REQUEST Consideration of a Preliminary Plat application for the Whisper Rock Plat "C" subdivision located at 190 North 1100 West in the PRD-1 Zone and amendments to the development agreement. BACKGROUND AND PROJECT DESCRIPTION The subject property is approximately acres in size. In 2009, the City approved a development agreement for the Whisper Rock subdivision project and applied a Planned Residential Development (PRD-1) zoning to the property. The original development agreement and development plan included the following: 58 residential pad sites with the use of TDRs; Required a minimum main level square footage of 1200 square feet; A trail system; A central park; and A clubhouse and swimming pool. In 2014, the City Council approved amendments to the development agreement with the following changes: Eliminate the trail around the perimeter (interior trails still proposed); Eliminate the swimming pool; and Reduce the size and scope of the clubhouse. Two phases consisting of a total of 16 lots have been built. On August 5, 2014 the City Council approved Plat C, which included the last 42 lots of the development. However, this plat approval has not yet been recorded and has expired. The property is now under new ownership and the owner is proposing the following: Divide the final 42 lots into two phases (plats C and D ); Preliminary plat approval for plat C consisting of 22 of the remaining 42 lots; Construct the park with a covered pavilion, picnic area, tot lot and sports court; Eliminate the requirement for a clubhouse (replaced by the pavilion); Allow the minimum main floor square footage to be as small as 1,000 square feet for two-story units (the PRD-1 zone already allows this, but the development agreement states a min. size of 1,200 square feet); Provision of off-street parking; and Reinstatement of the perimeter trail.

2 Planning Commission Staff Report September 28, 2017 EVALUATION PRD-1 Zone: Mapleton City Code (MCC) Chapter states the following purposes for the PRD-1 zone, which was adopted specifically for this project: A. The purpose of this chapter is to create diverse, quality housing in the city, while also providing a buffer from anticipated commercial development along the state road corridor (Highway 89) and adjacent lower residential uses. B. The purpose of this chapter is accomplished by: 1. Allowing densities higher than a typical residential development; 2. Establishing standards for landscaping, building and site design, public safety, parking, aesthetics, traffic circulation, fencing, lighting, and other similar site improvements; and 3. Requiring standards that enable the PRD-1 to fit into the surrounding neighborhoods. The proposed project is still consistent with these purposes and is consistent with the PRD-1 zone. Development Agreement: The development agreement allows for a maximum of 58 lots. The applicant is not proposing any changes to the density or the configuration of the roads or general lot layout. The applicant is requesting to replace the previously required clubhouse with a park pavilion. The applicant s position is that the pavilion will be easier and more cost effective to maintain by the H.O.A. and will probably get more use. Staff is supportive of this change. The applicant is proposing that the requirement for the perimeter trail that was removed in 2014 be reinstated. The applicant would then construct the trail system as the project develops out. Staff is also supportive of this request. Finally, the applicant is requesting that the minimum main level floor area for two story structures be reduced from 1200 square feet to 1000 square feet. The PRD-1 zone already allows for a minimum of 1,000 square feet for two story structures, but the development agreement does not. The applicant s request will ensure that the PRD-1 zone and the development agreement are consistent. Staff is supportive of this request. Subdivision Review Criteria: MCC Chapter B outlines the review standards that shall be used by the City in making its determination. These standards are shown in attachment 1. The proposed project complies with these standards. Parking: One concern that has been raised during previous hearings regarding this project is the lack of off-street parking. With the narrow road width of the subdivision, cars are sometimes parked outside of the development on 1100 West. The plans included with this staff report show eleven offstreet parking spaces that will be provided to help address this issue. The applicant has also committed to provide some additional spaces not shown on the current plans. This will be addressed at the meeting. Page 2

3 Planning Commission Staff Report September 28, 2017 Street Connectivity: Another concern that has been addressed during previous meetings is the lack of a second point of vehicle access. Please note, this issue has been decided by the Council and is not open for continued discussion. The development agreement commits the City to the subdivision and road design. STAFF RECCOMENDATION Recommend approval of the preliminary plat and development agreement amendments to the City Council with special conditions. SPECIAL CONDITIONS 1. The applicant shall address all outstanding items found in the DRC comments attached to this report. Page 3

There are not natural or manmade conditions existing on the site or in the vicinity of the site defined in the preliminary plan that, without remediation, would render part or all of the property unsuitable for development. 5. The project provides for safe and convenient traffic circulation and road access to adjacent properties under all weather conditions. 6. The project does not impose an undue financial burden on the City. 7. The location and arrangement of the lots, roads, easements and other elements of the subdivision contemplated by the project are consistent with the city's general street map and other applicable elements of the general plan. 8. The project plan recognizes and accommodates the existing natural conditions. 9. The public facilities, including public utility systems serving the area are adequate to serve the proposed development. 10. The project conforms to the intent of the Subdivision Ordinance as described MCC Chapter
