("Schwarz") and counsel for those plaintiffs with cases in Middlesex County who had agreed to settle with Schwarz submitted a Joint Stipulation and Order ("Schwarz Joint Stipulation") to the Court containing certain stipulations as between them addressing the resolution of settling plaintiffs' claims asserted against Schwarz and the effectuation of the agreed to settlement. On February 15, 2017, the Court endorsed an Order of Disposition dismissing the claims against Schwarz in those settling plaintiffs' cases. Similar joint stipulations were endorsed by the courts overseeing the Reglan/metoclopramide proceedings in California (Case No. CJC ) and Pennsylvania (Case No. 1997). Since the Schwarz Joint Stipulation was submitted, certain cases brought by plaintiffs who have also agreed to settle with Schwarz were transferred from Atlantic County to Middlesex County. These additional settling plaintiffs ("Additional Settling Plaintiffs") are listed in the accompanying Order of Disposition, appended hereto as Exhibit I. Schwarz and counsel for the Additional Settling Plaintiffs hereby fully incorporate the Schwarz Joint Stipulation, including the stipulations contained therein. IT IS SO STIPULATED.

2 Now therefore: 1. Pursuant to this Joint Stipulation and Order and the accompanying Order of Disposition, appended hereto as Exhibit 1, it is hereby Ordered that all claims asserted against Schwarz, by or on behalf of the Additional Settling Plaintiffs are hereby dismissed with prejudice, with each side to bear its own costs and fees in accordance with the Release; and 2. Pursuant to this Joint Stipulation and Order it is hereby Ordered that the only remedy or recourse for Additional Settling Plaintiffs to resolve their individual claims against Schwarz are the funds that Schwarz deposits into the Qualified Settlement Fund under the Master Settlement Agreement.
