3 WASHBURN UNIVERSITY OF TOPEKA BOARD OF REGENTS MINUTES July 24, 2014 I. Call to Order Chairperson Sourk called the meeting to order at 4:02 p.m. in the Kansas Room of the Memorial Union on the Washburn University campus. II. Roll Call Present were: Mr. Hoferer, Mr. McGivern, Mrs. Moran, Mrs. Parks, Mr. Sneed, Mrs. Sourk and Mrs. Trusdale. III. Election of Board Secretary It was moved by Regent Sneed and seconded to appoint Marc Fried, University Counsel, as Secretary to the Board. Motion passed. IV. FY 2015 Public Budget Hearing Chairperson Sourk declared the Public Budget Hearing open. No members of the public had given notice to speak at the hearing. Chairperson Sourk asked if anyone present wished to speak and none came forward. The Board moved and seconded a motion to approve the public budget. The motion passed and Chairperson Sourk declared the Public Budget Hearing closed. V. Approval of Minutes of the June 12, 2014 meeting It was moved by Regent Moran and seconded to approve the Minutes of the June 12, 2014 meeting. Motion passed. VI. Officer Reports A. Chair s Report Chairperson Sourk thanked Regent Sneed for his service as chair this past year. She said the meeting schedule will be an action item later. Chairperson Sourk presented committee appointments, saying she has contacted Regents and all have agreed to serve. It was moved by Regent Hoferer and seconded to approve the committee appointments. Motion passed. B. President s Report President Farley reported the Kansas Humanities Council awarded a grant in the amount of $8,736 to the Mulvane Art Museum for educational programming relating to Drift and Drag, an exhibition and series on water flow issues in Kansas. Dr. Farley said the Dean of the Law School is out of town with the Kansas Women s Attorney s Association, but reported the Washburn University School of Law was ranked Number 6 on a list by prelaw and the National Jurist magazines of the top law schools that improved their graduate employment rate by ten percent or more during the past two years. Regent Hoferer noted the School of Law also ranked 35 th for preparing students to practice. President Farley reported Dr. Marian Jamison said the School of Nursing applied for and received a grant in the amount of $557,000 to train full-time and part-time students who wish to be nurse practitioners. Dr. Farley said this weekend a mascot boot camp is being conducted on campus. This will be the third time in the last four years. A nationally known person typically leads the program. He said we have been getting many press inquiries to watch, but this is not permitted until the last day to preserve each individual s identity because participants are not in mascot garb until the last day. President Farley said Move-In day is August 14. He said classes start the following Monday, and that we are still doing new student orientations. C. Committee Report(s) There were no committee reports. D. Treasurer s Report Vice President for Administration and Treasurer, Rick Anderson reported 1. Liquidated Claims Approval May 2014 and 2 Liquidated Claims Approval June Regent Moran questioned the June check register entry for $22,000 to Gale. 6 2. Policies a. Agilent GC and GC/MS Systems for Washburn University Forensic Chemical Science Program Vice President for Academic Affairs, Randy Pembrook, explained that an Agilent is a microscope that keeps our equipment consistent with KBI equipment which will aid our students in working with KBI staff and should improve opportunities for employment after graduation. It was moved by Regent Sneed and seconded to approve. Motion passed. b. Change in Faculty Handbook Language Regarding the Probationary Period and Early Petitions for Tenure Vice President for Academic Affairs, Randy Pembrook, presented the item, saying there are two points as part of the ongoing revisions to the faculty handbook. The first deals with confusion of length of probationary period to create a uniform probationary period of six years and at least three years at Washburn. The second clarifies if a person has been teaching for a period of time and allows them to apply before the six year probationary period. It still requires at least three years at Washburn. This needs the approval of the chair and dean. It was moved by Regent Moran and seconded to approve. Motion passed. C. Information Item(s) 1. Report of Purchases between $25,001 and $50,000 Award of contracts to: Regents Flooring Company, Lenexa, KS, in the amount of $32,600 to replace rubber flooring in the Student Recreation & Wellness Center; Designed Business Interiors, Topeka, in the amount of $45,335 for installation of glass wall enclosure area at Mabee Library; Latimer Sommers & Associates, Topeka, in the amount of $28,600 for electrical engineering services primary electrical distribution system study; and, Jock s Nitch Sporting Goods, Topeka, in the amount of $26,593 for football uniforms, shoes and accessories for the Athletic Department. 2. Heartland Visioning Dr. Farley introduced John Hunter, executive director of Heartland Visioning, who made a presentation. Washburn University Board of Regents SUBJECT: Annual Audit Services BACKGROUND: On December 7, 2009, a Request for Proposal was issued to 31 accounting firms capable of providing annual audit services for Washburn University. The University received proposals from five firms: Berberich Trahan & Co., P.A.; BKD, LLP; RubinBrown LLP; Grant Thornton LLP; and Clifton Gunderson LLP. Following the proposal review, the two highest rated firms (BKD LLP and RubinBrown LLP) were invited for formal presentations. The presentation were attended by the review committee, other university personnel, the Board of Regents Audit Committee and other Board members. In addition to the presentations, the costs and hours proposed by the firms were analyzed in detail to ensure comparability for all proposals. An award was made to RubinBrown for the audits and related professional services for the fiscal year ending June 30, 2010 with the option of renewing for each of the subsequent four (4) fiscal years ending June 30, DESCRIPTION: At the August 27, 2014 Board of Regents Audit Committee meeting the committee voted to recommend approval to extend the RubinBrown contract with the University for an additional five years with partner rotation, meaning RubinBrown would provide a different lead audit partner for the FY 2015 through FY 2019 audits. FINANCIAL IMPLICATIONS: Expenditures for the FY 2015 through FY 2019 audits fees are outlined in the attached RubinBrown proposal. These following positions are necessary to meet the requirements of the Second Chance Act Grant that was awarded to the Kansas Department of Commerce in the amount of $511,750. Washburn University/Washburn Institute of Technology is a sub-award recipient to provide technical training for offenders in the Topeka Correctional Facility who are within 6 months to 18 months of release. The Advantage Center at Tech is designed to help students in certain categories who are seeking Tech Education [e.g., those in the Topeka Metro Area without a high school diploma]. The purpose of the Advantage Center is to improve student retention and improve student support services for Washburn Institute of Technology students. Washburn University Board of Regents SUBJECT: Designate Dr. William Gary Baker as Professor Emeritus and Mr. Douglas Jones as Lecturer Emeritus DESCRIPTION: Dr. William Gary Baker began his teaching career at Washburn University in 1975 as Assistant Professor of Finance in the School of Business and received tenure and promotion to Associate Professor in 1978 with promotion to Professor in He earned his B.A. from Ohio State University in 1965, M.A. from Wichita State University in 1967, and Ph.D. from the University of Nebraska in Prior to his Washburn career of 40 years, he served as an Instructor of Economics, then Assistant Professor and Chairman of the Department of Accounting, Business Administration, and Economics at Benedictine College. During his 40 years of service, he has been an outstanding teacher, productive scholar, and diligent colleague along with being the Social Chairman for the School. Mr. Douglas Jones began his teaching career at Washburn University in 2000 as Instructor and Coordinator of the Diagnostic Medical Sonography Program in the School of Applied Studies Allied Health Department and served for a time as Program Director. He earned his B.A. in 1974 at the University of Kansas. Prior to his Washburn career, he had 25 years of experience in general, vascular, and cardiac ultrasound, 13 years in ultrasound services management, and 20 years involvement in teaching ultrasound. During his 14 years of service, he was instrumental in the development of the Diagnostic Medical Sonography Program at Washburn, was a dedicated liaison with the community, area hospitals and clinics, served on many University committees, and held offices within his professional organizations. FINANCIAL IMPLICATIONS: None RECOMMENDATION: President Farley recommends the Board of Regents bestow the title Professor Emeritus to Dr. William Gary Baker and Lecturer Emeritus to Mr. Douglas Jones. Washburn University Board of Regents SUBJECT: University Health Plan Renewal DESCRIPTION: The University s Health Programs plan year with Blue Cross Blue Shield of Kansas is from November 1 to November 1 each year. University administrators and employees have reviewed the information provided by Blue Cross Blue Shield and are recommending no plan or premium changes. This is largely due to continued favorable claims experience and minor plan changes over the last several years. The University s plan is a non-grandfathered, partially self-funded program. Our rates are a direct result of the usage our group has experienced over this rating period, and utilization has been favorable. Once again the University will fund the entire cost of the single, base plan premium for employees. The University will continue a four tier premium schedule which, in essence, provides income adjusted family coverage based upon salary to assist lower paid staff afford family medical coverage. The University will continue two options a base option and a buy-up option. The attached Premium sheet shows the individual premium amounts, as well as those amounts paid by the University to continue the University s support of premiums for dependent coverage for lower paid employees. The University will continue to monitor the effect the Affordable Care Act has on employee provided health plans over the next several years and look for ways to tie our wellness program more closely with our health plan. FINANCIAL IMPLICATIONS: The FY 15 Fringe Benefits budget contains sufficient funds to cover the University s portion of the premiums. Washburn University Board of Regents The University s property insurance was renewed in July through the Midwest Higher Education Compact (MHEC) program. The renewal date for the remainder of the insurance coverage is October 1. Workers Compensation constitutes the highest premium of all the University property and casualty insurance policies. Over the last few years the University has worked closely with our insurance agent and workers compensation carrier and made a concerted effort to improve both the frequency and severity of claims. The experience modification factor of.82 is the lowest it has been in at least the last ten years. Washburn University Board of Regents SUBJECT: Updates Regarding Submitted Promotion & Tenure Materials DESCRIPTION: Promotion and tenure candidates will have an opportunity to update information for materials already submitted in their petition. RATIONALE: Sometimes a grant is funded or an article accepted for publication after a candidate has submitted his/her promotion and tenure petition. This change would allow the candidate to update the existing information in the petition package, but does not guarantee that it will make a difference to the final outcome. Each committee or individual reviewing the package should state specifically why a candidate did or did not get approved, so the person(s) at the next stage can determine whether the additional material should change the outcome; the package does NOT go backwards. This policy will become the new Section 3.II.G the current sections G-L will adjust accordingly (becoming H-M). Proposed Changes to Faculty Handbook: Section 3.II.G A petitioner may provide updates regarding SUBMITTED materials mentioned in the original petition (e.g., grants; submitted articles) at any time in the review process. So reviewers further in the process can evaluate accurately whether any updates would or would not change that decision, committees and individuals reviewing the petition are encouraged to specify clearly what contributed to a negative decision. This proposed change will be effective immediately and will be applicable to all faculty applying for promotion and tenure regardless of hire date. The increase was approved by the Board of Regents at its May 9, 2001 meeting. DESCRIPTION: In compliance with that approval and to ensure the Board fully complies with its fiduciary responsibilities, the Board of Regents requested all items approved by the administration between $25,001 and $50,000 be listed each month and included for information.
