BARRISTER - AT - LAW of DES VOEUX CHAMBERS CHARTERED ARBITRATOR CHARTERED QUANTITY SURVEYOR (NON PRACTISING) Arbitration / ADR Outside court litigation Mr. Houghton has over 20 years of experience as a dispute neutral, primarily as arbitrator (sole and tribunal member), with over 130 appointments having been accepted, and many awards rendered in a wide range of disputes. Matters in issue have included various commercial disputes including insurance disputes, professional negligence, breaches of licence agreements and deeds of trust, international sale of goods as well as a wide range of construction, engineering, dredging and other infrastructure related disputes. In the last three years, arbitration appointments have involved several construction and quarrying contracts in Hong Kong, Dubai and Qatar; sales of goods disputes between Thai and Nepali parties and between Australian and Indian parties; construction works in Malaysia; licensing agreements in India; dredging works (also in India); and roadworks in Hong Kong and the Philippines. Procedurally arbitrations have been conducted under a variety of Rules, including those of HKIAC, ICC, CIETAC, DIAC, the Thai Arbitration Institute, UNCITRAL and the KCAB. Several disputes have been ad-hoc, without the adoption of sets of rules. Evidence has been taken and various hearings conducted in jurisdictions including (alphabetically) Dubai, England, India, Nepal, Singapore, and Thailand, as well as China and Hong Kong. Mr. Houghton is a panel member of many institutional, regional and international bodies including bodies in Hong Kong, China, Singapore, Malaysia, the Philippines, Korea and Dubai. Appointments have also been accepted to act, as an Adjudicator on contractual /ad-hoc adjudications, and as a Mediator, on both domestic and international disputes. This practice encompasses a broad variety of civil and commercial litigation, but with a particular emphasis on construction and engineering litigation and arbitration. Appearances as counsel have been required locally and internationally before arbitrators, and in courts in Hong Kong at all levels, and in several specialist lists. Advisory work in relation to disputes of many types has frequently been undertaken, and also in regard to standard form construction contract drafting for a number of clients. As a fractional appointee with the University of Hong Kong from 1991 to 1993, Mr. Houghton was responsible for organizing and, (in part) teaching the "Property and Construction Law" element of the BSc (Surveying) degree in the Department of Surveying. Judicial Mr. Houghton was appointed as a Recorder of the Court of First Instance of the High Court of Hong Kong in March 2013 (having previously been appointed as a Deputy Judge on various occasions) and these duties involve him sitting as a judge in that Court for one month each year. Other Mr. Houghton is the Chairman of the Deposit Protection Appeals Tribunal, established under the Deposit Protection Scheme Ordinance. ADR Committees and Training Mr. Houghton is a Trustee of the Chartered Institute of Arbitrators, representing the East Asia region. He is an approved tutor and course director for the Chartered Institute and a former Chairman of the East Asia Branch. He became a Council Member at the Hong Kong International Arbitration Centre in 2016, having served on its Appointments Committee since 2014. Assistance has been given in the running of many educational and training courses for arbitration in China and Hong Kong, and in Dubai, Indonesia, Japan, Malaysia, Mongolia, The Philippines, Singapore, Taiwan and Thailand. Tutoring has also been undertaken for the Hong Kong University and City University Master s degree courses. Mr. Houghton was a member of the Departmental Working Group which was responsible for the implementation of the Report of the Committee on HK Arbitration Law and the drafting of the new Arbitration Ordinance. Quantity Surveying Employed in private practice in Liverpool, London and (from 1981) as a Senior Quantity Surveyor / Associate of two professional practices in Hong Kong, engaged in a variety of construction and engineering projects in United Kingdom, Hong Kong and the East Asia region. Experience with these firms included periods of secondment to Singapore (4 months) and Indonesia (2 months), and the provision of contractual advice to various offices within the Asian region as manager of the Legal Support Group. Hong Kong Arbitration Experience Appointments in excess of 130 cases in Hong Kong, the majority of which have been as sole arbitrator on construction and engineering disputes.
