1 Convention on the Conservation of Migratory Species of Wild Animals Format for reports of Parties on implementation of the Convention on the Conservation of Migratory Species of Wild Animals (revision of June 2003) Reporting format agreed by the Standing Committee at its 26th Meeting (Bonn, June 2003) for mandatory use by Parties, for reports submitted to the Eighth Meeting of the Conference of the Parties (COP8) (Nairobi, 2005). The questions below combine elements of Resolution 4.1 (Party Reports) adopted by the Fourth Meeting of the Conference of the Parties (Nairobi, June 1994) and Resolution 6.4 (Strategic Plan for the Convention on Migratory Species ), adopted by the Sixth Meeting of the Conference of the Parties (Cape Town, November 1999), as well as commitments arising from other operational Resolutions and Recommendations of the Conference of the Parties. Please refer to the separate instructions on completing the report. Parties are encouraged to respond to all questions, since it cannot be assumed that the absence of a response indicates that no activities taken have place in the current reporting period. Parties are also requested to provide comprehensive answers, including, where appropriate, a summary of activities, information on factors limiting action and details of any assistance required. (Please list.) 1a Federal Ministry for Consumer Protection, Food and Agriculture, Departments for Hunting and Fishery Affairs Ministries for the Environment and for Hunting and Fisheries on the level of the federal states (Länder) If more than one government department is involved, describe the interaction/relationship between these government departments: Cooperation on the level of the federal government takes place if species are concerned, which are under the hunting law in Germany (e.g. wildfowl) or which are interfered by fishery activities (e.g. marine mammals). The implementation of conservation measures is with the government departments of the federal states (Länder). 2 List the main non-governmental organizations actively involved in initiatives for the conservation of migratory species in your country, and describe their involvement: Dachverband Deutscher Avifaunisten (DDA), Deutscher Jagdschutz-Verband (DJV), EURONATUR, NABU (Naturschutzbund Deutschland e.v.), Whale and Dolphin Conservation Society (WDCS). See the National Report 2002 Conservation status and protection of migratory species in Germany for their involvement in CMS activities. 3 Describe any involvement of the private sector in the conservation of migratory species in your country: Volunteers participate in the conservation of migratory species through conservation implementation measures, monitoring surveys, amateur research and funding. 4 Note any interactions between these sectors in the conservation of migratory species in your country: There is close cooperation between governmental authorities, NGOs and private volunteers in many aspects of the conservation of migratory species in Germany. If Yes, please provide details (Include the date on which the exception was notified to the CMS Secretariat pursuant to CMS Article III(7)): The capture of single specimens was allowed for research purposes under the condition of careful handling and immediate release of the animals. Eggs of Great Bustards were taken for ex situ incubation and release of the chicks as part of a Species Conservation Programme. 3 Identify any obstacles to migration that exist in relation to Appendix I bird species: Haliaeetus albicilla is a frequent victim of wind turbines. From 1989 to November birds of this species were found dead struck by a turbine s wing. Anser erythropus is under threat to be shot at wintering sites in the federal state of Mecklenburg-Vorpommern due to misidentification. 3a What actions are being undertaken to overcome these obstacles? Bird conservation aspects shall be taken into account when wind turbines are planned or built. Appropriate instruments of land management and planning are at hand, e.g. environmental impact assessments, databanks on bird occurrence, and regional conservation priorities. However, there still are locations with an unsatisfying application of the available instruments. 3b What assistance, if any, does your country require in order to overcome these obstacles? Foreign assistance is not needed. 4 What actions have been taken to prevent, reduce or control factors that are endangering or are likely to further endanger bird species, including strictly controlling the introduction of, or controlling or eliminating, already introduced exotic species (Article III(4)(c))? Species specific habitat management and conservation programmes are implemented for Appendix I bird species in Germany: Aythya nyroca, Haliaeetus albicilla, Otis tarda, and Acrocephalus paludicola. In Haliaeetus albicilla a campaign is on the way to ban the use of lead shot in hunting, as eagles ingest the poison with carrion and die from it. In Otis tarda the reproductive success is encouraged by a special egg and offspring protection programme in Brandenburg. In Anser erythropus a German NGO is planning an international reintroduction project. 4a Describe any factors that may limit action being taken in this regard: The legal status of Haliaeetus albicilla and Otis tarda, which are under the hunting law in Germany, sometimes is a problem for nature conservationists as they are not authorized to take dead or injured birds of huntable species. In many locations conservation actions are also limited by financial restrictions and the number of people prepared to work in the fields on a voluntary basis. The Anser erythropus reintroduction project suffers from a lack of funds and international support. 4b What assistance, if any, does your country require to overcome these factors? Resolution 6.3 Southern Hemisphere Albatross Conservation: Resolution 7.2 Impact Assessment and Migratory Species: Resolution 7.3 Oil Pollution and Migratory Species: The German Wadden Sea area was declared as a Particularly Sensitive Sea Area in October 2002, being part of the first PSSA in Europe adopted by IMO. In 2003/2004 Germany also proposed its Baltic Sea waters to be declared as a PSSA. Resolution 7.4 Electrocution of Migratory Birds: The new Federal Nature Conservation Act from March 25 th, 2002, states in Article 53: To protect bird species, all newly constructed power poles and technical components of medium-voltage power lines shall be designed in such a way that birds are protected from electrocution. On existing power poles and technical components of medium-voltage power lines that pose a high risk to birds, the necessary measures to protect birds against electrocution shall be implemented within a period of ten years. The first and second sentences above shall not apply to the overhead power lines of the railways. Resolution 7.5 Wind Turbines and Migratory Species: A review by the German NGO NABU was funded to investigate the impact of wind turbines on birds and bats. The results highlight the most affected species and dangerous situations. Research was funded to evaluate the impacts of off-shore wind turbines on marine mammals, migratory birds and fish. In many cases environmental impact assessments were done within the process of local planning and erection of wind turbines.
