1 RESTRICTED COM.TEX/SB/25 27 September 1974 GENERAL AGREEMENT ON TARIFFS AND TRADE Special Distribution Textiles Surveillance Body Original: Spanish ARRANGEMENT REGARDING INTERNATIONAL TRADE IN TEXTILES Notifications Under Article 2, Paragraph 1 Attached is a notification received by the TSB from SPAIN in accordance with paragraph 1 of Article 2 of the Textiles Arrangement. As required by the provisions of this paragraph the TSB is circulating this notification to participating countries in the Arrangement for their information. A summary tabulation of this notification prepared by the secretariat is also attached. It is to be noted that the TSB, in tho light of paragraph 11 of COM.TEX/2, is continuing to examine tho notifications received in order to ensure the completeness and adequacy of the information, and is requesting the supply of additional information wherever necessary. Any additional information thus received will also be circulated. It is, of course, open to any party to the Arrangement to request the TSB or the secretariat to seek any further information or clarification they may wish to have from the parties concerned, or to supply any additional information of relevance. Such information will also be circulated.

2 COM.TEX/SB/25 Page 2 Letter No.1 3 April 1974 In accordance with instructions from my Government and pursuant to the provisions of Article 2, paragraph 1, of the Arrangemnet Regarding International Trade in Textiles, of 20 December 1973, I have the honour to transmit to you the lists oftextile products the import of which into Spain is subject to quantitative measures. The lists are as follows: (1) Textile products not liberalised for import into Spain nor subject to global import quotas. (2) Textile products the import of which into Spain is subject to the régime of global import quotas. (3) Textile products subject in Spain to the régime of global import quotas but which are liberalized de facto, for temporary and conjunctural reasons. Before 11 May next I shall have the honour to send you a supplementary notification concerning the special regime for the import into Spain of certain textile products from Japan, the terms of which are at present the subject of informal consultations between the Japanese and Spanish authorities. Later, I hope to send you quantitative data concerning the restrictions referred to in the annexed lists. Technical difficulties, and the fact that customs statistics for the whole of the year 1973 are not yet available, make it impossible to provide this information now. May I ask you kindly to transmit the annexed lists, together with the above information, to the Chairman of the Textiles Surveillance Body.

May I request you kindly to transmit the enclosed note to the Chairman of the Textiles Surveillance Body.

9 (Enclosure to letter No. 2) NOTIFICATION CONCERNING SPANISH IMPORT RESTRICTIONS ON TEXTILE PRODUCTS FROM JAPAN COM.TEX/SB/25 Page 9 In addition to the quantitative restrictions already communicated to the GATT secretariat, Spain maintains a special régime on impors of textile products from Japan, in pursuance of the trade agreement signed between Japan and Spain on 22 February In July 1971, the Spanish Government informed the Japanese Government that, as a provisional measure, it would continue applying the provisions of the abovementioned agreement until such time as a new agreement was signed, following negotiations between the two Governments. Since then, the two parties have had meetings from time to time with a view to drawing up a new> agreement. At meetings between the two delegations in June 1972 and March of this year, the Spanish authorities informed the Japanese authorities that, notwithstanding the fact that they are included in the restrictive lists of the agreement, Spain was applying the general import system on a de facto basis to the following textile products of Japanese origin which are included in lists A and B annexed to the agreement. 11 COM.TEX/SB/25 Page 11 Letter No.3¹ Geneva, 25 July 1974 I am replying with some delay to your letter of 3 May when you sent me the draft table concerning the Spanish notification of restrictions and asked me for certain additional information. The delay is due to the difficultly of obtaining the information requested from my Administration, because we have endeavoured to furnish the most detailed information possible. In addition, we have had to revise the draft tables that you sent us and this has also taken some time. I. Quantatives or values of imports subject to various types of general restrictions I enclose a table showing quantities and values for the year These data are taken from the customs statistics and accordingly they correspond to actual imports. (Table No.1.) On a separate sheet you will find data concerning our global quotas; these also refer to the year 1972, indicating the number and title of the global quota, the tariff headings to which the quotas refer and the value in pesetas of the global quotas opened for the year mentioned. (Table No. 20) The figures that I am sending concerning global quotas are designed to give an idea of the value of the quotas in They are not in any way designed to allow a detailed comparison to be made with the customs statistics referred to above, because the headings included in each of the global quotas do not correspond to the statistical tariff headings. It may be noted, however, thatthe figures corresponding to actual imports considerably exceed the size of the quotas opened and there are two reasons for this: 1. With respect to many quotas, practically all applications have been granted, even when they exceeded the levels of the quota as shown in table No. 2. TEX/SB/25 Page In the latter part of the year some headings were temporarily liberalized, and as a result actual imports were well above the quantities indicated when.ne corresponding global quotas were opened. Furthermore, the relatively high figures corresponding to many of our textile imports in 1972 are attributable to the general situation of international trade in textiles, at least in the second half of the year, and you are well aware of that situation. This has particularly affected Spain's imports of yarn, fabrics and made-up articles. For all these reasons the figures for 1972 should be considered exceptional. Il. Effective date and expiry date of the restrictions The restrictions in force in Spain form part of the restrictions as a whole that were in effect when the process of liberalizing our economy wasset in motion in It is not possible to indicate any expiry date for these because our balance-of-payments situation and our development needs do not allow any elimination of these restrictions to be contemplated for the time being. Apart from the present situation of international trade in general, the restrictions applied on our textile exports and the difficult situation facing our textile industry as a result of the general situation in Europe and even outside our continent make it impossible to set any dates for further liberalization measures, despite the fact that our authorities are fully disposed to continue the liberalization efforts that they resumed at the end of III. Comments on the general table (secretariat draft) Page 1 Heading No The product description given in the draft table is incomplete. The full text of the product description given in our communication of 3 April 1974 should be reproduced. In addition this heading is indicated as being subject toimport prohibition. This is an error which should be amended to read individual licensing with the addition between parenthesis of the words (imports not liberalized or subject to import quotas). In Spanish official terminology this would correspond to the licensing. This should be revised to take account of our communication of 3 April It contains errors of the kind mentioned for page 1. In addition, while certain headings mentioned in our communication have been rightly omitted, since they did not concern products covered by the Arrangement on Textiles, other have been omitted which, in our opinion, should be mentioned. The type of measures corresponding to heading No should be the same as for the headings preceding it. Pages 1 and 2 For the column Country affected replace all sources by all OECD countries and assimilated. IV. Comments on table conrcerning imports from Japan In the draft table concerning our restrictions visa-à-vis Japan, I believe that in the. general title the following should be added: bilateral trade agreement with Japan. This would avoid any confusion with bilateral agreements concluded within the framework of the Arrangement regarding Textiles or the Long-Term Arrangement. In this table concerning our restrictions on imports from Japan, the terms List A and List B, should be replaced. by List I and List II, in order to avoid any confusion with Lists A and B included in our agreements with Japan. In this way all the headings in List I would be those to which the general import régime has been applied on de facto basis, since March 1974, while the headings in List II would be those to which the special régime for imports of products from, Japan is applicable. In the two first lines of Column No. 1 of List I, the following should be included: A, B; A, B, and the letter C shown in the table should be deleted.

14 COM.TEX/SB/25. Page 14 The liberalization regime is applied on a de facto basis to all imports from Japan falling within Chapter 53. The headings are included in Table 3. Nevertheless, some of the headings in this chapter, which could therefore be omitted. we believe that the Arrangement regarding Textiles does not cover In respect of headings to we are adding a note which could appear as a footnote; otherwise these headings could be deleted. In column 3 type of measure applied the annotation shown in the facsimile annexed hereto should be included opposite each heading. In column8comments we believe that the text also shown in should be added. V.
