The abbreviation of the name of the organization shall be MLO. ARTICLE II Purpose: Mariachi Luz de Oro de Berkeley is a musical student-run group that performs traditional and modern mariachi music. We aspire to promote musical and cultural diversity by increasing exposure to the Mexican art form of mariachi. We aim to establish and maintain a performing group to inspire the lives of the community and its members. Article III Membership: Membership to this organization is open to any student, community member, alumni, and/or UC Berkeley staff, but shall be limited by the following: A. Individuals, with the exception of the elected historian, must have basic knowledge of a mariachi instrument: vihuela, guitarrón, guitar, violin, harp, trumpet, or flute. B.Student individuals must maintain above a 2.0 GPA if they are performing and/or practicing with the group. C.Individual instrument sections will be capped by the following: I. There will be no more than 9 violin members II. There will be no more than 5 trumpet members III. There will be no more than 6 guitar members IV. There will be no more than 3 vihuela members V. There will be no more than 2 guitarrón members VI. There will be no more than 3 harp members VII. There will be no more than 4 flute members Alumni and Non-UC Berkeley Members A. Alumni and non-uc Berkeley students are not considered active members, but they can still participate in practices and performances organized by the mariachi if permitted by the executive board.

2 * Only currently registered students, faculty, and staff may be active members in a registered student organization. Only active members may vote or hold office. * We will not haze according to California State Law. * We will not restrict membership based upon race, color, national origin, religion, sex, gender identity, pregnancy (including pregnancy, childbirth, and medical conditions related to pregnancy or childbirth), physical or mental disability, medical condition (cancer related or genetic characteristics), ancestry, marital status, age, sexual orientation, citizenship, or service in the uniformed services (including membership, application for membership, performance of service, application for service, or obligation for service in the uniformed services). Change to Article IV Officers and Elections: The Executive Board of Mariachi Luz de Oro undertakes the leadership and representative role of the organization. It shall be composed as follows: Co-Chairs (2 Individuals) Treasurer (1 Individual) Public Relations (1 individual) Historian (1 Individual) Secretary (1 Individual) Co-Chairs (2 Individuals) Mediate all the Mariachi Luz de Oro meetings and practices. The Co-Chairs reserve the right to delegate a representative in his/her absence. Will act as a representative and contact person for the organization. Responsible for overseeing Mariachi Luz de Oro s activities and guiding the organization. Will ensure adequate communication among the Board and members. Will collaborate with the Board to ensure completion of tasks and the fulfillment of responsibilities within each position as set forth by this constitution. Will draft agenda for meetings and follow up on points made at meetings. Will be in charge of seeking and booking performances throughout the semester. Treasurer Manages Mariachi Luz de Oro s ASUC-sponsored funds in addition to outside funding, and keeps all financial records current. Responsible for preparing all budgets, including but not limited to: semester/yearly budgets as well as budgets for Mariachi Luz de Oro s functions. Will be in charge of working with ASUC representatives to apply for semester/yearly grant funding. Will provide financial reports periodically at meetings. Will work with board to coordinate at least one fundraiser event per semester. Will be responsible for ensuring the best budget prior to any of the mariachi s necessary or

3 planned spending. Public Relations Responsible for coordinating and planning public performances at events such as Cal Day, Calapalooza, and Razapalooza or other public performances scheduled by Mariachi Luz de Oro. Will devise effective marketing strategies and plans to increase exposure to a general audience. Will be the liaison between Mariachi Luz de Oro and other UC Berkeley organizations and any university departments. Will work on creating stronger relationships with the student community at UC Berkeley. Will be in charge of effectively recruiting new members to the mariachi. Historian Only position that does not have to know how to play an instrument. Is in charge of maintaining an up-to-date document with Mariachi Luz de Oro s history. Will be taking pictures and/or video at all performances. Will be in charge of updating Mariachi Luz de Oro s official Facebook page, Twitter account, Instagram, Cal Links Organization Page, and website on a timely matter. Is responsible for, with the help of Public Relations, incrementing the number of followers on Instagram and number of Facebook Page likes. In charge of putting together and maintaining a scrapbook of performances, practices, and activities. Secretary Responsible for taking notes of important meeting updates and new propositions in an organized and comprehensive manner. Will be keeping track of members who attend meetings, practices, and performances. Will communicate his/her notes effectively to Board members upon request. Can communicate his/her general meeting notes to members upon request, but cannot (unless approved by the majority of the Board) communicate Board meeting notes to general members. Qualifications for a Mariachi Luz de Oro member to run for a board position: 1. Active member 2. Practicing and performing with Mariachi Luz de Oro for at least one (1) semester (with exception of Historian) 3. Minimum GPA of 2.5 Election Process: Officers will be elected by all active members of Mariachi Luz de Oro by majority vote. Board member nominations and elections will take place at the second to last meeting and last meeting of the semester respectively. o Fall Semester: Late November o Spring Semester: Late April

4 Any active member will be permitted to nominate anyone s eligibility Individuals running for a position will be required to give a speech about why they should be elected for that position Officers serve for one semester Officers can be reelected *The Co-Chairs (2 Individuals) serve as the primary signatories *Any board member missing more than 4 practices and meetings will be considered for removal and be placed under probation for two weeks. If the Board member does not fulfill his/her duties during that time, Board members (not including the person being considered for removal) have to agree unanimously to remove the board member on probation. *Mariachi Luz de Oro s hierarchical positions consist of: first, co-chairs; second, treasurer; third, public relations; and fourth, secretary. If a position becomes available due to the removal or resignation of a Board member, the next person in charge should take over the empty position until the secretary position is the only one available. Members will then nominate and vote on a new member that will take on the secretary position. *If the ascending officer does not wish to occupy the vacant position, he/she can request to opt out and remain in their previous position, in which case a special election for the vacant position will be held. Article V Meetings General Practices: The Board will determine the time and place for the minimum weekly two-hour practice. This meeting will be dedicated towards practicing the new and old repertoire. Co-Chairs will be in charge of calling the practices on or off. There is a minimum of three members needed for a formal practice to take place. At least a 48-hour notice is required from members to request missing a practice and/or meeting. Members who do not attend practices or who are excused from practices but show they have not made up the missing practice time at home will be penalized with one strike point per missed practice (see Strike Points). Board Meetings: The Board will determine the time and place of the board meetings. Board meeting will take place at least once a month to discuss each individual member s progress. Emergency Practices:

5 Emergency practices will be scheduled before performances. Executive Board members will be in charge of scheduling these meetings and communicating them to all eligible performing members. Strike Points A Strike Point is a penalty that will decrease the chances of a member to perform relative to other members in their section. Every member who does not attend a scheduled practice and mandatory meeting without having been excused from two days before will be given 1 (one) strike point for every practice or meeting he/she misses. Article VI Performances Performance Eligibility: A. Members who are performing must know most (preferably ALL) of the repertoire. New members cannot perform unless they have shown to know all scheduled repertoire. B. The members with the least amount of strike points per section can play at performances. If there is only one position left open to fulfill the limit of a particular section and two or more members are disputing over it: I. The member with the least amount of strikes will take the open position II. Performance Qualifications: If both have the same number of strikes, the member who is a UC Berkeley student will take the open position. III. If both are UC Berkeley students, the member with the longest time in the organization will take the open position IV. If both have the same amount of time, Board members will vote on the member who will take the last available position. In order for Mariachi Luz de Oro to perform there has to be at least one guitarrón, one trumpet, one violin, one vihuela, and one guitar. The maximum number of instruments per section for a performance has to be one guitarrón, one vihuela, one harp, two guitars, three flutes, three trumpets, and six violins. Mariachi Luz de Oro has to have at least one hour of repertoire in order to be booked for private events and should let clients know about the maximum amount of time we can perform without repeating songs. Performance Attire: Basic attire should consist of a white long-sleeve shirt, black dress pants, black dress shoes, black belt, and the blue custom designed Cal moño. New performance attire may

6 be used depending on the organization s budget. All members should be matching and be dressed in a professional manner. *Special accommodations may be made for members who cannot wear the basic attire due to religious, cultural, or belief reasons. Emergency Performances: Outside help from other mariachi members around the area might be used in case there is not enough members that can fulfill the performance qualifications. At least one Board member and two general members have to be present for these performances. The other helping mariachis will be paid using Mariachi Luz de Oro s privately earned money. Article VII Earnings and Fundraising All money earned, fundraised, and/or acquired through scholarships belongs to Mariachi Luz de Oro and should be used only for Mariachi Luz de Oro s travel expenses, all member s new (not basic) performance attire, private instruction of the mariachi as a whole, Mariachi Luz de Oro s community events, Mariachi Luz de Oro s social events, academic scholarships to UC Berkeley students (not part of MLO), and any other necessary spending that will benefit the growth of the mariachi s performance quality and/or the betterment of the UC Berkeley community. *Mariachi Luz de Oro will buy all new performance attire for all performing members, but the attire will be the property of the mariachi. If members wish to keep the attire, they can buy it from the mariachi at any time. If the attire is damaged the member who is/was wearing it has to buy it. *Founding members get to keep their first performance attire at no cost. Article VIII Partnership with other Campus Organizations Mariachi Luz de Oro will collaborate with other student organizations on campus at no cost as long as the type of collaboration or event will benefit the UC Berkeley community and/or future students. Article IX Constitutional Amendments The constitution of the Mariachi Luz de Oro can only be amended once a semester. Anyone can propose an amendment, however, it must be done so only with a 3/4 vote of the Board. Minimum time between a proposed amendment is 2 weeks and maximum time before final vote is a semester. After a vote, the board can change the item or article in question, or create new amendments. The board must then sign the newly revised

7 constitution and file copies of it with the appropriate entities. * All amendments, additions or deletions to this document must be filed with the LEAD Center in 102 Hearst Gym. Article X - Dissolution The Board and general members will decide dissolution. Dissolution is a vote of 100% of the Board and 3 4 votes of the active members. * All unspent ASUC funds shall remain the property of the ASUC; all Graduate Assembly funds shall remain the property of the Graduate Assembly. After 5 or more years of inactivity, any privately obtained funds left in accounts will be donated to the ASUC carry forward account.
