1 Mercosur/LX SGT Nº 3/P.. 03/17 MERCOSUR TECHNICAL REGULATION ON LABELLING OF PRODUCTS TEXTILES (REPEAL OF RES. GMC NO 33/07) HAVING REGARD TO: The Treaty of Asunción, the Ouro Preto Protocol and Resolutions Nos 38/98, 56/02 and 33/07 of the Common Market Group. WHEREAS: That is important for States Parties to have a harmonised Technical Regulation on textile labelling with a view to facilitate the free trade. The benefit that the Technical Regulation gives consumers a tool that ensures a clear and accurate identification of the composition of textile products, the dimensions and weight of tissues and Title of yarns, as well as the features of processing, cleaning and maintenance of textile products throughout their lifetime. The need for revision of GMC Resolution No 33/07 approving the Technical Regulation on the Labelling of Textile MERCOSUR in order to conform to the development of technological developments and new international rules in this area. THE GROUP COMÚNRESUELVE MARKET: Art. 1 The Mercosur Technical Regulation on the Labelling of Textile Products, which is annexed to and forming a part of this Resolution. Art. 2 This Resolution shall apply throughout the territory of the Member States, to trade between them and to imports from outside the area. Art. 3 The Member States shall designate in the scope of Work Subgroup No 3 Technical Regulations and Conformity Assessment ) (Sub-Working Group 3, the national bodies competent for implementation of this Resolution. Art. 4 Repeal GMC Resolution No 33/07. Art. 5 This Resolution must be incorporated into the legal order of the Member States before del//. 2 TEXTILES CHAPTER I GENERAL CONSIDERATIONS 1. For the purposes of this Technical Regulation, defined as a textile product which is exclusively composed of textile fibres or filament textile or by both raw, semi-worked, worked, semi-manufactured or manufactured or semi-manufactured, made-up or semiconfeccionado Other items also deemed to be textile product with 80 % of its mass at least consist of textile or textile fibres or by both. 2. Textile products of national origin or foreign intended for marketing must submit the following information: a) Name or business name or registered trade mark from the competent body in the country of consumption and tax identification number of the domestic producer or importer, or who imposes its exclusive trade mark or trade name, or of the person who holds a licence to use a trade mark, as the case may be. CHAPTER III THE NAME OF THE TEXTILE FIBRES AND FILAMENTS TEXTILES 4. Textile fibre or filament textile is any material of plant, animal or mineral origin and any artificial or synthetic material, with a high ratio of length and diameter, and furthermore, owing to its characteristics of elasticity, flexibility, softness, strength, perseverance and fineness is suitable for textile applications. 4.1 The generic names of textile fibres, textile fibres and their descriptions accepted are listed in Annex A of this Technical Regulation. 2

3 CHAPTER IV THE WORDING OF THE COMPOSITION 5. The generic name of the textile fibres or filament textile or both go hand-in-hand with its percentage of participation, 100 % in mass of the textile product, apart from the percentage referred to in paragraph 10. Any textile product composed of two or more fibres, textiles or textile fibres or both, none of them reaches 85 % of the total mass, shall be designated by the name of each of the textile fibres or filament textile or both, and of its percentage by mass. 9.1 Participation of a textile fibre or filament textile, or each of the textile fibres or of artificial textile a set is lower than 15 % in the product, such textile fibre or filament textile as a whole may be called, according with the expression Density or OR OTHER FIBRES. 10. The composition of textile products composed of two or more textile fibres (o) textile fibres, where one of them represent at least 85 % of the total weight, may be designated by: a) The name of the textile fibre or filament textile, with its percentage of participation; b) The name of the textile fibre or filament textile, with the text at least 85 %. 3

4 10.1. In the case of sub-paragraphs (a) and (b) of paragraph 10, shall not be declared a lower tolerance. 11. 5 b) For agents, stabilisers, auxiliary products and other dyeing and printing processes used in the processing and finishing of textile products. CHAPTER VI INFORMATION ON THE PRODUCT 16. Two or more textile products having the same information and forming a set constituting a single unit of sale and can only be sold as such, may indicate the mandatory information in one of the parties. 17. The mandatory information must be accurate and may be given via labels, stamps, posters, decals, stamps, stamped or similar (hereinafter the means ). If a trade mark, trade name or fancy name is a generic name of the textile fibres or 5

CHAPTER VII CARE TREATMENTS FOR THE CONSERVATION 23. The information on the treatments of care for the conservation is mandatory. This is achieved by the following processes: washing, bleaching, drying and ironing and textile care work, which shall be informed in the sequence described The use of codes for labelling of conservation by means of symbols described in ISO standard NM 3758: 2013 shall respect the correct sequence and take into account: a) The sequence described may be presented horizontally on one or more routes or in a single column. b) If all the main processes of conservation were indicated as not allowed should be informed in disposable product. c) If the washing process is indicated as not allowed should indicate the corresponding professional cleaning process (dry or moist). d) If the drying process in the drum is indicated as not allowed must indicate one or more symbols corresponding natural drying. e) If the possibility of drying drum may be mentioned in addition one or more symbols of natural drying Where to find information on care treatments for the conservation by means of symbols and text, each text shall be the corresponding symbol shown. 24. Textile products containing details such as embroidery, applications in general, pictures, ribbons or similar, or non-textile parts, may submit additional information concerning these parts separately to the compulsory information product In the event that the product is made up of different parts with regard to their 6

CHAPTER VIII THE LABELLING OF THE PACKAGING 26. Where the packaging is either sealed and the compulsory information contained in the product or in a means placed on the packaging cannot be seen from inside, on the packaging shall indicate at least the textile composition, country of origin, and size or dimension. 28. Products of bed linen, table, kitchen, bathroom and curtains, where already packaged, the information concerning the composition of textiles, the country of origin and the size of each component should be stated on the packaging or it may be used inside the package means any information whenever possible viewing through the package. CHAPTER IX THE LABELLING OF YARNS AND PASAMANERÍAS INTENDED FOR TRADE 29. In the case of sale by instalments, the information required in Chapter II point 3., item c), d) and the width shall be left to the consumer up to the total value of the piece. 34. 9 CHAPTER XII DISPOSICIONES END 38. Are exempt from the requirement to indicate the information provided for by Chapter II textile products listed in Annex B of this Technical Regulation. 39. For this Technical Regulation, the compulsory information concerning measures shall be laid down in the International System of Units (SI). 9
