Impose controls on your company s exports of technology, know how and goods Impose controls on U.S. origin goods/components and technology that you use Financial exposure if you don t comply Non-compliance could have adverse impact on your company s reputation in Canada and abroad and with governments Products with cryptographic capabilities may be barred from further export until the necessary permits are secured Jeopardizing important transactions parties doing due diligence for mergers, acquisitions or financings will discover and not want to be liable for the lack of compliance Brenda C. 13 Canada s Export Control Regime Groups 2 munitions generally problematic Canada closely controls exports of military goods and technology Canada uses the definition of military good found in the International Munitions List Harmonization of US Munitions List and ECL These are goods that are agreed to be specially designed or modified for military use. 26 Controls On Export of Technology In the public domain means technology that has been made available without restrictions upon its further dissemination (copyright restrictions do not remove technology form being in the pubic domain) basic scientific research is experimental or theoretical work undertaken principally to acquire new knowledge of the fundamental principles or phenomena or observable facts, not primarily directed towards a specific practical aim or objective Brenda C. 28 Controls on Exports of Technology Many software products having nothing to do with computer security are subject to export controls Virtually any product using cryptography (including encryption and decryption) Brenda C. 29 Controls on Exports of Technology Information Security (Cat. 5, Part 2): includes products which incorporate cryptographic elements low encryption strengths (ECL 1-5.A.2 (1)(a) & (b)) A symmetric algorithm employing a key length in excess of 56 bits An asymmetric algorithm where the security of the algorithm is based on any of the following: Factorisation of integers in excess of 512 bits Computation of discrete logarithms in a multiplicative group of a finite field of size greater than 512 bits Discrete logarithms in a group other than those mentioned above in excess of 112 bits key lengths are very low, meaning that almost any product that provides a reasonable level of security will require an export permit Brenda C. 31 Controls on Exports of Technology Open Source Exception permit is not required if the software containing the cryptographic function is in the public domain does not apply where open source software is combined with proprietary software i.e. open source cryptographic program (OpenSSL, etc ) integrated as security feature in or linked into company s proprietary software Brenda C. 32 Controls on Exports of Technology Programmers are often not aware of all the cryptographic functionality included in the third party code they use in writing their programs yet the company will be liable if export control requirements are not met Brenda C. 34 Controls on Exports of Technology Equipment where the cryptographic capability is not user-accessible and which is specially designed and limited to: Execution of copy-protected software Limiting access to copy-protected contents stored on read-only media Limiting access to information stored in encrypted form on media (e.g. for IPR protection) when the media is offered for sale in identical sets to the public Copying control of copyrighted protected audio/video data Encryption and/or decryption for protection of libraries, design attributed, or associate data for the design of semiconductor devices or integrated circuits Brenda C. 35 Controls on Exports of Technology Portable or mobile radiotelephones for civil use (e.g. for use with commercial civil cellular radio communications systems) that are not capable of end-to-end encryption Cordless telephone equipment not capable of end-to-end encryption where the maximum effective range of unboosted cordless operation is less than 400 meters according to the manufacturer s specifications Brenda C. 40 Controls on Exports of Technology Application of US Export Controls to Canadian Cryptographic software and technology requires a US export license to be re-exported from a foreign country to another foreign destination or person, if the item was: produced or originated in the US worked on by an American person made outside the US but contains more than a certain percentage of US controlled content made outside the US, but based on certain US-origin technology or software; or made outside the US by a plant (or major component of a plant) that is the direct product of certain US-origin technology or software Brenda C.
