee with respect to specifically identified Carrier charges to the extent that Customer demonstrates to Carrier's reasonable satisfaction that it is acquiring Carrier s services for resale, i.e., not for its own internal use, and that it has qualified as an entity not subject to these charges by virtue of its having submitted information required by the Federal Communications Commission and its appointed Universal Service Administrator. Rates The applicable charges for Private Line Telephone Service are the sum of the following charges, as appropriate, and the rates of the concurring company as set forth in this Rate Schedule and the rates of the overseas administration which operates the overseas terminal of the overseas channel. 1. Channels furnished by Carrier in connection with full-period Private Line Telephone Service to Australia; to Guam, to Japan; to Korea; to Midway, to New Zealand; to the Philippines; to Thailand, and to Wake may be used on an alternate use basis as channels for data transmission, namely for the transmission of signals generated by Customerprovided data processing equipment. Customer may switch the channels at will from use for Private Line Telephone Service to data transmission use, or vice versa, but only one type of use can be made at a time except as otherwise provided. In addition, when furnished to Guam and on party line service to Midway, Wake, and Guam, such channels may be used for data transmission only. B. Channel Conditioning Types and Description The following types of conditioning are furnished on channels provided by Carrier in connection with overseas private line services. The number of stations which may be connected to these channels and the distance over which satisfactory transmission is possible may be limited by operating and transmission factors. Carrier will meet the specifications set forth to the extent that associated facilities provided by overseas companies or administrations also meet these specifications. 1. Type Cl - For a two-point or multi-point channel - the envelope delay distortion shall not exceed: between 1000 and 2400 Hertz, a maximum difference of 1000 microseconds - the loss deviation with frequency (from 1000 Hertz reference) shall not exceed: between 1000 and 2400 Hertz, -ldb to +3db between 300 and 2700 Hertz, -2db to +6db (+ means more loss)

Used for Alternate Voice/Data Transmission The charges are the regular charges for full period service to the points specified as set forth in preceding, plus the charges set forth in a. and b. and V.C.3. and 4. following, as applicable, in addition to the applicable rates and miscellaneous charges for the portion of the overseas channel and the facilities beyond the terminal of the overseas channel furnished by the overseas company or administration. These rates, miscellaneous charges and associated regulations are those established by such overseas company or administration.

Carrier provides this Baseband Earth Station Service for use in connection with an appropriate earth segment service furnished at its earth station located at Ewa, Hawaii for IBS international services to Japan and Korea. Output/input of the baseband portion is directly routed to or from the RF equipment of the appropriate earth segment service. Customer is responsible to arrange for facilities from its location to Carrier's baseband equipment, and for obtaining the appropriate earth segment service. Service between Customer's location and Carrier's baseband equipment may be leased from Carrier under its facilities for Interstate Access Service Rate Schedule. Customer is responsible for obtaining the RF Earth Station Service. 2. Explanation of Abbreviations FDMA - Frequency Division Multiple Access khz - Kilohertz QPSK - Quadrature Phase Shift Keying RF - Radio Frequency SCPC - Single Channel Per Carrier 3. Definitions Baseband Equipment Equipment used to modulate and demodulate basic channels, groups, supergroups or data circuits into a single carrier. Output from or input to the baseband is directly routed to the up/down converter where the single carrier is converted to RF microwave frequencies. Carrier A continuous frequency capable of being modulated, or impressed, with a second (information carrying) signal. Channel A path for electromagnetic transmission between two or more points. Converter A device which converts the satellite frequency to an intermediate carrier frequency used between the baseband and the RF equipment.

Rates Duplex Channel A channel capable of simultaneous transmission in both directions. Group A group consists of a frequency band of 48 khz which is divided into twelve 4 khz voice channels. RF Equipment RF Equipment includes up and down converters, High Power Amplifiers, Low Noise Amplifiers and the antenna. Simplex Channel A channel capable of transmission in only one direction. Supergroup A supergroup consists of five groups for a total capacity of 240 khz or 60 voice channels. Voice Grade Channel A channel suitable for transmission of speech, digital or analog data, or facsimile, with a frequency range of 300 to 3000 Hz. Regulations RF Earth Station Service is defined as that portion of the earth segment service which converts the outgoing signal up to the transmit frequency and the incoming signal down to the baseband frequency. Carrier provides RF Earth Station Service at the earth station located at Ewa, Hawaii for IBS international services to Japan and Korea. Carrier assumes no responsibility for the availability or performance of the satellite system under the control of Comsat. If facilities obtained on a resale basis are not available, Customer may either cancel the request for service without penalty or request that Carrier fulfill the order when facilities become available. Such service will be provided on a first-come, first-served basis which is used here to mean requests will be fulfilled in the order in which they are received. Carrier may limit the use of service or interrupt service when necessary because of conditions beyond its control. B.
