TENDER DOCUMENT 2. ELIGIBILITY CRITERIA. 2.1 The tenderer should have successfully completed supply of similar work during the last three years. P r o o f o f t h e s a m e m u s t b e e n c l o s e d i n t h e t e n d e r b i d. 2.2 The company should be Proprietorship or Partnership or registered under Indian Company Act 1956 and relevant documents must be submitted with the bid. 2.3 Tender Fee of Rs. 500 irrespective of No. of sites quoted by Bidder shall be paid in form of Demand Draft 2.4 EMD: An earnest money deposit (EMD) of R s. 38000/- for all sites, For individual sites: Patna: Rs 5000, Agartala: Rs 10000, Gorakhpur: Rs 6500, Aligarh: Rs 8500, Muzaffarpur: Rs 8000 will be submitted by the Tenderer by a Demand Draft in favor of Broadcast Engineering Consultants India Limited payable at New Delhi. The EMD of the successful tenderer shall be returned after completion of work, whereas the EMD of the unsuccessful tenderer shall be returned within 15 days of the finalization of the contractor. PREFACE AND SCOPE OF WORK PREFACE 3.1 BECIL is appointed as System Integrator by Ministry of Information & Broadcasting, Govt. of India for Upgradation /Setting up of Common Transmission Infrastructure (CTI) for Private FM Broadcasters under FM Phase-III Batch-I scheme of Government of India where Prasar Bharti Infrastructure is available. 3. 2 BECIL invites bids from eligible and qualified Bidders for Fabrication and Supply of Horizontal cable tray at CTI Agartala, Aligarh, Gorakhpur, Muzaffarpur, Patna 3.3 List of Items to be executed. All the jobs are to be done so as to complete the system, which includes the following also: 3.4 Supply of suitable (as per attached drawing) clamps for supporting / installing horizontal and vertical cable tray. The rate shall be included with nuts, bolts, washers, spring washers (as per IS :6639 and property class 5.6 of IS:1367). Note:- Any discrepancy/dispute regarding scope of work will be decided by BECIL. That shall be binding on the Contractor. 3.5 The joint measurements of work shall b e d o n e b y t h e C o n t r a c t o r o r B E C I L authorized representative. 4. GENERAL CONDITIONS OF CONTRACT 4.1 The Competent Authority does not bind himself to accept the lowest or any other tender and reserves to himself the authority to reject any or all of the tenders received without the assignment of any reason.all Tenders in which any of the prescribed conditions are not fulfilled or are incomplete in any respect are liable to be rejected. 4.2 The contractor's rates must include the cost of Transportation & Packaging of material to the site. 4.3 Any defect developed within Defect Liability Period of one year from the date of virtual completion will have to be rectified by the Contractor at his own cost. 4.4 The Contractor shall not be entitled to any compensation for any loss suffered by him on account of any delay in commencing or executing the work, whatsoever is the cause for such delays. 4.5 After acceptance of our Order the tenderer shall submit the orde r acceptance in their letter head within 3 working days. In any case of delay BECIL has the right to hold bidder s Earnest Money and cancel his order.
4.6 No extension of time will be allowed to the contractor due to weather conditions prevalent in the area. The contractor is expected to take all the precautions at his own cost so that the workmanship and the materials are not affected in the inclement weather. 4.7 The work as described in the Contract, drawings & specification shall be completed within 3 weeks from the date award of work. 4.8 SAMPLES: BECIL will approve samples with reasonable promptness for being in conformity with the design concept of the project and for being in confirmation in the contract document. The work shall be carried out in accordance with the approved samples and Shop drawings. 4.9 INSPECTION: The contractor shall furnish promptly without additional charges all reasonable facilities and labor necessary for the safe and convenient inspection and test that may be required BECIL. 4.10 TESTING OF WORK: As and when required by the Principal, Contractor shall organize inspection of works at his cost to prove their soundness and efficiency. If after tests any work or portions of work are considered defective or unsound by the Principal, the Contractor shall remove the defective work from the site, or pull down and re-execute the works at his own cost to the satisfaction of Principal. 4.11 TERMINATION OF CONTRACT If the contractor is found faulting at any instance of the period of execution of project by his misdeeds or conduct OR attitude towards work in terms of deviation from specifications and drawings, the contract will be terminated without assigning any reason. All decisions will be taken at the discretion of BECIL and contractor will not have any legal binding on the contract. 4.12 ARBITRATION AND JURISIDICTION The CMD BECIL reserves to himself the right of accepting the whole or any part of the tender and the tenderer shall be bound to perform the same at the rate quoted. In case of any dispute, the Principal shall appoint in consultation and agreement with the Contractors, an Architect of repute in Delhi( India) as Arbitrator whose decision shall be final and binding on both the parties i.e the Principal and the Contractors However, the jurisdiction of only the Delhi High Court shall be accepted incase a reference of dispute is made to a court.
