What We Do Patent Drafting & Prosecution Osha Liang is known for drafting, prosecuting and obtaining patents at the forefront of science and technology. We focus on obtaining patent claims that match our clients business objectives supported by patent specifications providing fallback positions which are both in line with the requirements of different jurisdictions and useful in case of judicial or post-grant proceedings. As engineers and scientists with hands-on work experience in a diverse range of technology areas, our patent professionals are able to manage each client s patent portfolio in a timely and comprehensive manner. Our patent practice covers all technical disciplines and we have filed patent applications in almost every industrialized country in the world. Our prosecution team has extensive experience drafting, prosecuting, defending and opposing patents at the United States Patent and Trademark Office (USPTO) and the European Patent Office (EPO). In addition to our on-the-ground coverage in the United States, China, Japan, and France, we also partner with a carefully-vetted network of counsel located in other key jurisdictions worldwide. Brand Protection Osha Liang s trademark and industrial design specialists have a wide range of experience including availability investigations, global trademark application filings, prosecution and enforcement, and opposition and cancellation actions before the U.S. Trademark Trial and Appeal Board. We assist clients in building design portfolios covering all major commercial markets in the United States, Europe, and Asia, either directly or via brand protection professionals in countries throughout the world. We build cost-effective brand protection covering both the supply chain and consumer products, ensuring that our clients can protect their brands worldwide. We also help clients develop their global domain name strategy and actively patrol for potential infringement by third parties on the Internet. Furthermore, we have represented clients in private negotiations, litigation and domain name proceedings, including costeffective resolution before the Internet Corporation for Assigned Names and Numbers (ICANN) using Uniform Dispute Resolution Procedures (UDRP) and Uniform Rapid Suspension (URS) tools.

Litigation United States. Osha Liang s U.S. Litigation Group handles a wide variety of intellectual property disputes including patent, trademark, copyright, unfair trade practice, and trade secret matters. Our team of experienced litigators has extensive experience representing clients in Federal District Courts across the United States, including the popular Eastern District of Texas, as well as the International Trade Commission (ITC). Our practice frequently includes defending against non-practicing entities, with a high rate of success both in negotiating favorable settlements for our clients early in the litigation process and, where appropriate, mounting an aggressive, substantive defense. In addition to traditional courtroom litigation, we leverage our patent office expertise to provide representation at the Patent Trial and Appeal Board (PTAB), where Osha Liang has handled an ever-growing number of proceedings. From federal trials, to post-grant reviews, to covered business method patent reviews, our litigators have successfully handled virtually every type of intellectual property proceeding. Europe and Asia. Osha Liang s patent litigation experience combined with our knowledge of EPO and USPTO law and case law provide us with a knowledgeable and unique perspective on how best to coordinate litigation support and strategies from a global context. We regularly defend clients patents while also helping clients establish freedom to operate by challenging patents in at the EPO before both the Opposition Divisions and the Boards of Appeal. Our French and European patent attorneys provide litigation support in cooperation with French IP lawyers before the Paris Court. We also assist clients with invalidation proceedings before the Patent Reexamination Board (PRB) of the State Intellectual Property Office (SIPO). We have close, established relationships with a number of litigation firms throughout Europe and Asia to effectively handle multi-jurisdictional issues. Due Diligence Osha Liang s attorneys routinely engage in a variety of strategic IP due diligence activities including substantive review of IP portfolios, analyzing the IP aspects of mergers, acquisitions and divestitures, analyses of license agreements, and providing strategies for ensuring business objectives are fulfilled. In reviewing IP portfolios, our attorneys are particularly experienced in preparing opinions with respect to each IP asset s scope, strength, limitations, validity, and enforceability. Additionally, we are experienced in assessing pending litigation, threatened litigation, or risks of potential litigation as it relates to business objectives.

Copyrights Osha Liang handles complex copyright cases across the country involving architectural designs, technical drawings, music, photography, literary works, computer software, and many other protected works. Whether representing copyright owners or defending those accused of infringement, we pursue these matters aggressively, thus maximizing the chances for non-judicial resolution of the case or, if such resolution is not possible, for the successful litigation of such cases. Particularly in cases where we represent copyright owners, we routinely handle copyright infringement cases on alternative fee bases, including contingency or hybrid fee arrangements. Licensing Osha Liang has extensive experience in patent licensing matters and patent portfolio management. We have a deep knowledge in structuring, drafting and negotiating licenses across the full spectrum of IP assets and across a wide range of industries. Managing Partner Jonathan Osha leads the Licensing Group and is a Certified Licensing Professional TM. IP Counseling Osha Liang s IP Counseling Group assesses and analyzes clients technologies and their IP portfolios to identify both opportunities and roadblocks. U.S. Patent Agent Program Osha Liang s U.S. Patent Agent Program is unique and effective in developing a technically and legally savvy team. We actively recruit science and engineering graduates from top-rated universities to become Patent Engineers. These individuals are apprenticed in the art of patent practice through the use of practical on-thejob training and weekly lectures. Eventually, these Patent Engineers are encouraged to sit for the USPTO registration exam to become licensed patent agents. Under supervision, our Patent Engineers and Patent Agents provide exceptional value to clients in terms of both technical knowledge and cost effectiveness. Many graduates of the program choose to go on to attend local law schools on a part-time basis with tuition assistance provided by the firm.
