He is responsible for overseeing all of the legal functions for the corporation. In February 2016, he was named to the additional role of chief administrative officer where he oversees PNC s corporate ethics office, the PNC Foundation, Community Affairs, and the Office of the Regional Presidents. The Fifth Annual George and Susan Beischer Address Mick Mulvaney '92, U.S. Representative, South Carolina Introduced by: Martin H. Brinkley, Dean, UNC School of Law Congressman Mick Mulvaney '92 was first elected in November 2010 to represent South Carolina's 5th District. He currently serves on the House Financial Services Committee as well as the House Oversight and Government Reform Committee. Congressman Mulvaney graduated with a degree in Economics, Commerce, and Finance from Georgetown University and a J.D. from UNC School of Law. He is a serial entrepreneur, having started four businesses. His private sector experience is across many fields including law, real estate, homebuilding, and restaurants. In the Beischer Challenge, George and Susan Beischer agreed to match up to $1 million of grifts and pledges to the Center for Banking and Finance. The gift was completed in In honor of this transformative gift to the Center, its board of advisors voted to name the after-dinner address at the annual Banking Institute in honor of the Beischers. Clifford, Jr. Distinguished Lecture on Consumer Law [Salon II & III] Kelly Thompson Cochran 01, Consumer Financial Protection Bureau (CFPB) Introduced by: Martin H. Brinkley, Dean, UNC School of Law Kelly Cochran '01 is the Deputy Assistant Director for Regulations at the Consumer Financial Protection Bureau (CFPB). She came to the CFPB from the U.S. Treasury Department, where she worked on the policy staff on financial reform and consumer protection issues. Prior to joining Treasury in November 2009, Ms. Cochran practiced law with the firm of WilmerHale in Washington, D.C., with a focus on consumer financial services regulatory counseling and litigation. Ms. Cochran served as law clerk to the Honorable David S. Tatel on the United States Court of Appeals for the D.C. Circuit and the Honorable James Robertson on the United States District Court for the District of Columbia. She is a graduate of the University of North Carolina and the UNC School of Law.. The Clifford Distinguished Lecture on Consumer Law was established by the UNC School of Law and friends following Professor Clifford s death. Donald Clifford was the Aubrey L. Brooks Professor and served as a faculty member of Carolina Law from 1964 to 2004, specializing in commercial and consumer law. 4 2016 Banking Institute Speaker Biographies Luis M. Agosto Wells Fargo Luis M. Agosto is senior counsel in the litigation and workout division of the Wells Fargo law department. As a team member of the commercial workout section, he works closely with the bank s commercial workout teams for several lines of business, including wholesale banking, business banking, wealth, and Wells Fargo equipment finance. Prior to joining Wells Fargo, Agosto was a member of Moore & Van Allen, concentrating his practice on bankruptcy and financial restructuring. Agosto spent the earlier part of his legal career with Faegre & Benson (now Faegre Baker Daniels). Prior to attending law school, Agosto was a CPA working for KPMG and Coopers & Lybrand. Agosto received his BS and MAC from the University of North Carolina, and his JD from Vanderbilt University School of Law. Thomas H. Bentz, Jr. Holland & Knight LLP Thomas H. Bentz, Jr. practices insurance law with a focus on D&O, cyber, and other management liability insurance policies. Bentz leads Holland & Knight s D&O and management liability insurance team, which provides insight and guidance on ways to improve policy language and helps insureds maximize their possible insurance recovery. Prior to joining Holland & Knight, Bentz worked as a claims advocate for Marsh USA Inc., the world s largest insurance brokerage firm. Bentz also worked as a broker while at Marsh, negotiating and placing complex D&O insurance programs. Bentz received his BA in political science and communications from the University of Michigan. He obtained his JD from Loyola University Chicago School of Law. Joseph N. Callaway U.S. Bankruptcy Judge Joseph N. Callaway became a U.S. Bankruptcy Judge for the Eastern District of North Carolina in January Callaway is a certified specialist in both business and consumer bankruptcy law. He is a frequent speaker at bankruptcy law seminars, and past topics include lender liability in North Carolina, Fourth Circuit discharge appeals, uniform commercial code and bankruptcy intersection, and section 363 sales in bankruptcy. Previously, Callaway headed the creditor rights and bankruptcy practice of Battle Winslow Scott & Wiley in Raleigh and Rocky Mount, covering all U.S. Bankruptcy and District Courts in North Carolina. Callaway received his BA degree from the University of North Carolina at Chapel Hill, and his JD degree from UNC School of Law. 1
5 Richard D. Callicutt, II Bank of North Carolina Richard D. Callicutt, II serves as the president and chief executive officer of Bank of North Carolina. With Callicut s assistance and leadership, the Bank of North Carolina has grown form a start-up bank to a $6 billion bank in 24 years of operation. Callicutt has more than thirty years of banking experience. Prior to becoming the president and chief executive officer for the Bank of North Carolina, Callicutt joined the Thomasville, NC bank in 1991 as senior lender. In the early years of the Bank of North Carolina, Callicutt served as the chief credit officer, compliance officer, and the main lender. Callicutt was promoted to president and chief executive officer in June Callicutt attended High Point University where he earned his BS in business. He also serves as the current vice chairman of the North Carolina Banker s Association Board of Directors and is the incoming chairman of the North Carolina Banker s Association Board of Directors for Kelly Thompson Cochran Consumer Financial Protection Bureau Kelly Thompson Cochran is the assistant director for regulations at the Consumer Financial Protection Bureau. She previously served as the deputy assistant director for regulations and oversaw preparation of the Bureau s proposed and final rules implementing Dodd-Frank Wall Street Reform and Consumer Protection Act provisions concerning mortgage lending, servicing, and other topics. Cochran came to the Bureau from the U.S. Treasury Department, where she served as a policy advisor concerning the consumer and investor protection provisions of the Dodd-Frank Act and led the stand-up of the Bureau s rulemaking function. Cochran previously practiced law with the firm of Wilmer Cutler Pickering Hale and Dorr in Washington, D.C., with a focus on consumer financial services regulatory counseling and litigation. Cochran is a graduate of the University of North Carolina and the UNC School of Law, and a former clerk on the U.S. District Court for D.C. and the U.S. Court of Appeals for the D.C. Circuit. Emily R. Culler Bank of America Emily R. Culler is assistant general counsel and senior vice president at Bank of America. In her capacity, Culler provides in-house bankruptcy legal support to consumer lines of business. Prior to joining Bank of America, Culler was counsel at Stutman, Treister & Glatt Professional Corporation and O Melveny & Myers LLP. Culler represented debtors, debtors-in-possession lenders, committees, asset purchasers, and creditors in chapter 11 bankruptcy proceedings. Culler received her BA from the University of South Carolina, and she earned her JD from Columbia University School of Law. 2
6 Beth S. DeSimone CommunityOne Bancorp Beth S. DeSimone is the executive vice president and general counsel of CommunityOne Bancorp and CommunityOne Bank, N.A. in Charlotte, North Carolina. She joined the company in late 2011, after assisting in the company s recapitalization and merger with Bank of Granite Corp. As general counsel, DeSimone is responsible for corporate governance, enterprise risk management, internal controls, regulatory relations, compliance, corporate, legal, regulatory and securities law compliance, contract negotiation and vendor management, and corporate, community and investor relations. Prior to joining CommunityOne, DeSimone was an attorney at Arnold & Porter, LLP, Washington, D.C. for 27 years, where she practiced law in the corporate and financial institutions areas. While at Arnold & Porter, DeSimone focused on mergers and acquisitions of, and investments in, financial services companies, and in strategic planning activities and charter review. She also focused in the consumer banking area, structuring lending and deposit programs in the card and mortgage areas, and compliance with fair lending laws. DeSimone received a BA from Wheaton College and a JD from the Marshall Wythe School of Law at the College of William & Mary. Todd H. Eveson Wyrick Robbins Yates & Ponton LLP Todd H. Eveson is a partner with Wyrick Robbins Yates & Ponton LLP, where he serves as a member of the firm s executive committee and heads the banking and financial institutions practice group. His practice is focused on the representation of financial institutions and their holding companies in connection with regulatory, securities, mergers & acquisitions. and corporate law matters. He is a member of the firm s financial services practice group. Gilbert s emphasis has been in the representation of financial institutions and other institutional lenders. Harmon is in-house counsel for First Community Bank, a comprehensive community bank which currently operates fifty-one financial centers in North Carolina, Virginia, West Virginia, and Tennessee (under the trade name People s Community Bank). First Community Bank also provides wealth management and investment services through its wholly-owned subsidiary First Community Wealth Management, and First Community Bancshares, Inc. (FCBC), the bank s holding company, offers insurance services through its whollyowned subsidiary Greenpoint Insurance Group. Among Harmon s primary duties is the procurement and oversight of the insurance portfolio for the bank and its affiliates. 8 H. Lynn Harton United Community Bank H. Lynn Harton serves as the president and chief operating officer of United Community Banks, Inc. and its subsidiary bank, United Community Bank. Harton has more than thirty years of experience in the banking industry, with expertise in commercial banking, risk management, turnarounds, and change management. Harton is responsible for directing overall operations for United Community Bank and working alongside other members of senior management regarding the strategic direction and expansion of the $9.6 billion holding company. Prior to joining United Community Banks in 2012, Harton was a consultant and special assistant to the chief executive officer and executive vice president of commercial banking for TD Bank financial group, headquartered in Cherry Hill, New Jersey. Prior to joining TD Bank, Harton held the positions of president and chief executive officer, head of commercial banking, and head of credit and risk at The South Financial Group. He also held various executive positions at Regions Financial Corporation, Union Planters Corporation, and BB&T. Harton earned his bachelor s degree from Wake Forest University and has participated in various executive programs at Duke University, Wharton, Columbia, Northwestern, the University of North Carolina, and the University of South Carolina. Gregory B. Jordan The PNC Financial Services Group Gregory B. Jordan is executive vice president, general counsel, and chief administrative officer of The PNC Financial Services group. 9 Richard B. Levin Jenner & Block Richard B. Levin is a partner with the New York office of Jenner & Block. He practices in the areas of bankruptcy law and offers expertise for special situations in restructuring assignments for large-scale bankruptcy litigation and trustee and examiner engagements, and for distress M&S and distressed investing. He also advises clients with non-financial legal or regulatory challengers to help them resolve matters without litigation. Christopher Liu AIG Property and Casualty Christopher Liu is the head of cyber for the financial institutions group of AIG Property & Casualty and oversees the underwriting of network security products within the financial institutions division for the U.S. and Canada. Prior to assuming responsibility for the network security portfolio, Liu had a focus on a broader array of management and professional liability products for banks and non-bank lending institutions. AIG is a diversified global market leader, serving businesses and individuals worldwide. The firm's financial institutions group is a leading provider of management and professional liability insurance, cyber liability products, and customized risk solutions. Liu earned his bachelor s degree in economics from Rutgers University in New Brunswick, New Jersey. Gary McNorrill Bank Street Partners Gary McNorrill is the chief operating officer and the managing director of Bank Street Partners. He works closely with the firm s financial services clients to execute M&A transactions, capital raises, and strategic engagements. McNorrill also serves as general counsel to the firm. Prior to joining Bank Street Partners, McNorrill was the vice president of Edge Capital Partners, where he was responsible for the day-to-day operations of the corporate finance division. Earlier in his career, McNorrill was an attorney with Alston & Bird in its global finance and debt products group. 10 Bradley J. Miller United Community Bank Bradley J. Miller serves as executive vice president, general counsel, and chief risk officer of United Community Banks, Inc. In this capacity, Miller is responsible for the company s legal affairs and all facets of its enterprise risk management. He is the vice chairman of the bank counsel section of the Georgia Bankers Association and is a member of the regional bank counsel group of the American Bankers Association. Miller has more than twenty years of relevant experience. Prior to joining United in 2007, Miller was a litigation attorney with Kilpatrick Townsend with a focus in consumer and regulatory matters. Miller earned his bachelor s degree from Georgia Southern University and JD from John Marshall Law School. Glenn E. Morrical Tucker Ellis, LLP Glenn E. Morrical is a partner at Tucker Ellis in Cleveland. Morrical advises banks and their holding companies on transactional and regulatory matters, such as raising capital, buying and selling loans and branches, and complying with supervisory requirements. In 2009, as loaned counsel, he served in-house at a troubled $13- billion savings and loan and its holding company to assist in asset sales, attempts at raising capital, and dealing with increasingly challenging supervisory demands. In the ensuing years, he has represented that holding company in its bankruptcy, including extensive litigation with the FDIC. Morrical assists in capital raising transactions, both public and private, sometimes as issuer s counsel to a holding company and sometimes as placement agent counsel or underwriter s counsel to the securities broker-dealer. Having also headed or served as a senior executive with multiple banks compliance, technology, human resources, and operations functions, O Keefe s experience includes all aspects of litigation, regulatory compliance, governance, cybersecurity, risk management, and compensation, including the structuring and management of pension and equity plans. Prior to joining Moore & Van Allen, O Keefe was the general counsel of Bank of America Corporation. O Keefe was also the deputy general counsel for Deutsche Bank AG and chair of the Clearing House Association. O Keefe received his bachelor s degree from the University of Rhode Island, and he received his JD from the Fordham University School of Law. M. Patricia Oliver Tucker Ellis LLP M. Patricia Oliver is a partner with Tucker Ellis LLP in the Ohio office. Oliver is the chair of the firm s financial services industry team. Oliver s expertise includes securities, corporate governance, and M&A. Oliver also maintains an active practice representing banks and thrifts before federal and state regulators. Prior to joining Tucker Ellis, Oliver was at Vorys, Sater, Seymour and Pease where she represented Northeast Ohio-based financial institutions. Complementing her experience in private practice is her service as an inside advisor at BB&T Corporation where she served as executive vice president, general counsel, chief corporate governance officer, and corporate secretary. Oliver earned her JD from Case Western Reserve University School of Law, and she obtained her BA from Allegheny College. Patricia A. Robinson Wachtell, Lipton, Rosen & Katz Patricia A. Robinson is of counsel at Wachtell, Lipton, Rosen & Katz. Prior to joining the firm in 2010, Robinson was an assistant general counsel in the legal division of the Board of Governors of the Federal Reserve System. She managed the legal division s evaluation of M&A applications subject to Federal Reserve Board review under the Bank Holding Company Act, Bank Merger Act, Change in Control Act, and Federal Reserve Act. Before joining the Federal Reserve Board in 1993, Robinson was an associate at Sidley & Austin in the firm s financial institutions regulatory practice in its Washington, D.C. office. 12 Gregg Rozansky The Clearing House Gregg Rozansky is managing director and senior associate general counsel of The Clearing House. In that capacity, Rozansky leads the policy efforts of The Clearing House on a wide array of bank regulatory, compliance and corporate governance-related issues impacting large financial institutions. Rozansky is a frequent presenter on bank corporate governance and regulatory issues at leading financial industry events and has written extensively on the regulation of major banking institutions and regulatory reform, including the Dodd-Frank Act. Prior to joining The Clearing House in 2013, Rozansky advised financial institutions on U.S. bank regulatory and compliance issues in private practice at Cleary Gottlieb Steen & Hamilton and Shearman & Sterling, focusing on cross-border transactions and the implications of U.S. and global regulatory reforms and developments. Rozansky earned his BA in economics and government at Cornell University and a JD from Harvard Law School. At Harvard, he held a position as a Teaching Fellow in the Department of Economics. James W. Stevens Troutman Sanders LLP James W. Stevens is a partner at Troutman Sanders LLP in the Atlanta office. Stevens has substantial experience in the representation of public and private companies and financial institutions in mergers and acquisitions, securities offerings and regulatory reporting and compliance. Prior to joining Troutman Sanders in 2013, Stevens was a partner at Kilpatrick Townsend & Stockton LLP. Stevens earned his JD from the University of Georgia and a BS from the Georgia Institute of Technology. Jena M. Valdetero Bryan Cave Jena M. Valdetero handles a variety of commercial litigation and business disputes both locally and nationally before state and federal trial and appellate courts. Valdetero has represented a diverse array of clients, including mortgage lenders, mortgage servicers, commercial lenders, consumer product manufacturers, healthcare companies, major retailers, and individual parties. Valdetero heads Bryan Cave s data breach response team, with a specific focus on counseling, compliance, and litigation. In addition, Valdetero s practice includes advising and defending clients with respect to claims involving federal lending laws and regulations, including TILA, RESPA, FDCPA, FCRA, and state consumer protection claims, as well as defending clients against product liability claims, negligence claims, and wrongful death claims.
