Worker Organizing and Advocacy in the 21st Century United States After decades of decline in union density, especially in the private sector, along with unrelenting employer opposition to unionism, skyrocketing inequality, and growing economic insecurity for working people, the labor movement has struggled to reinvent itself in the 21st century. Although the challenges are formidable, a new generation of progressive activists, along with veteran organizers experimenting with a variety of novel strategies and tactics, are attempting to rebuild and reinvent the labor movement in the 21st century. With all its limitations, organized labor is still the single most important institution representing workers interests; and unions as well as other forms of collective action by or on behalf of workers remain vital to the American democratic order.

3 Against the background of an analysis of the rollback of New Deal era public policies and economic restructuring since the 1970s, as well as the more recent rise of right-wing populism, this lecture will examine recent labor movement innovations. It will include an overview of worker center organizing and advocacy on behalf of low-wage workers, including immigrants; the recent surge of union activity among Millennialgeneration workers, such as online journalists, adjuncts and other contingent workers in colleges and universities, and teachers; efforts to leverage unions political influence (often in coalition with allies outside organized labor) to win state and local support for pro-worker initiatives, from minimum wage increases to paid leave provisions, from wage theft prohibitions to scheduling regulations; and efforts to develop tripartite wage boards to lift labor standards. 11:30a.m.-1:00p.m. Ogilvie Auditorium IL MCLE Credit: 1.5 hrs The lecture is free and open to the public, however registration is requested at cle.kentlaw.edu This lecture is funded by the Kenneth M. 4 FACULTY LECTURER Ruth Milkman Distinguished Professor of Sociology, City University of New York Graduate Center and Research Director, Murphy Institute for Worker Education and Labor Studies, CUNY Ruth Milkman is a sociologist of labor and labor movements. She is currently Distinguished Professor of Sociology at the CUNY Graduate Center and at the CUNY School of Labor and Urban Studies, where she teaches labor studies and also serves as Research Director. For the academic year she is a fellow at Stanford University s Center for Advanced Study in the Behavioral Sciences. Ms. Milkman has written on a variety of topics involving work and organized labor in the United States, past and present. She has published five sole-authored, one co-authored, and six edited or co-edited books, as well as numerous articles. Her early research focused on the impact on U.S. women workers of economic crisis and war in the 1930s and 1940s. More recently she has written extensively about lowwage immigrant workers, analyzing their employment conditions as well as the dynamics of immigrant labor organizing. She co-authored (with Eileen Appelbaum) a 2013 study of California s paid family leave program, focusing on its impact on employers and workers. She has also conducted policy-oriented research on such topics as wage theft, unionization trends, paid sick leave, the aging workforce, and home care workers. She is currently at work on a book on labor and immigration, forthcoming from Polity Press. Ms. Milkman received her B.A. from Brown University and her Ph.D. from the University of California, Berkeley. COMMENTATOR Sharon Block Executive Director, Labor and Worklife Program and Lecturer on Law, Harvard Law School. Sharon Block is Executive Director of the Labor and Worklife Program and Lecturer on Law at Harvard Law School. Prior to coming to Harvard Law School, she was the Principal Deputy Assistant Secretary for Policy at the U.S. Department of Labor and Senior Counselor to the Secretary of Labor. For 20 years, Ms. Block has held key labor policy positions across the legislative and executive branches of the federal government. In 2012, President Obama appointed her to be a member of the National Labor Relations Board. She was senior labor and employment counsel to the Senate Health, Education, Labor and Pensions Committee under Senator Edward Kennedy. While serving in the Obama White House as Senior Public Engagement Advisor for Labor and Working Families, Ms. Block led the historic White House Summit on Worker Voice. She serves on a number of labor-related board and advisory committees, including as a board member of the National Employment Labor Project, advisory committee member for the Harvard T.H. Chan School of Public Health, Education and

5 Research Center, and member of the Higher Quality Jobs Advisory Council of the Federal Reserve Bank of Boston. In addition, she writes frequently on labor and employment issues and is a senior contributor to OnLabor.org. Ms. Block received her B.A. from Columbia University and her J.D. from Georgetown University Law Center, where she received the John F. Kennedy Labor Law Award. COMMENTATOR Harry I. Johnson, III Partner, Morgan Lewis Once a member of the National Labor Relations Board (NLRB), Harry I. Johnson, III is now a management-side defense lawyer at the firm of Morgan Lewis & Bockius LLP with more than 20 years of experience in traditional labor matters before the NLRB and federal courts. He practices across the entire traditional union/labor field, including in NLRB unfair labor practice and representation proceedings, union representation campaigns, union corporate campaigns, labor arbitrations, collective bargaining, labor-management relations, labor-related advice for mergers and acquisitions, and federal and state labor injunction cases. He is also the co-practice group leader of the firm s nationally-recognized labor / management relations practice. Mr. Johnson received a B.A. from John Hopkins University, an M.A.L.D. from Tufts University s Fletcher School of Law and Diplomacy, and a J.D. from Harvard School of Law. KENNETH M.
