The US is the largest market for the life sciences industry today while India is one of the fastest growing markets in the world. In this context, this seminar aims to inform the audience on patent protection of life sciences inventions in the US and India. Harvard Oncomouse have emerged, debates on Life-form patenting have remained stormy. Newer developments in GM brinjal, cloning, stem cell therapy have only added fuel to the fire. A comparative critique of Indian, US and European patent laws with regard to the statutory provisions and emerging judicial precedence are dealt with. 11.30-12.30 Talk: Life Science Patent Protection and Patent Ownership in the U.S by, Dr. Nathan Letts Abstract: Dr. Nathan Letts, a PhD organic chemist and experienced patent attorney visiting from the United States, will discuss recent life science patent cases. Specifically, Dr. Letts will give a seminar on patent protection for pharmaceuticals, biotechnology, and diagnostics under current laws. One case, Stanford v. Roche, regards ownership of Federally-funded inventions and the Bayh-Dole Act under review by the Supreme Court. Another case he will discuss is the Court of Appeals for the Federal Circuit (CAFC) decision, Prometheus v. Mayo, about patent protection for a diagnostic method for monitoring drug treatment. Lastly, he will discuss a case currently under review by the CAFC related to genes associated with breast and ovarian cancer BRCA1/2, American Association of Molecular Pathologists et al. v. Myriad and the US Patent and Trademark Office. The Myriad case has received a great deal of attention because it has the potential to dramatically change the U.S. law on biotechnology patents such as Amgen s erythropoietin patents. 12.30-12.45 Discussion and closure FACULTY Dr. GopaKumar Nair Dr. Gopakumar Nair, heads his own IP boutique firm, Gopakumar Nair Associates and is also CEO of Patent Gurukul, reputed and well-known training centre for Patents Profile: 40 years in Pharma Industry as Director, Managing Director & Chairman of various public limited pharma companies, Dr.Nair has also served Industry Associations for more

than 25 years in various capacities, latest as President of Indian Drug Manufacturers Association (IDMA), during 1999-2000. Presently Dr. Nair is Consultant to Pharmexcil on IPR and was also a Consultant to NAARM (ICAR) on P.G. Diploma in Intellectual Property & Technology Management in Agriculture. He was also Advisor to Bulk Drug Manufacturers Association (BDMA) and is currently Advisor/Consultant to nearly 15 Pharma/Biotech/Agrotech companies. Dr. Nair is also Editor, Assistant Editor, Editorial Board Member of various publications and journals, relating to pharma, biotech and chemicals. In the field of Intellectual Properties, Dr.Nair was the Dean of Institute of Intellectual Property Studies (IIPS) at Hyderabad, India. Presently he heads his own IP boutique firm, Gopakumar Nair Associates and is also CEO of Patent Gurukul, reputed and well-known training centre for Patents. Dr. Nair is a Ph.D from National Chemical Laboratory (NCL), Pune and has Diploma in Management & Patent Law. Dr. Nair is also a Law (LL.B) graduate from Mumbai University. Dr. Nathan Letts Dr. Nathan Letts is working as Counsel at The Eclipse Group in North Carolina.
