Prior to this matter being assigned to Your Honor, the parties stipulated to a briefing schedule for any motions to dismiss the amended complaint in this action. That agreed-upon schedule provides for defendants' motions to dismiss to be filed and served by May 30, 2014, plaintiffs' oppositions to any motions to be filed and served by July and reply memoranda, if any, to be filed and served by August 22, Additionally, the GATE Defendants now seek enlargement of the page limits set forth in Commercial Division Rule 17(ii) (22 NYCRR (g)) ("Rule 17") for their memoranda of law in support of a motion to dismiss. Plaintiffs seek a commensurate enlargement of the page limit set forth in Rule 17 for their memorandum of law in opposition to a motion to dismiss filed by the GATE Defendants. All parties have conferred and consent to these requests for enlargement of the page limits. Accordingly, enclosed is an agreed stipulation, signed by counsel for all parties, regarding these requests and the previously agreed-upon briefing schedule. If the Court finds this stipulation satisfactory, the parties respectfully request the Court to so-order the enclosed stipulation.
