UNOFFICIAL MINUTES DONIPHAN COUNTY COURTHOUSE, TROY, KANSAS, FEBRUARY 12, 2018 The Board of County Commissioners met in regular session at 8:30 o clock A.M. with Second District County Commissioner Thad G. Geiger, Chairman, calling the meeting to order. First District County Commissioner Timothy D. Collins and County Clerk Peggy Franken were present. Third District County Commissioner Jerry P. McKernan and County Attorney Charles D. Baskins were present for a portion of the meeting. The Kansas Chief Reporter Paul Stewart and Susan Studer observed the entire meeting. Commissioner Geiger made a motion, seconded by Commissioner Collins, to approve the meeting agenda as amended to include discussion on county van repairs, Economic Development Director update and Noxious Weed 2018 KDOT Contract. Motion carried. Commissioner Collins made a motion, seconded by Commissioner Geiger, to approve county commission minutes of the January 29, 2018 regular meeting as written. Motion carried. Commissioner Collins made a motion, seconded by Commissioner McKernan, to approve abated taxes to the 2017 tax roll in the amount of $8.64. Motion carried. Commissioner Geiger made a motion, seconded by Commissioner Collins, to approve payroll and warrants for the period February 15, 2018 as presented. Motion carried. Fee reports for the month of January were presented on behalf of the County Clerk, Register of Deeds and Sheriff for the Boards review. Currently there are 14 local and 5 Atchison County inmates housed in the Doniphan County Law Enforcement Center. In observation of President s Day, February 19, 2018, the Board of County Commissioners will not hold a regular weekly meeting. County Clerk Peggy Franken presented sale tax collections in the amount of $67,727.18 and January 2018 departmental budget and expense report to the Board for their review. Noxious Weed Director Francis Hubbard reviewed the 2018 Kansas Department of Transportation agreement to treat noxious weeds along State Rights-of-Way with the County Commission. Said agreement calls for reimbursement of services at a rate of $25.00 per hour for labor and $30.00 per hour for equipment usage. Commissioner Collins made a motion, seconded by Commissioner McKernan, to execute the 2018 agreement as presented. Motion carried. Noxious Weed Director Hubbard informed the County Board of the annual Noxious Weed Directors conference March 5-9, 2018. In addition, Director Hubbard will place an employment advertisement for part-time sprayer position. Commissioner Geiger made a motion, seconded by Commissioner Collins, to approve budgeted transfer of $150,000.00 from Road and Bridge fund to Equipment Reserve fund. Motion carried.

County Appraiser Danielle Kiefer told the County Board there is an internal fault issue with the diagnostic control module on the 2010 Chrysler Town & Country minivan used by various county departments. The Board requested Appraiser Kiefer obtain a cost estimate from J&G Auto Repair to replace the control module and also provide them with the value of the vehicle to determine if repairs exceed the value of the van. Zoning Coordinator Julie Meng presented the Board of County Commission with recommendation on behalf of the Doniphan County Planning Commission to change zoning for property owned by Evean Benitz, dba Kansas Riverbend Properties, LLC, located at 926 Sheridan Road, Wathena, Kansas, from A-1 Agriculture to A-1 Agriculture with Conditional Use for operation of small vehicle lot. Commissioner McKernan made a motion, seconded by Commissioner Collins, to accept the recommendation of the Doniphan County Regional Planning Commission and change zoning from A-1 Agriculture to A-1 Agriculture with Conditional Use for property owner Evean Benitz, 926 Sheridan Road, Wathena, Kansas. Motion carried. Emergency Management/Zoning Coordinator Julie Meng, who also serves as the ADA Coordinator, told the County Commission she will be obtaining a cost estimate to replace the metal ramp on the handicap accessible lift. Economic Development Director Adrienne Korson updated the Board of County Commissioners on the Strategic Plan Committee meeting, Doniphan County Job Fair to be held April 13, 2018 and media exposure through Rainbow Communications and area radio stations. The Doniphan County Strategic Plan Committee will meet with the Board of County Commissioners on Tuesday, March 13, 2018 at 9:30 A.M. to review results of the Doniphan County Strategic Plan survey and set future goals. Commissioner Collins made a motion, seconded by Commissioner Geiger, to approve Kansas Economic Development Alliance membership dues in the amount of $300.00. Motion carried. At 9:10 A.M. Commissioner Collins made a motion, seconded by Commissioner Geiger, to enter into executive session for a period of 15-minutes for the purpose of discussing and protecting the interest of non-elect personnel within the Economic Development Department. Motion carried. The County Clerk and Economic Development Director remained. The meeting reconvened at 9:25 A.M. with no action taken. Road Secretary Lindsay Norris presented the Board of County Commissioners with a supplemental agreement between the Kansas Department of Transportation and Doniphan County for participation in the Federal Fund Exchange Program at a rate of 75% on the dollar. Doniphan County will receive $89,121.61 in Federal Fund Exchange dollars for 2018. Chairman Geiger executed the supplemental agreement between the Kansas Department of Transportation and Doniphan County for participation in the Federal Fund Exchange Program. Road Secretary Norris reported final repair costs to the clutch on the 2005 Mack dump truck by Westfall were $8,840.50. Commissioner Geiger suggested the County make a conscience effort in the future to not purchase Mack equipment based on the high cost of repairs and lack of local mechanics to service.

Commissioner Geiger made a motion, seconded by Commissioner Collins, to approve payment to Highland Hardware in the amount of $412.11 for miscellaneous supplies for the Road Department. Motion carried. Lindsay Norris, Road Secretary, informed the County Commission of correspondence from the US Army Corp of Engineers regarding Monument Road repairs. Road Foreman Danny Adkins reports the roadway has dropped off another foot since August 2017. It was the consensus of the Board of County Commissioners to have the Second District Road Department stabilize the roadway and contact the US Army Corp of Engineers for a future plan of action to keep the roadway from dropping off due to being undercut by the Missouri River current. Road Secretary Norris is obtaining bids to replace the roof and guttering on the Third District Road Shop building. Norris reported dump truck safety training will be held February 23, 2018 at 7:00 A.M. and she will be working with KCAMP to hold a motor grader training with participants from the Atchison County Road Department. Road Secretary Lindsay Norris presented the Board with Township road improvement fund balances and Road and Bridge expenditures for the period of January 31, 2018. Whetrock rock price list for 2018 and number of hours on the County owned excavators from date of purchase were also presented to the Board for their review. Road Supervisor Bob Edie informed the County Commission he obtained approval from the Commissioners during the week of February 5, 2018 to begin hauling chat from Hamm s Quarry in Cummings, Kansas at a rate of $14.75 per ton with 6,000 ton of chat to be hauled for County chip seal projects. Commissioner Collins made a motion, seconded by Commissioner McKernan, to approve the purchase of 6,000 ton of chat from Hamm s Quarry at a rate of $14.75 per ton. Motion carried. Supervisor Edie asked the Board of County Commissioners about entering into a two year agreement with Hamm s Quarry for the purchase of chat. Chairman Geiger told Supervisor Edie a contract laying out the terms of a multi-year purchase agreement would need to be submitted to the Board by Hamm s Quarry for their consideration prior to taking action. Chairman Geiger asked the Board of County Commissioners and Road Supervisor Edie to use caution with future purchases as to not violate the Doniphan County Purchasing Policy or Kansas Open Meeting Act. Road Supervisor Bob Edie presented the Board with bids for the purchase of 26 tires for the First District Road Department and 27 tires for the Second and Third District Road Departments as follows: Consumers Oil & Propane $10,056.72 (First District) $ 8,866.11 (Second/Third Districts) Campbell Oil Company $ 9,747.36 (First District) Neumann Services $ 8,567.74 (Second/Third Districts) $ 9,747.36 (First District) $ 8,567.74 (Second/Third Districts) Commissioner Geiger made a motion to accept the bid of Campbell Oil Company for the purchase of tires for the First District in the amount of $9,747.36 and Neumann Services for the purchase of tires for the Second/Third Districts in the amount of $8,567.74 plus an additional four

tires in the Second District in the amount of $496.94 each. Commissioner Collins seconded the motion and it carried. Road Supervisor Bob Edie said he was approached by landowners along Elgin and 210 th Roads about taking out the curve and straightening the roadway. County Attorney Charles Baskins advised the property owners would be responsible for all legal work involved in altering the roadway, once it is determined by the Road Department the true origin of the road. Discussion was held in regard to replacing the excavators in the First and Second Districts. Road Secretary Lindsay Norris reported the 1993 Komatsu PC200 excavator in the First District has been used 5,432 hours over the 16 year period the County has owned it. The Second District 2000 Komatsu PC200LC, which was a total loss due to damage, had been used 3,600 hours over a 16 year period. Commissioner Geiger inquired if two machines are needed or the County could get by with one machine used between all three road districts. Supervisor Edie said with emergency road repair work and only being able to use the equipment during favorable weather conditions, there is a need for two excavators. In addition, Commissioner Collins indicated excavators now replace the use of dozers on some projects. Commissioner McKernan asked about using one employee to operate one excavator all year to complete county projects. Road Supervisor Edie said it takes several employees to complete a project where excavation work is involved. Road Supervisor Bob Edie presented the Board of County Commissioners with price quotes for the purchase of two excavators for use by the Road Department. Commissioner Collins made a motion to purchase a 2014 Komatsu PC210LC-10 with 2099 hours from Berry Tractor in the amount of $139,000.00 less trade of the 1993 Komatsu PC200 excavator in the amount of $19,940.00 for a total purchase price of $119,060.00. And to purchase a 2012 Hyundai R250LC9 excavator with 2200 hours from Victor L. Phillips in the amount of $109,773.00 less insurance payment in the amount of $44,500.00 from KCAMP for loss of the 2000 Komatsu PC200LC excavator in the Second District, with payment to be made from the Equipment Reserve fund. Commissioner McKernan seconded the motion and it carried. Road Supervisor Bob Edie said operators would be required to receive formal training in order to run the newly acquired excavators. At 10:36 A.M. Commissioner Collins made a motion to enter into executive session for a period of 15-minutes for the purpose of discussing and protecting the interest of non-elect personnel in the Road Department. Commissioner McKernan seconded the motion and it carried. The Road Supervisor remained. Commissioner Jerry McKernan left the meeting at 10:46 A.M. The meeting reconvened at 10:51 A.M. with no action taken. Commissioner Geiger requested the County Clerk add to the February 26, 2018 County Commission meeting agenda an item setting a concrete date for the Board of County Commissioners to hold a work session to re-evaluate the management structure, rate and personnel policies of the Road Department. During public comment, Susan Studer asked the Board of County Commissioners to re-evaluate the use excavators at the end of 2018 to determine if usage warrants purchasing versus renting equipment. Mrs. Studer asked how many tubes are slated to be installed in 2018 in the Road

Department. Commissioner Geiger said no list of tube projects is currently available but tubes for projects have been purchased and are on hand. There being no further business before the Board, Commissioner Geiger made a motion to adjourn at 10:59 A.M. Commissioner Collins seconded the motion. DATED THIS 12TH DAY OF FEBRUARY 2018.
