1 BOARD OF REGENTS BRIEFING PAPER 1. Agenda Item Title: Amendment to employment contract, Head Football Coach, University of Nevada, Reno Meeting Date: June 16 and 17, BACKGROUND & POLICY CONTEXT OF ISSUE: In 2007, the Board of Regents approved an amendment to Chris Ault s employment contract extending his employment to June 30, The term of that extension is being amended and therefore Board approval is requested. Exhibit 1. Coach Ault s current contract and its first amendment form Exhibit SPECIFIC ACTIONS BEING RECOMMENDED OR REQUESTED: President Johnson requests approval of an amendment to Coach Ault s employment contract, extending the contract to June 30, IMPETUS (WHY NOW?): Coach Ault has built a nationally competitive and recognized football program. In order to sustain momentum and continue to grow the Wolf Pack football program, it is imperative that Coach Ault receive an extension to his current contract. 5. BULLET POINTS TO SUPPORT REQUEST/RECOMMENDATION: Coach Ault has just completed his seventh season in his third tenure as Head Football Coach. Under Coach Ault s leadership, the UNR football team finished in the top 15 nationally of the BCS rankings and shared in the WAC Championship title. Coach Ault led the team to victory in the Kraft Fight Hunger Bowl. In 6 of the last 7 years, Coach Ault s teams have appeared in Bowl games. Coach Ault was awarded WAC Coach of the Year this year. Coach Ault s success has raised national awareness of the University of Nevada and the Wolf Pack Athletic Program. Student-Athlete graduation rates continue to increase. 6. POTENTIAL ARGUMENTS AGAINST THE REQUEST/RECOMMENDATION: Some may not want Chris Ault to continue as Head Coach of the Wolf Pack football program. 7. ALTERNATIVE(S) TO WHAT IS BEING REQUESTED/RECOMMENDED: Do not approve the extension and risk losing assistant coaches and recruits. 8. 2 SECOND AMENDMENT TO EMPLOYMENT AGREEMENT BETWEEN THE BOARD OF REGENTS OF THE NEVADA SYSTEM OF HIGHER EDUCATION, ON BEHALF OF THE UNIVERSITY OF NEVADA, RENO AND CHRISTOPHER T. AULT The Board of Regents of the Nevada System of Higher Education, on behalf of the University of Nevada, Reno and Christopher T. Ault, hereby amend the EMPLOYMENT AGREEMENT between them, which EMPLOYMENT AGREEMENT was approved by the Board of Regents of the Nevada System of Higher Education on or about March 16-17, 2006, and which EMPLOYMENT AGREEMENT was amended by the Board of Regents of the Nevada System of Higher Education on or about August 16-17, 2007, as follows: 1. ARTICLE IV TERM OF EMPLOYMENT, 4.01 Term of Agreement, a. Multi-Year Contract is amended to read as follows: ARTICLE IV TERM OF EMPLOYMENT Term of Agreement. a. Multi-Year Contract. The Employee s employment, hereunder, shall commence July 1, 2006, and shall continue until this Employment Agreement terminates upon the close of business at the University on June 30, 2014; provided, that this provision is subject to the terms and conditions of Article VI hereof concerning termination and Article VII hereof concerning restrictions on competition, and neither party shall have any right to terminate this Employment Agreement prior to the close of business at the University on June 30, 2014, except as provided therein. THE PARTIES TO THIS EMPLOYMENT AGREEMENT EXPRESSLY UNDERSTAND AND AGREE THAT THE PROVISIONS OF THIS SUBSECTION CONSTITUTE THE NOTICE TO THE EMPLOYEE OF THE NONRENEWAL OF HIS EMPLOYMENT AT THE UNIVERSITY AND THAT HIS EMPLOYMENT WILL TERMINATE UPON THE CLOSE OF BUSINESS AT THE UNIVERSITY ON JUNE 30, 2014; AND THAT, NOTWITHSTANDING ANY PROVISION OF THE NEVADA SYSTEM OF HIGHER EDUCATION CODE TO THE CONTRARY, NO OTHER NOTICE OF NONRENEWAL OF EMPLOYMENT SHALL BE REQUIRED. THE PARTIES AGREE that all other terms of the Employment Agreement as amended on or about March 16-17, 2006, remain unchanged and in full force and effect.
