3 SECOND ANNUAL SUMMIT ON DISCLOSURE,TRANSPARENCY AND AGGREGATE SPEND FOR DRUG, DEVICE AND BIOTECH COMPANIES Sales and marketing disclosure initiatives are sweeping the pharmaceutical and medical device industries. New Jersey recently became the latest state to propose a broad set of disclosure requirements. Meanwhile, competing versions of the Physician Payments Sunshine Act have been included in the House and Senate healthcare reform bills moving through Congress. If the Sunshine Act is passed, drug and device companies will have a broad new federal requirement with which to comply. If it is not, the states are prepared to fill the void with a patchwork of inconsistent requirements, and the Sunshine Act will likely be moved forward as freestanding legislation next year. Meanwhile, the HHS Office of Inspector General has made disclosure requirements a standard feature of corporate integrity agreements (CIA). In addition, state Attorneys General are pushing the envelope with their own disclosure requirements included in state settlements. The influential Institute of Medicine (IOM) recently gave the issue further impetus when it recommended disclosure reforms and a growing list of academic medical centers have entered the act with their own independent requirements. The Second Annual Summit on Disclosure, Transparency and Aggregate Spend for Drug, Device, and Biotech Companies will examine these numerous mandates and how companies are responding.
