MM CUL 11: Control unauthorized access. The Applicant shall coordinate with the authorized officer of the BLM or local landowner/administrator at least 60 days before construction in order to determine if gates shall be installed on access roads, especially trails that would be dually used as access roads, to prevent unauthorized vehicular access to the ROW. Gate installation shall be required at the discretion of the land management agency. On trails proposed for multiple use as access roads, gates shall be wide enough to allow horses, bicycles, and pedestrians to pass through. The Applicant shall document its coordination efforts with the administering agency of the road/trail and provide this documentation to the administering agency and all affected jurisdictions 30 days prior to construction. Signs prohibiting unauthorized use of the access roads shall be posted on the installed gates. Background: Pattern Energy (on Behalf of Ocotillo Express) has attempted to make efficient use of existing BLM roads to the extent possible. However, due to overlap of cultural areas with existing BLM roads, many sections of these roads were not able to be used for the project and therefore new wind farm project roads bisect existing roads in several locations across the project area. Please note that only Open and Numbered BLM routes within the project area were considered for access control. Recommendation: In effort to control public access to both active construction areas and undisturbed portions of the project area via project road, Pattern Energy proposes either construction warning signs or temporary gates at approximately 35 locations as shown with the attached maps. The types of locations that may require signs or gates include the following:
2 Name Date Page 2 Locations where new project access roads intersect with the existing paved roads such as S-2, Route 98, and the private mine road. Locations where new project access roads intersect with major open and numbered BLM routes such as Dos Cabeza Road. Locations where project access roads intersect with open and numbered BLM routes that lead to relatively undisturbed portion of the project area. Locations where project access roads lead to locations that are out of sight distance from the open and numbered BLM routes. Pattern proposes either a single warning sign at these access points or temporary 20 to 36 wide rope or chain gates which will feature a reflective Sign in the middle of the gate. The warning sign will indicate unauthorized access prohibited. If used, the gates will be installed as low to the ground as possible to reduce risk to illegal motorcyles, while still being visible and un-passible to cars, trucks and jeeps. The gates can be supported on each side by temporary steel fence posts installed on both sides of the route being restricted. The temporary fence posts will be inspected on a regular basis to ensure fences are being maintained in good working order and repairs will be completed if necessary in a timely manner. If gate are used, the public access across project roads will controlled via the described gates during periods of high construction activity. During periods of low construction activity, access across construction areas will not be restricted, however the access onto project roads would be restricted. At some of the 35 locations, gates will need to be installed on both sides of the BLM route to meet the access goals described above. Conclusion: Pattern Energy requests that the BLM consider the recommendations on public access control as fulfilling the BLM mitigation measure CUL-11 as required for notice to proceed.
