2 BEFORE THE PUBLIC UTILITIES COMMISSION OF THE STATE OF CALIFORNIA Application of SAN DIEGO GAS & ELECTRIC Company (U 902-E for Approval of its 2017 Electric Procurement Revenue Requirement Forecasts and GHG-Related Forecasts And Related Matters A (Filed April 15, 2016 A A MOTION FOR CLARIFICATION OF SCOPING MEMO Pursuant to Rule 11.1 of the California Public Utilities Commission s (Commission or CPUC Rules of Practice and Procedure, Southern California Edison Company (SCE, on behalf of itself and the Alliance for Retail Energy Markets/Direct Access Customer Coalition (AReM/DACC, the Public Agency Coalition (PAC, and the California Large Energy Consumers Association (CLECA (referred to hereinafter collectively as Settling Parties, respectfully moves for the Commission to clarify the February 2, 2018, Scoping Memo and Ruling of Assigned Commissioner for Phase 2 (Phase 2 Scoping Memo to reflect the consensus reached in the Settling Parties February 1, 2018 Settlement Agreement. 1 The Settling Parties appreciate the Commission s issuance of the Phase 2 Scoping Memo, and the various references therein to the Settling Parties pending Settlement Agreement, which was filed just one day before the Phase 2 Scoping Memo. 2 As currently written in the Phase 2 Scoping Memo, however, it is unclear how and when matters addressed in the Settling Parties pending Settlement Agreement will be resolved. The Phase 2 Scoping Memo sets for briefing two issues, one of which is styled: 1 In accordance with Rule 1.8(d, SCE confirms the Settling Parties have authorized SCE to file this motion on their behalf. 2 See, e.g., Phase 2 Scoping Memo at p. 2. 1

3 Since SCE propose[s] removal of Utility Owned Generation (UOG costs from the PCIA calculation for pre-2009 vintaged Direct Access customers, what should be the effective date for implementation of PCIA adjustments associated with only retaining SONGS related costs in the PCIA for pre-2009 vintages? 3 The Settling Parties respectfully submit that legal briefing is not necessary to resolve this question, because the Settling Parties February 1, 2018 Settlement Agreement already answers it: January 1, As such, as to SCE and issues contained in the Settling Parties pending Settlement Agreement, it is most appropriate and efficient to address these issues within the confines of the Commission s settlement process and procedure. Accordingly, the Settling Parties respectfully request that instead of briefing an issue that has already been agreed-upon and is currently before the Commission in the form of a settlement, the Commission clarify that, as to SCE, this issue will be addressed in an expeditious Proposed Decision on the Settling Parties proposed Settlement Agreement, which they expect to be unopposed. 5 This clarification will ensure that issues move forward on a dualtrack nature in light of the pending settlement, namely, matters under the Settling Parties pending Settlement Agreement will proceed under the settlement process and matters unaffected by the Settling Parties pending Settlement Agreement will proceed as described in the Phase 2 Scoping Memo. Allowing the Settling Parties settlement to proceed under the settlement process would minimize delay and allow SCE 6 to begin the refunds of already-collected PCIA revenues to pre-2009 vintage departing load customers that all parties now agree are appropriate. Accordingly, the Settling Parties respectfully request that the Commission amend the Phase 2 Scoping Memo to eliminate this issue from the briefing requirement, and instead clarify that matters under the Settling Parties pending Settlement Agreement will proceed under the Commission s settlement review process. 3 Phase 2 Scoping Memo at pp See Settlement Agreement at Article See generally, February 1, 2018, Motion for Approval of Settlement Agreement. 6 SDG&E does not have non-songs legacy UOG resources reflected in pre-2009 vintage departing load customers PCIA. 2
