Photo by Moza Mathias One Step Closer To Citizenship Last fall, New York Lawyers for the Public Interest s Pro Bono Clearinghouse entered into an exciting new partnership with Catholic Migration Services. As with many successful past projects, this partnership sought to leverage the resources of volunteer attorneys to expand the reach and services of Catholic Migration Services, a local nonprofit that provides comprehensive legal, advocacy, educational and pastoral services to advance equality and social justice in a changing and diverse population throughout Brooklyn and Queens. With Catholic Migration Services as its community partner, NYLPI designed and coordinated two naturalization clinics to assist individuals who are Lawful Permanent Residents in applying for citizenship. Recognizing the important role of volunteer attorneys, NYLPI called on two Two years ago, NYLPI s Health Justice lawyers met a Mexican national in his 30s with kidney failure who had been on dialysis for 10 years. The Health Justice team completed a comprehensive health and immigration screening and determined that he was eligible to apply for an immigration benefit through his sister, which would qualify him for Medicaid. With Medicaid, he could obtain coverage for a life-saving kidney transplant. NYLPI provided him with immigration assistance and in the spring of 2015, he received a kidney transplant. Following this experience, NYLPI developed UndocuCare, a project connecting immigrant New Yorkers with serious health conditions to statefunded Medicaid that can provide life-changing and often life-saving treatment. In 2015, NYLPI conducted comprehensive immigration (continued on page 4) (continued on page 4)

2 Message from the Executive Director Dear Friends, We re thrilled to share with you highlights of our work since we wrote last summer. This year we celebrate 40 years of securing justice for millions of New Yorkers. Keep an eye out for a special 40th anniversary edition of this newsletter that will profile our history of community-driven civil rights work and partnerships with the private bar. We welcome you to join us throughout the year in commemorating this milestone as we look back at what we ve accomplished together and look forward to new challenges and opportunities. Just a few weeks ago, we celebrated our 23rd Law & Society Award Luncheon. We were proud to honor Brian Moynihan, CEO of Bank of America, and John F. Savarese, Litigation Partner at Wachtell, Lipton, Rosen & Katz, for their steadfast commitment to the pursuit of justice. We were profoundly grateful for the outpouring of support for our event, our honorees and our work. It was a celebration of the social justice community in New York City, and you ll find several photos in these pages. In this newsletter, we recognize our strong partnerships with the private bar and with legal and corporate leaders. Your pro bono talent and skills add immense power to our work with communities in need. You ll read about how we ve expanded our work to provide immigration legal services to New York City s most underserved through the Pro Bono Clearinghouse s new partnership with Catholic Migration Services, and how our UndocuCare project continues to improve the health and lives of seriously ill immigrants with the City Council s strong support. You ll also read about our recent work to secure equal access to quality education and supportive learning environments within charter schools for students with disabilities. As community needs evolve, each of our program areas continues to work towards good schools, safe jobs, quality healthcare and healthy neighborhoods for all New Yorkers. In upcoming editions, we ll be excited to report on the outcomes of our most recent litigations, updates on our new ventures resulting from increased funding for fair housing initiatives, and our evolving role in coalitions and movements across New York City. 3 Celebrating 40: Hundreds of Advocates, Thousands of Pro Bono Attorneys, Millions of New Yorkers As we launch our 40th anniversary year, we celebrate our unique communitydriven civil rights work and groundbreaking pro bono leadership. We invite you to join us in observing this significant time by participating in events and activities that we will host throughout the year. We are looking forward to what we will accomplish together in the next 40 years. Still Transforming: Progress on Transform Don t Trash NYC Campaign Two years ago, NYLPI helped to found Transform Don t Trash NYC, a grassroots coalition of workers, communities and environmental advocates dedicated to reforming the city s inefficient and polluting commercial waste system. The coalition envisions a more efficient, sustainable and accountable waste system in which private waste haulers and processors competitively bid for the right to collect, process and recycle business waste from a series of citydesignated zones instead of maneuvering through over-congested and toxic routes as they currently do. Similar competitive zone systems have been adopted by major cities across the nation and are successfully boosting recycling rates while creating local, green jobs in the recycling industry. NYLPI is excited to report that the campaign continues to clean up around the city. In 2015, NYLPI took a lead role in publishing two extensive research reports on the impacts of the commercial waste system on our communities, environment, small businesses and workers. These reports, which outline the coalition s findings and proposals, can be found online at NYLPI is currently researching reform legislation passed by other major cities and drafting model legislation for New York City to address this pressing issue. Pro Bono Highlights The Friends of Crown Heights Education Centers provide a diverse array of child care, family support, and educational services to families in New York City. Morgan, Lewis & Bockius and American International Group, Inc. are working with the organization to resolve a landlord dispute at one of their properties. Project Petals works with artists to create safe and sustainable public spaces in underserved communities. Debevoise & Plimpton is helping the group incorporate and acquire tax-exempt status. Resource Generation engages young people from privileged backgrounds to become active leaders in movements for social, racial, and economic justice. McDermott Will & Emery is reviewing the group s employment manual. Rhythm Break Cares uses the therapeutic powers of dance and music to enhance the lives of people with early and middle stage Alzheimer s. The organization trained volunteer attorneys who eagerly joined in on the opportunity to assist this underserved population. (continued from page 1) Together, about 18 attorneys staffed two full-day clinics in Brooklyn, and were able to serve more than 80 clients from over 20 countries. These attorneys also assisted clients in applying for fee waivers, resulting in $17,000 worth of savings for eligible participants. This exemplary partnership represents one of the best ways nonprofits and private firms can partner together to maximize their impact. In a true demonstration of their dedication to pro bono, Cleary and Fried Frank have made an ongoing commitment to staff quarterly clinics through The assistance that clients receive from volunteer attorneys continues to have a tremendous impact on their lives, providing assurance and confidence on their path toward citizenship. Photo by Moza Mathias Empowered for Fuller, Healthier Lives and health screenings for nearly 200 undocumented individuals with serious health conditions. NYLPI also provided immigration representation, connection to Medicaid, wraparound advocacy services with health care providers and organ transplant centers, housing assistance and systemic advocacy at the city and state level. As a result of this work, NYLPI is proud to be part of the City Council s new $1.5 million Immigrant Health Initiative. The City Council granted NYLPI, along with several community health center partners, $500,000 to expand services. Additionally, NYLPI has formed a partnership with DLA Piper US to 4 VOLUNTEER OR DONATE NOW NYLPI.ORG (continued from page 1) prepare humanitarian deferred action applications for seriously ill individuals with no other immigration recourse. This work by attorneys at DLA Piper will lead to access to state-funded Medicaid, and healthier lives. Through targeted outreach, raising public awareness and educating health care providers, community based organizations and legal services providers, NYLPI is getting the word out about immigrant access to Medicaid in New York and is helping people safely come out of the shadows to live fuller lives the true meaning of Health Justice.

5 Ensuring Equal Access to Charter Schools In February 2016, NYLPI and Stroock & Stroock & Lavan filed a federal civil rights complaint against Success Academy Charter Schools, Inc. on behalf of a student and his parents. The case relates to the discriminatory treatment of this student with learning disabilities at a Success Academy school while he attended kindergarten there. The school failed to provide the child with reasonable accommodations for his disabilities and engaged in a campaign to force the student out of the school. Over the course of many months, the school and its principal targeted this student with harsh disciplinary measures, including regular removal from class and the school, and labeled the child a got-to-go student, as detailed recently in the New York Times. NEWS HEADLINE FROM The New York Times At a Success Academy Charter School, Singling Out Pupils Who Have Got to Go Through their work, Senior Supervising Counsel Roberta Mueller and Staff Attorney Irene Mendez recognized that students with disabilities were not receiving the services and accommodations they needed to succeed. Under the leadership of Partner and Founding Director of Stroock s Public Service Project, Kevin J. Curnin, NYLPI is pleased to work with Stroock s legal team, Alan M. Klinger, Beth A. Norton, and David V. Simunovich, on this important case. NYLPI also looks forward to co-counseling this case with Arthur Z. Schwartz of Advocates for Justice, and to expanding the action to include additional parents at Success Academy Fort Greene whose children were subjected to the same discrimination. This case also highlights the effectiveness of NYLPI s community lawyering model in pursuit of NYLPI s long-standing efforts to ensure equal access for students with disabilities. Because individuals like NYLPI Senior Advocate Paola Martinez Boone, MSW have forged strong relationships with parents and families in the education community around New York City, these issues continue to be brought to NYLPI s attention. As more charter schools enter the educational landscape of New York City, it is imperative that all children are able to access the unique learning environments these schools offer. Pro Bono Advisory Council Holds Leadership Session with Board of Directors NYLPI s Pro Bono Advisory Council members had the opportunity to get a behind-the-scenes look at nonprofit board service and board governance from NYLPI s Board of Directors during a special leadership session held in November at Cohen & Gresser. Members that attended walked away with first-hand knowledge from NYLPI s talented Board of Directors and gained valuable insight into how board service can develop leadership skills, enhance their legal career and help them fulfill their commitment to public interest. 9 Preserving Elder Rights to Liberty and Self-Determination In February, NYLPI filed a lawsuit on behalf of an elderly woman, Ms. Claire Giambrone, against a for-profit nursing home, Oceanview Nursing and Rehabilitation Center, in Far Rockaway, Queens. The nursing home violated Ms. Giambrone s rights to self-determination by keeping her in the nursing home against her will without seeking court intervention to determine her decision-making capacity, and medicating her with psychotropic drugs without informed consent. NYLPI asserted claims for disability discrimination under federal and state law. We hope this case will serve to help rein in abuses at the hands of many nursing homes, which effectively appoint themselves decision-makers for their residents, routinely overriding individual wishes with regard to both discharge and to medication. At seventy-nine years old, Ms. Giambrone is able to take care of her own health needs and make her own decisions. Despite her repeated requests to the nursing home to be discharged and the fact that she was legally capable of making her own decisions about her care, the home refused to release her. The nursing home discriminatorily denied Ms. Giambrone access to discharge planning because of a perceived mental disability and refused to plan her transition to an environment less restrictive than a nursing home. All through this ordeal, Oceanview was receiving payments through Medicaid and Medicare of hundreds of dollars per day for each additional day it kept Ms. Giambrone at its facility. Model Partnerships Exhale to Inhale teaches yoga as a tool for empowering survivors of domestic violence and sexual assault in New York City, Hudson Valley, Long Island and Connecticut. Through connections with shelters and community-based organizations, the yoga instructors that Exhale to Inhale works with bring the healing practice of yoga to survivors in a safe space. Like many small nonprofits, Exhale to Inhale needed advice regarding employment law concerning its volunteers, teachers, contractors and employees. Organizations often attempt to make these decisions without expert counsel, which can have serious consequences. NYLPI connected Exhale to Inhale with Jonathan Sokolowski, Associate at Sheppard, Mullin, Richter & Hampton and a member of NYLPI s Pro Bono Advisory Council, to help them address their concerns. Jon was able to apply his diverse knowledge of employment law to resolve Exhale to Inhale s questions, demonstrating what a unique resource pro bono attorneys are for nonprofits. Thanks to Jon s expertise and engagement, the organization can remain focused on continuing and expanding its vital work.
